Washington state law requires all contractors to be registered. General contractors must maintain a $6,000 bond and specialty contractors must maintain a $4,000 bond. (Specialty contractors are those who participate in no more than two trades and do not subcontract work to other contractors.) It is against state law for any contractor to submit bids or perform any contracting work without being registered with the Department of Labor and Industries. It also is illegal for contractors to advertise without including their 12-character contractor registration number in the advertisement. Consumer protection The contractor registration law exists to protect consumers from incompetent and/or fraudulent contractors. Requiring contractors to be bonded gives consumers some financial protection against unsatisfactory or incomplete work. Dissatisfied consumers may take civil action to obtain restitution by taking action against a contractor’s bond in Superior Court. The law also requires contractors to carry insurance for property damage and public liability. It also ensures that contractors have a current Unified Business Identifier (UBI) Account Number and Federal Employer Account Number. Any correspondence you send to a contractor should clearly state that bids will not be accepted unless the contractor provides a valid registration number. . While the-law does not guarantee perfect. . performance, it improves the likelihood that the contractor does competent work. Registration penalties A maximum $3,000 fine and a misde- meanor infraction can be levied against any con- tractor who performs work or submits a bid with- out being registered with Labor and Industries. _ 12 tips to remember 1. Make sure your contractor is properly registered. 2. Be wary of contractors who ask you to pick up the building permit. 3. Plan your project carefully, including detailed plans, if necessary. 4. Try to get at least three written bids on each job. 5. Ask contractors for references. 6. Ask what inconveniences might arise. 7. Obtain a written contract. 8. Make sure you understand the terms before you sign anything. 9. Becautious about paying for work not yet completed. 10. Put all change orders in writing. 11. Make frequent inspections and consult your local building department. 12. Avoid making final payment until you have received a lien release from suppliers and subcontractors. Risks and liabilities When hiring an unlicensed contractor and acting as your own contractor: 1. You are responsible for the medical and time loss costs of employees injured while working on your project. 2. You may be liable for all unpaid taxes. 3. Your homeowner’s insurance may not cover work done by an unlicensed contractor. 4. The law requires complete disclosure of all work that has been done on your home, if you resell. You may be required to do work over again that has been done without permits, or inspections. Non-disclosure can lead to civil action being taken against you. 5. You may be placing yourself and your family in a life-threatening situation, especially when hir- ing unlicensed people to install plumbing, elec, trical wiring, heating systems or wood stove: 6. Suppliers can place a lien on your home fo non-payment of materials by your contractor. 7. Unpaid workers can place a lien on your property. 8. When problems arise, your only recourse is a lengthy and costly civil action — if there are any assets of value to attach, and if you can find the contractor. Insurance protection Contractors are required to carry at least $20,000 in property damage insurance coverage and $100,000 in bodily injury or death insurance. You are encouraged to verify the contractor’s insurance coverage with his or her agent, as the department's records may not reflect current coverage. Our information line The Labor and Industries contractor registration information line 1-800-647-0982 operates weekdays from 8 a.m. until noon and 1 to 5 p.m., excluding state holidays. The information line allows you to check whether commercial and resi-dential contractors are registered and properly bonded. Our staff can tell you if the contractor currently is registered, if action against the bond is pending, or if legal acton has been taken against the contractor’s bond in the past. ADU’s can be developed in districts zoned as R-I, R-II, or R-II. The owner of the single- family home must occupy either the primary unit or the ADU and must meet the regulations outlined in Section 17.16.020 of the Port Townsend Municipal Code. What requirements must be met to develop an ADU? An ADU established in an outbuilding may be 800 square feet in utilized floor area regardless of the size of the main residence. The front of the house may have only one exterior entrance. Neither the main or accessory dwelling unit may be used as a transient accommodation, i.e., occupied for periods less than 30 days. An ADU may be established in a residence or outbuilding that is legal, nonconforming (“grand fathered”) with respect to required setbacks. However, entrances may be no closer than five feet to neighboring property lines. An entrance as close as three feet to a neighboring property line may be allowed if no feasible alternative exists. In addition, any side window closer than five feet to neighboring property lines and which is also