Box 1180 ] CUT | hae Port Townsend, WA — _| | 98368 CITY OF PORT TOWNSEND — J Project Location and Legal Description: Generally located in Port Townsend Bay fronting 111 Quincy Street, Port Townsend, WA 98368. Legally described as Tideland 33 including submerged portions of Quincy Street and Front Street rights-of-way. Application fora DNR lease will apply to a rectangular area of unidentified dimensions located waterward of City Tideland 31. SW1/4 of Section 1 Township 30 North, Range 1 West. Assessor’s Tax Parcel Number: 937600200 and 989700612. Latitude N 48°06’53” Longitude: W 122°45°14”. Proposal: Emergency repairs to the Quincy Street Dock transfer span in order to avoid an imminent threat to public safety and property. The transfer span was supported by cables from the overhead dolphins and adjusted for varying tidal ranges. This system was damaged in recent storms and portions of the dock appear to be in imminent danger of collapse. To stabilize the structure, the applicant is proposing to replace the damaged overhead timbers and cables supporting the transfer span. Existing headworks and crushed timber headers will be removed and the towers leveled. New 14 x 14 beams would be placed on top of the blocking. 12 x 12 or or 14 x 14 timbers would be placed on the new headworks with steel angles to protect from the chain. Existing cables would be replaced with a 3/4inch chain to hang the transfer span from existing pad eyes which are in good shape. _ This is not a permanent fix but a temporary method of stabilization. All work is to be conducted from a barge. Work is anticipated to begin pon city approval and should take approximately one day to complete. Adjacent Waterbody:__ Strait of Juan de Fuca__Admiralty Inlet _X_Port Townsend Bay SMP Shoreline Designation: According to the Shoreline Master Program (SMP) adopted by the City of Port Townsend on February 14, 2007, the property is designated “Shorelines of Statewide Significance”, “Aquatic” and “Historic Waterfront” per SMP Chapter 5. Findings & Conclusions 1. The proposal made by the applicant to undertake the repairs described above within the shoreline of the City of Port Townsend and/or its associated wetlands is exempt from the Shoreline Substantial Development Permit Exemption LUP 10-065 Page 2 requirement of a substantial development permit. Specifically, the proposal constitutes: _X_ Normal Maintenance and Repair _ Development not exceeding $2,500 __ Single-family home for owner’s use __Other: The existing Quincy Street dock is owned by the Port of Port Townsend and is currently under lease to Quincy Street at the Waterfront LLC. On October 4, 2010, the City of Port Townsend sent a letter to both Quincy Street at the Waterfront LLC and the Port of Port Townsend notifying them of the potentially dangerous condition of the dock: We have observed that portions of the dock appear to be in eminent danger of collapse (see attached photographs). Specifically, the overhead mechanism that was used to raise and lower the transfer span has become dislodged. Should this portion of the structure fail, it could injure anyone who happened to be in the immediate vicinity (beach water, kayaker, other). It would also remain connected to the dock by cables but the span (connected to the overhead mechanism) would enter Port Townsend Bay and be subjected to wave action. This could significantly damage the dock and street end bulkhead as well as the adjacent and newly repaired piles supporting the Wave Gazing Gallery. In light of the pending winter storms season, the City of Port Townsend requires that this portion of the dock be stabilized as soon as possible, or that the City receive a report from a licensed structural engineer confirming the structural integrity of the overhead mechanism and that there is no risk to the public or to property. The Port of Port Townsend contracted with the engineering firm, PND, and the contractor Culbertson Marine to assess the condition of the dock and determine needed repairs. The proposed emergency repairs are categorically exempt from review under State Environmental Policy Act (SEPA) under the provisions of WAC 197-11-880 - Emergencies. Quincy Street Dock is located within the Special Overlay Design Review District, wherein exterior alteration of structures is subject to Design Review involving the City’s Historic Preservation Committee (HPC) and compliance with PTMC Chapter 17.30. However, the Director has issued an emergency waiver pursuant to Section 17.30.020C(4): “Emergency repairs of buildings, structures and improvements; provided (a) that a waiver of design review has first been obtained from the director, subject to such conditions as the director determines appropriate based on the emergency, and based on the requirements of this chapter; (b) such repairs shall be strictly limited to correcting emergency conditions; and (c) that after cessation of the emergency condition, all permanent installations shall be subject to design review and Shoreline Substantial Development Permit Exemption LUP 10-065 Page 3 approval under this chapter.” (A Per the Department of Archaeology & Historic Preservation (DAHP), though the 10. structure is not individually listed on the National or State Register, structures found to be "contributing" within a National Historic Landmark District are deemed to be on the National Register without the need to be individually listed. City staff will coordinate with DAHP during the Design Review Process. _ According to the City’s Critical Areas maps, the following critical areas are likely to occur on the site or in the immediate vicinity: Geologically Hazardous, Frequently Flooded, and Fish and Wildlife Habitat. Under separate application, Quincy Street at the Waterfront LLC, has applied for a Shoreline Substantial Development and Conditional Use Permit to restore and expand Quincy Street Dock for boat and seaplane moorage (File Reference: LUP09-021 