AN ORDINANCE VACATING A PORTION OF 32ND STREET MEASURING 100
FEET LONG BY 28.5 FEET WIDE BETWEEN THE LANDES STREET AND
HAINES STREET RIGHTS-OF-WAY IN THE ROSEWIND CO-HOUSING
PLANNED UNIT DEVELOPMENT IN THE CITY OF PORT TOWNSEND;
ESTABLISHING CONDITIONS TO THE STREET VACATION; AND
ESTABLISHING AN EFFECTIVE DATE.

WHEREAS, the City Council for the City of Port Townsend has considered Street Vacation
Application No. LUP96-79 (Rosewind PUD Homeowner's Association), and following due
notice has held a public hearing upon the application; and
WHEREAS, the City Council for the City of Port Townsend adopted its Findings of Fact and
Conclusions on July 20, 1998; and
WHEREAS, the applicant has paid to the City one-half of the appraised value of the area to be
vacated; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DOES ORDAIN AS
FOLLOWS:
Section 1. That the following street is hereby vacated to Rosewind Inc:
That portion of 32nd Street measuring 100 feet long by 28.5 feet wide between
the Landes Street and Haines Street rights-of-way in the Rosewind Co-housing
Planned Unit Development. The vacation does not include the north 20 feet of
this portion of 32nd Street. This area would remain available for utility, non-
motorized trail, and emergency access purposes.

Section 2.
That the street vacation aforementioned is conditioned, however, on the
following:
a)
Future construction within the 28.5 foot by 100 foot vacated street right-
of-way shall be subject to'building setbacks as defined by Title 17 of the
Port Townsend Municipal Code. The applicable building setbacks will.
be ten (10) feet as measured from adjacent street rights-of-way (Landes
Street and 32nd Street).
b)
A certified copy of the ordinance vacating the street shall be recorded by
the City with the office of the Jefferson County Auditor.
Section 3.
This ordinance shall take effect upon its passage, approval and publication in the
form and manner provided by law, and after it has been recorded with the
Jefferson County Auditor pursuant to Section 2 of this ordinance.
Read for the first, second and third times, passed by the City Council for the City of Port
