AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING ORDINANCE
1564 AND EXTENDING THE ELECTRICAL DISTRIBUTION SYSTEM FRANCHISE
TO PUGET SOUND ENERGY UNTIL DECEMBER 31, 2000, UNDER ALL TERMS AND
CONDITIONS OF ORDINANCE NO. 1564
WHEREAS, on February 18, 1969, at a regularly scheduled City Council meeting, the
Port Townsend City Council adopted Ordinance No. 1564, granting Puget Sound Power & Light,
and its successors and assigns, the non-exclusive right, privilege, authority and franchise to
construct, erect, alter, improve, renew, repair, operate and maintain electric transmission and
distribution lines within the City of Port Townsend. Section 1 of Ordinance No. 1564 provides
that the franchise is for a 30-year term. Puget Sound Energy (PSE) is the successor and assigns
of Puget Sound Power & Light; and
WHEREAS, on February 16, 1999, at a regularly scheduled City Council meeting, the
Port Townsend City Council adopted Ordinance No. 2690, extending PSE's electrical
distribution franchise in Port Townsend for an additional 18 months until August 21, 2000; and
WltEREAS, on September 7, 1999, at a regularly scheduled City Council meeting, the
Port Townsend City Council appointed four individuals to a citizens' franchise advisory
conur, ittee to make recommendations for PSE's franchise agreement with the City; and
WHEREAS, on June 15, 2000, the franchise advisory committee published its final
report including recommendations for franchise negotiations with PSE; and
WHEREAS, Mr. Don McDaniel, PSE's representative, has requested of the City
Manager an additional extension of the existing franchise agreement until December 31, 2000,
NOW, THEREFORE, the City Council of the City of Port Townsend does ordain as
follows:
SECTION 1. Franchise Agreement Extended. The electrical power transmission and
distribution granted by Ordinance No. 1564 and extended by Ordinance No. 2690 to Puget
Sound Energy, as successor and assign of Puget Sound Power & Light, is herebY extended, and
shah expire on December 31, 2000. Section 1 of Ordinance No. 1564, which was extended by
Section No. 1 of Ordinance No. 2690, is hereby amended to extend the term of the PSE franchise
in accordance with this Ordinance. With the exception of the expiration of Ordinance No. 1564
extended herein, ah terms and conditions of Ordinance No. 1564 are reaffirmed without further
amendment, and are incorporated herein by this reference.
SECTION 2. Effective Date. This Ordinance shall take effect and be in force five days
after the date of its publication at, er final adoption in the manner provided by law.
SECTION 3. Severability. If any provision of this Ordinance or its application to any
person or circumstance is held invalid, the remainder of the Ordinance, or the application of the
provision to other persons or circumstances is not affected.
This ordinance shall take effect and be in force five days after the date of its publication
in the manner provided by law.
Adopted by the City Council of the City of Port Townsend, Washington, at a regular
