It was great to get the good news regarding our building permit and the change to the ordinance that would result in us obtaining the permit without having to record any notices to our title. We are definitely still interested in obtaining the permit for our back porch remodel and hereby cancel our previous withdrawal from the permit process. We will come in to get the permit after the August 2nd date you indicated, and pay any fees due. Thank you for all you have done to help us in this matter. Although we were frustrated at times, as you know, the frustration was never meant to be directed to you personally, and we very much appreciate your persistence and communication. Thank you for sharing the letter with the Director, Planning Manager and Planner in your recent meeting. I would definitely appreciate being contacted in the case that the critical areas ordinance comes up for review in the future. Although I realize I cannot recover the money we spent so far on the permit process, I appreciate the idea that I may be able to have these fees credited toward future application if I decide to re-apply for our porch. After more closely examining the Notice to Title and Hold Harmless Indemnification Covenant you provided to us, we feel it would be unwise to attach these documents to our title for a number of reasons. We have been advised that, due to the explicit language of the documentation, it could negatively affect the sale of our home at some future point by giving the buyer an unfair bargaining point that our house was constructed in a Seismic Hazard area. We also feel that under the current economic climate, it may adversely affect future re-financing or home equity loans, as well as earthquake insurance or homeowner’s insurance. As you might imagine, it is difficult for us to put a halt to a project that we have been anticipating completing since we moved into our home. It is worth noting that the porch addition that has been submitted for approval has already been through the permit process, and approved, when the rest of the house was approved for permit, back in 2003. Due to lack of funds at the time, we were unable to complete the porch portion of our house and chose to get the final inspection carried out anticipating that we would have no problem completing the porch a few years later. The proposed porch is enclosed by two sides of the existing house and I believe the issue at hand comes down to a mere 2’ by 2’ footing. It is difficult to fathom any negative repercussions (from a building standpoint) from building on this soil after having built the rest of the house and observing first-hand the favorable soil conditions. It is my understanding that in order to obtain a permit without the Notice to Title, we will need to hire a soils engineer as well as a building engineer to design a footing that will then need to be submitted for building review. Please inform us of the steps we need to take in this matter in case, at some future date, we choose to spend the extra funds that would be required. I appreciate the work you have done in trying to help us through this process. Our experience with you and the rest of the building department when we built our home was absolutely positive. Please let us know if anything should change in the future that would favorably affect our permit. The applicants, Steven and Lisa Anderson, propose to undertake the improvements described above within a mapped critical area within the City of Port Townsend. Specifically, the site is mapped as a seismic hazard. The mapped predominant soil type is Hoypus Gravelly Loamy Sand 15 — 30%. However, the slope on the property is approximately 10%. PA The regulations for seismic hazard areas are intended to maintain the natural integrity of hazardous areas and their buffers in order to protect adjacent lands from the impacts of landslides, mudslides, subsidence, excessive erosion and seismic events, and to safeguard the public from these threats to life or property. 2, Pursuant to Section 19.05.040 E(1)(j) of the Port Townsend Municipal Code, the director may waive compliance with the application requirements and delineations requirements of this section and compliance with the performance standards for development contained in PTMC 19.05.060 for development proposals which contain only aquifer recharge areas, frequently flooded areas or seismic hazard areas. 4. The director finds that the performance standards provided for in the individual critical area regulations for Seismic Hazard areas are met and no purpose established under this chapter would be furthered by requiring compliance with application requirements or the performance standards for development. In accordance with the recent procedural amendments to PTMC 19.05.050, the director waives the recording of a Hold Harmless Agreement and Notice to Title as no useful purpose would be served. Conditions 1. All development shall be in substantial conformance with the development plans submitted. There shall be no further expansions to or addition of any structures/impervious surfaces without prior review for conformance with the Critical Areas Ordinance codified in Chapter 19.05 of the Port Townsend Municipal Code and any other applicable laws and ordinances. 2. All development subject to the provisions of this chapter shall comply with the 2005 Department of Ecology Stormwater Management Manual for Western Washington (SWMM-WW (2005)), City engineering design standards manual, City stormwater master plan, and adopted drainage basin plans. 3. Standards for development of structures and improvements in seismic hazard areas shall be in accordance with the provisions of building and construction codes as currently adopted by the City. No additional setback or other requirements are necessary to regulate structural design.
