Compliance is demonstrated separately for each of the three systems described above. One exception to this, the system analysis compliance approach, determines the energy efficiency of the building as a whole rather than for each system. Energy code compliance must be addressed at the time of building permit application. For each of the three building systems, compliance must be demonstrated in two general areas. ° Compliance with a series of general requirements that apply, regardless of the compliance path chosen. ¢ Compliance with the requirements of one of the optional compliance paths, in order to demonstrate overall energy efficiency of that system. Compliance Options For each of the three building systems, there are three optional NREC compliance paths. The availability of three options simplifies code compliance in many situations, yet offers design flexibility when needed. The three compliance options are illustrated in the figure below. Since these forms will be evaluated for completeness and accuracy, you can avoid unnecessary permit delays by carefully providing all required information. Disregard items that don't address your particular building or equipment. Design Changes Be sure to get prior approval from the Department if you wish to make changes in your project during construction. Code Books For more detail, refer to the 2003 Washington State Energy Code, and the 2003 Ventilation and Indoor Air Quality Code. Both may be obtained, for free, from Washington State University’s Energy Program website (www.energy.wsa.cdu). The NREC compliance forms may be obtained from the Northwest Energy Efficiency Council (NEEC) www.neec.net. Automatic time switches must also have program back-up capabilities, which prevent the loss of program and time settings for at least 10 hours, if power is interrupted. 1513.6 Automatic Shut-Off Controls, Interior: Office buildings greater than 5,000 sq. ft. and all school classrooms shall be equipped with separate automatic controls to shut off the lighting during unoccupied hours. Automatic controls may be an occupancy sensor, time switch, or other device capable of automatically shutting off lighting. EXCEPTIONS: 4. Areas that must be continuously illuminated, or illuminated in a manner requiring manual operation of the lighting. 2. Emergency lighting systems. 3. Switching for industrial or manufacturing process facilities as may be required for production. 1513.6.1 Occupancy Sensors: Occupancy sensors shall be capable of automatically turning off all the lights in an area, no more than 30 minutes after the area has been vacated. 1513.6.2 Automatic Time Switches: Automatic time switches shall have a minimum 7 day clock and be capable of being set for 7 different day types per week and incorporate an automatic holiday "shut-off" feature, which turns off all loads for at least 24 hours and then resumes normally scheduled operations. Autornatic time switches shall also have program back-up capabilities, which prevent the loss of program and time settings for at least 10 hours, if power is interrupted. Automatic time switches shall incorporate an over-ride switching device which: a) is readily accessible; b) is located so that a person using the device can see the lights or the areas controlled by the switch, or so that the area being illuminated is annunciated; and c) Is manually operated; d) allows the lighting to remain on for no more than two hours when an over-ride is initiated; and €) controls an area not exceeding 5,000 square feet or 5 percent of footprint for footprints over 100,000 square feet, whichever is greater. 1513.7 Commissioning Requirements: For lighting controls which include daylight or occupant sensing automatic controls, automatic shut-off controls, occupancy sensors, or automatic time switches, the lighting controls shall be tested to ensure that control devices, components, equipment and systems are calibrated, adjusted and operate in accordance with approved plans and specifications. Sequences of operation shall be functionally tested to ensure they operate in accordance with approved plans and specifications. Exceptions: 1, Special occupancy, special usage, or code requirements where deadband controls are not appropriate. 2. Buildings complying with Section 1141.4, if in the proposed huilding energy analysis, heating and cooling thermostat setpoints are sat to the same temperature between 70 degrees F and 76 degrees F inclusive, and assumed to be constant throughout the year. 3. Thermostats that require manua! changeover between heating and cooling modes, 4412.3 Humidity Controts: If a system is equipped with a means for adding moisture, a humidistat shall be provided. 1412.4 Setback and Shut-Off: HVAC systems shall be equipped with automatic controls capable of accomplishing a reduction of energy use through control setback or equipment shutdown during periods of non-use or alternate use of the spaces served by the system. The automatic controis shall have a minimum seven-day clock and be capable of being set for seven different day types per week. Exceptions: 1. Systems serving areas which require continuous operation at the same temperature setpoint. 2. Equipment with full load demands of 2 KW {6,826 Btu/h) or less may be controlled by readily accessible manual off-hour controls. 