closer than twenty feet to either the front or rear property line must be permanently glazed with translucent material. One additional off-street parking space is required to establish an ADU, provided the off-street parking requirements for the other uses on the site are continuously met. Under certain conditions, an on-street parking space may satisfy this requirement, subject to approval by the Public Works Director. What will the permit, building code, and Public Works requirements be for the ADU? Please refer to the sheet titled ADU Code Requirements. How does a pre-existing unit become legal? If an ADU was established prior to the effective date of the Port Townsend Zoning Code (August 17, 1971) and continuously occupied thereafter, the ADU may continue without compliance with the requirement that the owner occupy either the ADU or the primary unit, or that the ADU meet size limitations (see above). However, a certificate of occupancy is required (see sheet titled ADU Code Requirements). Utilities: The entire structure may be served by one shared underground service lateral from the utility’s main to the structure for water and sewer, respectively. The water shut-off must be accessible to the occupants of both units. If liquid petroleum gas (LPG) or fuel oil is supplied to the ADU, again, a shut-off must be accessible to the occupants of both units. Y Electrical: A single, shared electrical service, a single meter, and a single main service panel would be allowed to serve the ADU and primary residence, provided that a) the occupants of both dwelling units have equal and unrestricted access to the main electrical shut off device, and b) the capacity of the service panel shall be sufficient to safely handle the electrical loads attributed to two dwelling units, as determined by the electrical code in effect at the time of application. } Plumbing: Both dwelling units may share common supply and waste plumbing systems and a common water heater appliance, so long as the occupants of both dwelling units have equal and unrestricted access to the water heater appliance. Z) WATER SERTENS Heating; Both dwelling units may provide their space heat by a shared, common forced air system if listed fire/smoke dampers are properly installed at all duct penetrations through all structural elements (walls, floor, ceiling, etc.) which separate the two dwelling units. & Smoke Detectors: Smoke detectors shall be installed throughout both dwelling units in compliance with International Residential Code requirements for new construction in effect at the time application is made for permits associated with the conversion. i€ Exiting: All components of the required exit systems in the ADU and the home shall comply with code requirements in effect at the time application is made for permits associated with the conversion, especially with regard to escape windows in all rooms used for sleeping. 08/21/08 P:\DSD\Forms\Building Forms\Information-ADU Code Requirements.doc \4 Fire Separation: The International Residential Code (IRC) requires a one-hour fire separation between dwelling units. This includes horizontal and vertical assemblies as well as one hour rated door assemblies in tenant separation. & Ceiling Height: The minimum ceiling height for ADU’s located within existing structures is seven feet. kA What Building Code requirements have to be satisfied when developing an ADU in a new structure or with an addition? f Electrical: (See “2. Electrical” above) 4} Plumbing: The entire structure, including both dwelling units, may share a common water supply and waste plumbing systems. Each dwelling unit must, however, be provided its own separate hot water appliance, and occupants of each dwelling unit must have equal and unrestricted access to the main water shut-off valve. JA Garbage: Separate garbage/recycle collection fees are not required. 4. What is the permit process to obtain ADU designation? JM If the ADU is a new structure or an addition, the ADU requirements will be included with the building permit issued for the new structure or addition. If the ADU is being established in an existing structure, you may need to apply for a building permit depending ‘on the improvements required. If a permit is required for improvements, once they are complete and final inspection is passed, a Certificate of Occupancy (CO) will be issued pursuant to the International Residential Code (IRC) after the project is finaled. j@ Staff will prepare a Notice to Title regarding the Accessory Dwelling Unit for the property owner(s) to sign in front of a notary, and record at the Jefferson County Auditor. The document will state that: e The property owner will reside on the property, either in the principal residence or in the ADU in order to rent or lease the other unit. e Neither the principal residence or ADU may be used as transient accommodation (i.e. rental of up to 29 consecutive days). JX The cost to convert an existing structure to an Accessory Dwelling Unit, not including building permit fees, is approximately $130.00. 5. Will the ADU have a separate address? Jk Yes. The address must be posted on the ADU with 5-inch tall house numbers. If the numbers are not visible from the street, additional 3-inch tall house numbers must be posted on the street at the most direct path to the ADU.
