Looks like the new Fillmore sewer stub out has already proven useful as it has been
connected to a surprise sewer line from the 1136 Water St building.
i netlae that my ogin, at my eorr of 4' lkr W,,rV, and t7NAut ha b111110116+wY ar4** tw1a,0Veatl, l
had not agreed to its removal as it has gtAe a history with aggravation from the City. (
"Feather flag on It was too long and too colorful") The sign is vital for other notices and I
will need it replaced essentially in the same locatlon and just as skookum as it tends to get
hit amazingly often by camper pickups, Rvs etc. Concrete/metal base but 4 X 6 treated
wood upright would be best. Some of my parking lot asphalt has been damaged beyond
cuts done, presumably that will be corrected. I was curious that CR #15 has not been
installed despite excavated area being compacted. ICI has certainly had some impact in my
lot but they have been responsive to requests for getting things out of the way of
customers at lunch time. It would of course be ideal if they could confine work in the lot to
the hours before llam but that is flexible. The restaurant business has suffered significant
impact already so it would be nice to get t1*V iwerrtwditsr,d up ASAP.

Jim
Hi Laura,
You did not respond directly or indirectly to my emails. As a result when I got to town early
afternoon the forms for the wall were being erected and nobody had any knowledge or
had addressed my concerns. I IIIIIII Vrm!Aad and winuld n(Mtn kiock motto ft pro am WWA

with it. The ideal would have been to have the meter and shut off accessible at the edge of
the property line, whereas It is eight feet or so from the property line with a mickey mouse
connection to the pressure reducing valve and then to an iron pipe and from there to my
property line where it becomes polypropylene. 1 imservos w rbM f

Scott Studeman for the City was present and was helpful in making sure the repair got
done. I am attaching some photos that document the saga.

Jim McCarron:
The City is continuing our work on the Water Street Project and had a few items we wanted
to follow up with you about.
1. The sign below is on your property directly adjacent to the public right-of-way where
the City will be doing sidewalk work. In order to complete the project work, the City
would need to remove this sign and post. Would you like the City to put it back in
the same location and on the same pole and foundation when the project is done?

Dear Steve.
I am addressing this to You as I know you were in the tight loop after the 1206-1208 Water
Street water leak was detected. I had talked to Rich Diesel and explained to him that I had a
strong suspicion as to where the leak was most likely situated. Because I have two properties
abutting Water Street I "bird dogged" the Water Street improvement project pretty closely, I also
granted an easement to the City and made several concessions to facilitate the project.
On May 18th 2018 1 noticed a freshly broken pipe in the area that was being prepared for
the sitting wall parallel to the 1206-1209 property. I suspected that the pipe was a riser from a
shut Off valve on my water line. I was concerned that there might be damage to the water line
so I talked to Scott Studeman about my concerns. I believe that it was on his request that the
City's Contractor/Agent had the area of concern excavated. it was immediately evident that
there was a substantial leak at the shutoff valve where it connected to 3/4" poly tubing that fed
my building. The leak location was only 101from the planned water meter location and in my
opinion the 1-nost logical fix wouldhave been to run a poly or pex tube and avoid the' rat's nest"
already existing in the "new meter box" location.1 had assumed at that time that the mess in the
meter box would, be brought to code before project completion.
The Contractor "fix" for the leak they had caused was most unsatisfactory and I had no
problem expressing my skepticism. I don't know if Scott remembers the event but I am pretty
sure fie was a witness to the unprofessional "fix". I took a number of photographs as I felt sure
future problerns were inevitable. It is evident from my photos that there are several problems
with the repair.
When Rich contacted me on Friday about the evident significant leak I 'told hii-n about my
concerns about the location being in the City easement and a direct consequence of a shoddy
repair done by City agents in 20181 suggested that City perform excavation and repair and
promised that if the leak was not where I suspected I Would be happy to reimburse the
City. U nfortUnately you Steve did not agree to that proposal. I therefore, contracted with Leavitt
who came immediately and excavated the problem. When the area was exposed turning on the
water showed the leak at the botched repair. I made a video to demonstrate the big leak exactly
where I predicted it would be. d, We will proceed to a proper repair and
The excavation is still open but protecte
installation of an access box unless the City has a better idea. Ideally the Water Meter deficit
should be addressed at this juncture.1bri feet of pipe could correct current deficiencies and
ivoid several potential future problems.
Please give your urgent attention Jo this problem.
A correct repair of the line needs to be quickly established so the restaurant can reopen on
Tuesday.
If pipe connecting the meter to my property line is not replaced now I need permanent access to
the shutoff valve as existed prior to destruction of the shutoff riser by City agents. At this time
Leavitt plans an access "vault"'.
It Would be nice to keep this, "process"' simpie but just in case I am copying Heidi, so she has an
early opportunity to give her input.
I will send relevant photos in a separate email as the files are large and the City barriers even
larger.

A very one sided agreement but Note especially " in the case of
any damage or disruption of the Parent Parcel, the City shall
return the property to a condition as good as or better than its
condition immediately before entry and/or work was made
thereon by the City or its agents".
Grievances:
1: Access riser for shutoff valve was destroyed and not
replaced.
2: Water supply pipe was damaged and not correctly repaired.
3: Significant water was lost and adjustments need to be made
to my tenant's water bills. ( He had noted increased billings over
past several months but had not brought it to my attention.)