1412.4.1 Dampers: Outside air inlakes, exhaust outlets and relief outlets serving conditioned spaces shall be equipped with dampers which close automatically when the system Is off or upon power failure. Exceptions: 1. Systems serving areas which require continuous operation. 2. Combustion air takes. 3. Gravity (nonmotorized} dampers are acceptable in buildings 4 less than 3 stories in height Gravity (nonmotorized) dampers are acceptable in exhaust ang relief outlets in the first story and levels below the first story of buildings three or more stories in height. 1412.4.2 Optimum Start Controls: Heating and cooling systems with design supply air capacities exceeding 10,000 cfm shall have optimum start controls, Optimum start controls shall be designed to automatically adjust the start time of an HVAC system each day to bring the space ta desired occupied temperature levels immediately before scheduled eccupancy. The control algorithm shall, as a minimum, be a function of the difference between space temperature and occupied setpeint and the amount of time prior to scheduled occupancy. 1412.6 Heat Fump H eat pumps shall include microprocessor controls that minimize supplemental heat usage during start-up, set-up, and defrost conditions. These controls shall anticipate need for heat and use compression heating as the first stage of haat. Contrals shall indicate when supplemenial heating is being used through visual means (e,g,, LED indicators). 1412.6 Combustion Heating Equipment Controls: Combustion heating equipment with a capacity over 225,000 Btu/h shail have modulating or staged combustion control. Exceptions: 4. Boilers. 2, Radiant Heaters. 4412.7 Balancing: Each air supply outlet or air or water terminal device shall have a means for balancing, including but nat limited to, dampers, temperature and pressure test connections and balancing valves, 1413 Air Economizors 1413.1 Operation: Air econcmizers shall be of automatically modulating outside and return air dampers to provide 100 percent of the design supply alr as outside air to reduce or oliminate the need for mechanical cooling, Water economizers shall be capable of providing the total concurrent cagling load served by the conneted terminal equipment lacking airside economizer, at outside air temperatures of 45°F dry-buto/40°F wet-bulb and below. For this calculation, all factors Including solar and Internal load shali be the same as those used for peak load celculations, except for the outside temperatures. Exception: Water economizers using air-cooled heat rejection equipment may use a 35°F dry-bulb outside air temperature for this calculaticn. This exception is limited to a maximum of 20 tons per building. 1413.2 Documentation; Water economizer plans submitied for approval shall include the following information: 1. Maximum outside air conditions far which economizer is sized to pravide full cooling. 2. Design cooling load ta be provided by economizer at this outside aif condition. 3. Heatrejection and terminal equipment performance data including model number, flow rate, capacity, entering and leaving temperature in full economizer cooling mode. 1412.3 Integrated Operation: Air economizers shall be capable of providing partial cooling even when additional mechanical cooling is required to meet the remainder of the cooling load. Exceptions: 1. Individual, direct expansion units that have a rated capacity less than 66,000 Btu/h and use nonintegrated economizer controls that preciude simultaneous operation of the economizer and mechanical cooling. 2. Watar-cooled water enuliers: 1414 Ducting Systems 1414.1 Sealing: Duct work which Is eaigri to operate at pressures above 1/2 inch water column static pressure shall be sealed in accordance with Standard RS-18. Proposal: The proposal is a five-year program of commonly performed, well defined maintenance activities and repair projects by the WSF in relation to the existing ferry terminal in Port Townsend, WA. These projects are necessary to keep the ferry terminal operating safely and efficiently, and to meet and/or maintain state and federal code requirements. The four categories of activities contemplated are summarized below (see application for complete descriptions): 1. In- and over-water structures: Repair/replacement of the dock, trestle, transfer span, towers, pilings supporting these structures, and fenders to protect pilings; installation of piles to protect existing piles from further deterioration; replacement of cross-bracing; repaving, re-decking; replacement/repair of the seawall and bulkhead; and painting, pressure washing, and rust removal to prevent corrosion and decay to timber and steel structures. 2. Buildings: Repair, replacement (comparable to its original configuration and location) painting, washing, and weatherproofing of the exterior of any or all of the buildings and their components. 