AN ORDINANCE VACATING McCLELLAN STREET-FP. OM THE SOUTHERLY
CORNERS OF BLOCKS 260-261 TO THE NORTHERLY EDGE OF THIRD
STREET BETWEEN BLOCKS 280-281, SUPPLEMENTAL PLAT TO THE
EISENBEIS ADDITION TO THE CITY OF PORT TOWNSEND; ESTABLISHING
CONDITIONS TO THE STREET VACATION; AND ESTABLISHING AN
EFFECTIVE DATE.

WHEREAS, the City Council for the City of Port Townsend has considered Street Vacation
Application No. LUP99-34 (Jefferson Transit Authority), and following due notice has held a
public hearing upon the application; and
WHEREAS, the City Council for the City of Port Townsend adopted its Findings of Fact and
Conclusions on August 16, 1999; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DOES ORDAIN AS
FOLLOWS:
Section 1.
That the following street is hereby vacated to Jefferson Transit Authority, a
Municipal Corporation:
That portion of McClellan Street from the southerly corners of Blocks 260-261
to the northerly edge of Third Street between Blocks 280-281, Supplemental
Plat to the Eisenbeis Addition to the City of Port Townsend.

That the street vacation aforementioned is conditioned on and subject to the
following:

Prior to recording this Ordinance, the applicant has conveyed by Statutory
Warranty Deed to the City Lots 3-8 of Block 281 in the Supplemental Plat to the
Eisenbeis Addition less that portion of vacated McClellan Streets that would attach
by operation of law.
Section 3.
The standard fee of one-half of the appraised value of the land shall be waived
as the property owner has dedicated six platted lots, an area of approximately
30,000 square feet to the city. The land offered in trade to the city for the
vacated right-of-way is located within a critical drainage corridor which the city
has identified as "Potential Park and Open Space" on the adopted Land Use Map.
This overlay was applied to "...areas that.may have the potential to be included
within a comprehensive and interconnected system of open spaces and trails. The
overlay appears in areas that could be valuable if maintained as open spaces, such
as wooded areas, drainage corridors, and scenic vistas." (Emphasis added).
Acquisition of lots within the drainage corridor would implement a goal and
related policies of the City of Port Townsend Comprehensive Plan. Goal 23 of
the Capital Facilities & Utilities Element of the Plan generally sets forth a
preference of using "natural drainage systems" to manage stormwater quantity.
Under theat goal, Policy 23.1 is to "(p)reserve natural surface and subsurface
drainage systems to the maximum extent possible", and Policy 23.1.1 is to
"(p)rotect and preserve critical drainage corridors and wetlands".
Section 4.
This ordinance shall take effect upon its passage, approval and Publication in the
form and manner provided by law, and after it has been recorded with the
Jefferson County Auditor pursuant to Section 1 of this ordinance.
Read for the first, second and third times, passed by the City Council for the City of Port
