AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING CHAPTER 10.24, RULES
OF THE ROAD, CREATING A NEW SECTION 10.24.020, APPLICABILITY--PARKING LOTS,
OF THE PORT TOWNSEND MUNICIPAL CODE, TO CLARIFY THE APPLICABILITY OF THE
WASHINGTON STATE MODEL TRAFFIC ORDINANCE TO PUBLICLY-OWNED PARKING
LOTS AND PUBLIC ACCESS PARKING LOTS
WHEREAS, in 1994, by Ordinance 2407, and pursuant to a directive from the Washington State
Legislature, the City Council of the City of Port Townsend adopted the Washington Model Traffic
Ordinance, including all Washington .statutes and regulations governing traffic safety and traffic control;
and
WHEREAS, the Washington Model Traffic Ordinance includes a broad range of traffic control
measures, including the parking regulations and criminal traffe violations, such as prohibitions against
negligent driving, reckless driving, and driving while intoxicated; and
WHEREAS, by adopting Section 10.24.020 PTMC pursuant to this Ordinance, the City Council
desires to make explicit that the Washington Model Traffic Ordinance applies on public streets within the
City of Port Townsend, as well as parking lots having public access to public streets and parking lots
owned by the City of Port Townsend. The purpose of this Ordinance is to provide for enhanced public
safety through imposition of standard and mandatory Washington public safety measures on properties
having direct access onto public streets; and
WlrlEREAS, the City Council finds that it is necessary for the protection of public safety to extend
the applicability of Chapter 10.24 PTMC to public access parking lots and City-owned parking lots, in
that operation of motor vehicles in public access parking lots which violates criminal and civil traffic
controls measures directly imposes hazards for motorists and pedestrians on public streets as well as in
parking lots,
NOW, TItEREFORE, the City Council of the City of Port Townsend ordains as follows:
SECTION 1. A new Section 10.24.020, Applicability--Parking lots, of the Port Townsend Municipal
Code is adopted and shall read as follows:

10.24.010 Washington Model Traffic Ordinance adopted.
Pursuant to RCW 35.21.180, authorizing adoption of state codes by reference, the city adopts by this
reference, as though fully set forth herein, the Washington Model Traffic Ordinance, Chapter 308-330
WAC, as the traffic code of the city of Port Townsend, as now or hereafter amended, including but
not limited to all other sections of the Revised Code of Washington incorporated by reference within
Chapter 308-330 WAC, as now or hereafter amended. (Ord. 2407 § 1, 1994; Ord. 2013 § 1, 1985;
Ord. 1869 § 1, 1980; Ord. 1634 § 1, 1972).
_10.24.020 Applicability--Parking lots.
A. Without limitation to the applicability_ of this Chapter 10.24 PTMC, all provisions of
this Chitpter 10.24 PTMC shall apply to all public access parking lots, including public access parking
lots owned by municipal corp_ orations and private persons or entities. For the purpose of this section,
"public access parking lots" means parking lots having a direct access to public streets.
B. Without limitation to the applicability_ of this Chapter 10.24 PTMC, all provisions of
this Chapter 10.24 PTMC shall apply to all parking lots owned or controlled by the Cit_v of Port
Townsend. (Ord. ~ § 1, 1998.)
10.24.030 Conflicts - Existing rules control.
Except as otherwise provided in this chapter, nothing herein shall be deemed a repeal of specitic
ordinances now in existence governing traffic control or parking, and, in the event of conflict with
existing ordinances, the existing ordinance shall control. (Ord. 2013 § 2, 1985; Ord. 1634 § 3, 1972).
SECTION 2. Severability. If any provision of this ordinance or its application to any person or
circumstance is held invalid, the remainder of the ordinance, or the application of the provision to
other persons or circumstances is not affected.
This Ordinance shall take effect and be in force five days after the date of its publication in the
manner provided by law.
Read for the first, second, and third times and adopted by the City Council of the City of Port
Townsend, Washington, at a regular meeting thereof, held this 5th day of October, 1998.