3. Infrastructure and Equipment: Repair/replacement of sewer and water facilities, interior and exterior fixtures, including all pipelines, tanks, pumps, toilets and sinks, sewage and water infrastructure necessary to operate the terminal. Repair/maintenance of storm water conveyance and treatment including catch basins, conveyance lines and associated structures and treatment facilities. The work may include retrofit of the system within normal maintenance and repair criteria. Repair and maintenance of roads, traffic lanes, bridges and driveways, including repaving, minor repairs, painting lane lines and other markings. The proposal by WSF to undertake repair and replacement of the existing ferry terminal facility within the shoreline of the City of Port Townsend, is exempt from the requirement of a substantial development permit. The applicant has consulted with and entered into environmental agreements with the DOE and WDFW, have agreed upon BMPs to protect natural resources and habitat, and have acquired an HPA permit. The project has acquired a NWP 3 from the USACE. 4, The proposal is consistent with the policies of the Shorelines Management Act (SMA) and the City’s Shorelines Master Program (SMP). The proposal involves repair, maintenance and replacement of elements that relate to a water-dependent use. Provision for and maintenance of water-dependent uses is consistent with the goals of the Shoreline Management Act. (See Port Townsend Shoreline Master Program [PTSMP] 2007 2.4.D.2 and WAC 173-27-040 2[b] - exemptions for normal repair and maintenance). 5 The proposal to install, replace or maintain navigational aids is consistent with exempted activities under PTSMP 2007 2.4.D.5 and WAC 173-27-040 2(f) - exemptions for navigational aids. 10. il, The proposal to perform geotechnical marine sediment borings is consistent with activities considered as site exploration and investigation, and meets the criteria for exempted activities under PTSMP 2007 2.4.D.12 and WAC 173-27-040 2(m). The nature of some of these repairs will require in-water construction and mechanized equipment for a limited period of time. In water work shall be conducted within in water work periods for this location as limited by the Washington State Department of Fish & Wildlife and US Army Corp of Engineers. WSF will notify the City of Port Townsend four weeks before a project begins. Project details and drawings will be included in the notice. For maintenance and repair projects where it is uncertain if this approval applies, WSF will consult with the City of Port Townsend earlier than four weeks. If there is an emergency repair at the terminal, a shorter notice may be necessary. (See Appendix B of application for sample notice). The WSF has developed extensive mitigations and BMPs that are outlined in the environmental agreements and permits found in Appendix D of the Shoreline Substantial Development Exemption submitted to the City of Port Townsend, Development Services Division, that are considered to be incorporated into the activities considered under this exemption. Washington State Ferries, acting as lead agency has determined that the proposal is categorically exempt from the State Environmental Policy Act (SEPA) under the provisions of WAC 197-11-800 (see Appendix C of application). This programmatic approach to routine maintenance, repair and replacement activities of the WSF terminal in Port Townsend was subject to review, comments, and amendments by the Ecology Headquarters Shoreline Policy Group. Decision Based on the foregoing Findings and Conclusions, LUP 07-040 is hereby APPROVED subject to compliance with the following CONDITIONS: 1. All maintenance, repair, or replacement activities shall be in substantial conformance with the narrative description, environmental agreements, and other support documents submitted in the application for Shoreline Exemption. There shall be no further expansions to or addition of any structures without prior review for conformance with the Shoreline Master Program and any other applicable laws and ordinances. This exemption does not excuse the proponent from complying with other local, state and federal ordinances, regulations, or statutes applicable to the proposed development including but not limited to the city’s critical areas ordinance, US Army Corps of Engineers NWP 3, and Hydraulic Project Approval (HPA) from Washington Department 3 of Fish and Wildlife, and the environmental agreements incorporated into the application. 3. In water work shall be conducted within ‘in water work periods’ for this location as directed by the environmental agreements and permits incorporated unless further restricted by permitting agencies. 4, The use of mechanized equipment shall be the minimum necessary to complete the permitted repairs and shall comply with any conditions of the associated HPA. 5. If construction equipment inadvertently damages the shoreline environment, the applicant shall notify the City and any other responsible agencies (i.e. State Fish & Wildlif, Ecology, USACE) immediately. The applicant shall be responsible for repairing the shoreline to its preexisting condition to the satisfaction of the responsible agencies. 6. If city street rights-of-way are to be used for staging during these activities the applicant must first obtain a City Minor Improvement Permit (MIP). ts To avoid environmental health hazards during construction, emergency spill and cleanup procedures shall be explained to all workers on the site and a point of contact will be designated. All heavy equipment involved with the construction shall be inspected daily for leaks. Any equipment leaking hazardous materials is prohibited from conducting any work below the OHWM until the leak is repaired. 