February, 1978, at ?:30 p.m. in t~ Cduncil Chambers of the City Hall, Mayor Ooseph 8. Steve presiding. ROLL CALL Councilmember present at roll call were Tom Camfield, Dale 3udy, Richard Shaneyfelt, 3ames Parker, Elizabeth Smith'and 3a~es Wilson. 'Councilmember 3oseph Ciprioti arrived-at 7~34 p.m. Also present were'City Engineer Roger French, Clerk-Treasurer Dave Grove, and Attorney Harry Holloway III. SPECIAL 8USINESS Mayor Steve indicated the meeting was called to discuss application No. ~??11=05 for rezone of property bounded by Sims ~ay, Kah Tai Lagoon, Decator St., and the alley between Kuhn and Haines Streets all within the SE~ 1/4 of the NE 1/4 of Section 10; and the 5 1/2 of the NW 1/4 of Section 11; within Township 3ON, RlW, ~, 3efferson County. He explained that at the Council's request, he secured the services of Harry Holloway III to review the application for a Plan- ned Unit Development submitted by the Port of Port Townsend and advise the City Council whether the application met with the ~equirement of City Ordinance No. 1625, Section 4.05, Planned Unit Development. He then called upon ~r. to give his opinion. Mr. Hollo~ay stated that the Port's application is defi- Cient in several material respects and~p~ovides insufficent information to permit the approval of the application. He ~ec~mmended that the~application be denied o~ continued until adequate information is provided for a deci.~ion. He then viewed the specific sections of the Ordinance that have not bean addressed in the application or that have insufficient information ~hich were outlined in his written opinion. Councilmember Shaneyfelt asked if Mr. Hollo~ay had revie~ed this applica.~ tion in regard to the Comprehensive Plan. Mr. Holloway indicatad'that he did review the Comprehensive Plan but he considered that the Zoning90rdinaece super- sede the Comprehensive Plan because it was approved more ~ecently. Councilmember Smith asked what difference appear between the Zoning Ordi- nance and the Comprehensive Plan. M~. Hollo~ay indicated the Comprehensive Plan proposed that ~he area considered in this application be designated for open space. The Zoning Ordinance labeled the area P-1 but at the same time provided Planned Unit Developments. Councilmembe~ shaneyfelt suggested that Mr. Holloway be hired ~o study the Zoning Ordinance as it pr~tains to the Comprehensive Plan to determine which takes precedence. Councilmember Ciprioti stated that the Comprehensive Plan is only a guideline. Councilmember Camfield quoted sections of the Zoning Ordinance that specifically refer to the Comprehensive plan. Councilmember Camfield quested the same study. Councilmember Shaney~elt ~sked ho~ long it ~ill take to update the Compre- hensive Plan. Mr. Marsh from the Planning Commission was recognized ~nd stated that the budget allocation given them by the Council was not sufficient to ac- complish this. Councilmember Smith stated that ~h~ wished that more public inpot had been obtained in the planning stages, mayor ~teve commented that when a matter of thismagnitude comes up, he would like to see it 9o on a ballot to 9et public opinion. Councilmember Camfield indicated this is why we have elected officials. Councilmember 3udy explained that ~h~-Port and City have been working on this application for nine months, in public meetings. mayor Steve asked if mr. Holloway would study.the inter-relationship of the Zoning Ordinance and the Comprehensive Plan. mr. Grove read a letter f~om Susan Enfield dated February l?, 1978, re- garding the proposed livestoc~ ordinance, Grace Umbarger dated February 20, 1978,~ regarding the proposed livestock ordinance, Carroll m. mercer, Chairman of ~the 3efferson County Commissioners dated February 21, 1978., regarding ~olid ~aste dumping charges for Olympic Disposal which mayor Steve instruc~t~d be~rsviewed with the City Attorney, Kay ~ojt ~ilson, dated February 21, 1978, regarding her r~signation f~om the Planning Commission. mayor Steve asked that a letter of appreciation be written to msj ~ilson. mr. Grove then read a letter from 3anet mosher dated February 1~, 1978, regarding animal licenses which was referred to _the Police and License Cdmmittee by mayor Steve. mr. Grove read a letter from Charles E. ~allin dated February 14, 1978, regarding the Ka5 Tai Lagoon Develop- ment.
