HomeMy WebLinkAbout2691 Repealing Ordinance 2610, PTMC Chapter 2.04.045 Council President and Mayor Pro TemOrdinance No. c~9/~ ~/ AN ORDINANCE OF THE CITY OF PORT TOWNSEND REPEALING ORDINANCE NO. 2610, CODIFIED AT SECTION 2.04.045, COUNCIL PRESIDENT AND MAYOR PRO TEM, OF CHAPTER 2.04, CITY COUNCIL RULES, OF THE PORT TOWNSEND MUNICIPAL CODE WHEREAS, at a regularly scheduled meeting on November 3, 1997, the City Council adopted Ordinance No. 2610, establishing a new Section 2.04.045 PTMC, Council president and mayor pro tem, creating a "job description" and establishing minimum qualifications for the Council President and Mayor pro tem position; and WHEREAS, since the adoption of Ordinance 2610, Port Townsend has changed its form of government to Council-Manager and elected a new City Council. The provisions of Ordinance 2610, as codified in Section 2.04.045 PTMC, unduly restrict the nomination, appointment and role of the Mayor pro tem; and WItEREAS, until the City Council adopts new rules and procedures, RCW 35A. 13.035 will sufficiently describe and govern the appointment and role of the Mayor pro tem, NOW, THEREFORE, the City Council of the City of Port Townsend does ordain as follows: SECTION 1. Chapter 2.04, Port Townsend City Council Rules, Section 2.04.045, Council president and mayor pro tern, of the Port Townsend Municipal Code is hereby repealed in its entirety. [REPEALED] 2.04.045 Council president and mayor pro tem. The city council at its first business meeting of the calendar year, or at such time as a vacancy shall occur, shall elect from its membership a council president who shall also serve as the mayor pro rem. A. Qualifications. As an official representative of the city council, qualifications for the position include a minimum of one and one-half years' experience on the city council. The person elected by his or her peers on the city council possesses, in their judgment, the following additional qualifications: knowledge of the workings of city government, experience working with community groups, and the skills of diplomacy and judgment in accomplishing the priorities of the city council of the city of Port Townsend. B. Duties and Responsibilities of the Council President. The council president's duties and responsibilities for overseeing and maintaining the council's internal operating procedures, include: 1. Monitoring the council's use of adopted council operating procedures; 2. Facilitating changes and updates as needed by bringing proposed changes to the council; 3. Orienting new members to the city council; and 4. Assuming such other duties and obligations :as provided by law or as prescribed to such office from time to time by the city council. C. Duties and Responsibilities of the Mayor Pro Tern. The duties and responsibilities of the mayor pro tern shall include the following: 1. Preside at the council meeting in the absence of the mayor; 2. Act on the mayor's behalf during the mayor's absence from the city and with such power and authority as the mayor may grant in writing; 3. Upon request of the mayor, the council president will also represent the city at official or ceremonial functions when the presence of the mayor and/or a council representative is required; and 4. Assume such other duties and obligations as provided by law or as prescribed to such office from time to time by the mayor. D. At any time there is reference in this code to "mayor," it shall include the mayor and/or his or her specific designees acting with the mayor's authority. (Ord. ~ § 1, 1999; Ord. 2610 § 1, 1997). SECTION 2. Emergency. As adopted, Ordinance 2610 impedes the ability of the City Council to choose and appoint a Mayor pro rem. Therefore, in order for the City Council to effectively organize itself, it is imperative that Ordinance 2610 be repealed, effective immediately. Therefore, the City Council hereby declares an emergency to exist. SECTION 3. Severability. If any provision of this ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance, or the application of the provision to other persons or circumstances is not affected. This ordinance shall take effect and be in force immediately upon enactment. Read for the first, second, and third times and adopted by the City Council of the City of Port Townsend, Washington, at a regular meeting thereof, held this 16th day of February, 1999.