8. All construction contracts shall specify that all diesel, gasoline and air-powered equipment must be properly muffled or silenced. 9. As an over-the-water structure lying beyond the extreme low tide, the terminal falls within the Aquatic shoreline designation and Shorelines of Statewide Significance. Ferry terminals are categorized as transportation facilities under the city’s Master Program. The existing legally established Port Townsend ferry terminal is a water- dependent use. Adjacent uplands are designated as Urban. Surrounding uses are primarily commercial in nature including a bank, retail shops, dry cleaners, pharmacy, restaurants, and a small public park. The ferry terminal and adjacent public park are zoned P-I Public Infrastructure. Waterfront properties to the west are zoned C-I] General Commercial and properties to the east are zoned C-III Historic Commercial. In instances where the SMP provisions conflict with basic zoning provisions, the SMP governs. Pursuant to Section 10.4.1 of the City of Port Townsend Shoreline Master Program, the application may be processed as a Type II Minor Shoreline Substantial Development Permit. The proposal involves a shoreline modification to support an existing legally established use. Specifically, the proposal involves installation of a portable spill boom container on the existing Washington State ferry terminal in compliance with the Ecology Spill Program Proposed alternations to the existing terminal wil] not exceed one-story in height. The proposal will not alter nor intensify existing uses; nor will it alter the over-the —water footprint. Said Notice was published in the local newspaper, mailed to neighbors within 300 feet of the site, and posted at the site. No comments were received. Washington State Ferries, acting as lead agency, has determined that the proposal is categorically exempt under the State Environmental Policy Act (SEPA). The terminal building is located in a mapped habitat area and seismic hazard zone. The Director of Development Services Department has determined that Critical Areas requirements can be waived for the proposed modifications to the existing terminal building as alterations are to be conducted atop the existing over-water-structure and the proposal will not result in any approval of over-water shading impacts as compared to those caused by the current structure. A critical areas permit will not be required (PTMC 19.05.040C(2)). Section 4.4 Circulation Element: To achieve safe, convenient non-motorized-friendly, and diversified circulation systems to provide public access to the shoreline, efficient movement of people and goods, with minimum disruption to the shoreline environment and minimum conflict among shoreline uses and between shoreline users and abutting upland areas. Analysis: The spill boom container is accessory and incidental to the water-dependent transportation facility. Spill response capability is mandated by the Ecology Spill Program to be in place by February 22, 2007. All improvements are to be constructed on the existing pier surface. Preserve the natural character of the shoreline. The proposal would not adversely affect the natural character of the shoreline. The proposal will benefit the public at large. Policies in Section 5.6 Aquatic Designation call for: “Minimizing interference with surface navigation (Policy 5.6.8) preservation of water quality and habitat (Policy 5.6.9). Analysis: As the proposal will not expand the over-water-structure, there will be no impact to surface navigation. DR 5.6.23 — No new or expanded structure shall exceed a building height of 18 feet, 6 inches above the deck surface consistent with the existing Union Wharf building, except height limits shall not apply to flagpoles, antennas, and functional components of water-dependent uses (e.g., overhead walkways for ferry operations, booms for haul-out facilities), that may exceed the height limit when necessary to perform their intended functions. Analysis: The container is approximately 24x 8x 8ft. Its maximum elevation is roughly 8-feet 4 -inches above the pier surface. During Historic Design Review, the Historic Preservation Committee requested that the spill boom container (the subject of this permit) be painted to blend with the environment. The applicant agreed to paint both the spill boom container and hazardous waste containers gray. Policies and Regulations in Chapter 6, Environmental Protection, of the SMP are based upon the requirement to: “Assure, at a minimum, that development and use within the shoreline’s jurisdiction result in no net loss of ecological functions necessary to sustain shoreline natural resources...” (Policy 6.3.3 and DR 6.3.2). Provide a level of protection to critical areas that is equal to or greater than the level of protection provided by the adopted Port Townsend critical areas regulations....” (Policy 6.5.3). Analysis: The proposal will not impact ecological functions nor will it increase the potential impact to critical areas or their buffers. There is no expansion of over-water footprint.