and - 022). The work would involve replacing existing piles with 23 steel piles placed with a vibratory hammer. Environmental impacts were assessed in the Mitigated Determination of No Significance (MDNS) issued by the City of Port Townsend on July 26, 2010. The MDNS is incorporated herein by this reference pursuant to WAC 197-11-600(4). Existing biological conditions were assessed by Amy Leitman, Marine Surveys & Assessments in the Biological Evaluation for Quincy Street at the Waterfront, LLC (Jul 8, 2009) and in two letter addendums (September 22, 2009 and February 23, 2010). The Habitat Survey data, compiled by Marine Survey and Assessments (MSA) divers on September 11, 2009 and September 23, 2009 found that “there was almost no macroalgae in the survey area and the macroalagae that is present is located in deep water (-19.0’MLLW or deeper). The eelgrass that was found is located approximately 50-feet from the area where the proposed floats will be located. The City’s Shoreline Master Program (SMP) has been updated consistent with the state guidelines, and the Department of Ecology (DOE) has adopted the SMP. The SMP incorporates the Critical Areas Ordinance (CAO) by reference (Chapter 6 of the SMP). A separate Critical areas permit is not required. Given the si gnificant overlap between the _ CAO standards and typical SEPA mitigation measures, the MDNS issued for the Quincy 11. 12. Street Dock Restoration included an analysis of the project’s compliance with relevant CAO performance standards. As conditioned, the activity will have no significant adverse impact on the environment including but not limited to fish, wildlife, fish or wildlife habitat, water quality, and aesthetic values. Proposed repairs to the dock are consistent with the policies of the Shorelines Management Act (SMA) and the City’s Shorelines Master Program (SMP). The proposal involves emergency repairs to an existing over-water structure. Maintenance of over-water structures to ensure public safety and avoid shoreline impacts is consistent with the goals of the Shoreline Management Act. _ Shoreline Substantial Development Permit Exemption LUP 10-065 Page 4 i The proposal will not materially interfere with the public use of public lands and waters or the private use of adjacent private lands nor will it result in any material expansion or change in use beyond that previously existing. The historic Quincy Street Dock is currently derelict and blocked off from the public. Temporary repairs are necessary to stabilize the structure until such time as restoration can be completed. There is no change in use proposed and no impact to public access. Conditions 1. All development shall be in substantial conformance with the development plans submitted in the application for Shoreline Exemption. There shall be no further expansions to or addition of any structures without prior review for conformance with the Shoreline Master Program and any other applicable laws and ordinances. This exemption does not excuse the proponent from complying with other local, state and federal ordinances, regulations, or statutes applicable to the proposed development including but not limited to the city’s critical areas ordinance, Modification of Water Quality Criteria from DOE; Hydraulic Permit Approval from WDFW. Wooden components, which will be in contact with the water, shall not contain creosote or pentachlorophenol. This shall include pilings, beams, structural supports, and decking. These components shall remain free of these toxic substances for the duration of their functional lives. The proponent shall apply for a building permit with the Department of Development Services (DSD) prior to beginning any construction activities. Consistent with Section 17.30.020C (4); after cessation of the emergency condition, all permanent installations shall be subject to design review and approval under Chapter 17.30 PTMC Historic Preservation Code. City staff shall coordinate with the Department of Archaeology & Historic Preservation (DAHP) and incorporate recommended measures as appropriate. If city street rights-of-way are to be used for staging the applicant must first obtain a City Minor Improvement Permit (MIP). During Construction ts Construction Window: To protect juvenile salmon residing in nearshore areas, work waterward of the ordinary high water line shall not be permitted from February 15 through July 14 or as otherwise specified by the WDFW. Demolition materials and construction debris shall be removed and legally disposed of upland and prevented from entering waters of the state. All construction debris shall be Shoreline Substantial Development Permit Exemption LUP 10-065 : Page § deposited in approved areas in accordance with local, state, and federal laws. 9. Construction shall be carried out in a manner that avoids adverse impacts to eelgrass (e.g., barge shall not ground on or shade eelgrass for more than three consecutive days from March until August, care shall be taken to avoid eelgrass beds when deploying anchors/spuds) 10. The application shall comply with best management practices to minimize or control erosion/water quality contamination. Sawdust, trimmings, or drill shavings from treated wood shall be completely contained with tarps or other impervious materials and prevented from entering the beach, bed, or waters of the state. No petroleum products or other deleterious materials shall enter surface waters. 11. —_ Ifa fish kill occurs or fish are observed in distress, the project activity shall immediately cease and WDFW Habitat Program shall be notified immediately. 12. _ If construction equipment inadvertently damages the shoreline environment, the applicant shall notify the City and any other responsible agencies (e.g., Ecology) immediately. The applicant shall be responsible for repairing the shoreline to its preexisting condition to the satisfaction of the responsible agencies. 13.
