On September 20, 2010, you submitted BLD10-148 for a residence on Lot 40 with the following setbacks: 6 feet on one side, 8 feet on the other side, and 10 feet on the front side. Regarding how this affects Planned Unit Developments (PUDs), DSD Director Rick Sepler has determined the following: if a PUD Agreement included departures from the minimum zoning setbacks and/or lot size, then the setbacks agreed to at the time of the PUD shall remain in effect; but if the PUDA did not include any departures from the zoning code and/or stated that development shall follow regulations in effect at the time of the building permit application, then current zoning shall apply. Lynnesfield PUD is located in the R-II zone, and the PUDA did not establish a variation of lot size or setbacks. Lynnesfield PUDA (AFN 391311) Condition #53 states “Unless otherwise provided herein, any and all improvements within the Lynnesfield PUD shall be made in full conformance with all applicable federal, state and local laws and regulations in effect at the time of application for building permits, and in the event any of the conditions prescribed herein are in conflict with any such law or regulation, the more restrictive shall apply.” The First Amendment to the Lynnesfield PUD in 1997 (AFN 402738) amended the original PUDA as follows: “1. Add anew condition 53(A), “The minimum rear setback for all single family lots shall be five feet.” In 2002, Ordinance 2825 increased R-II setbacks for garages that face a street right-of-way, amending Table 17.16.030 to a minimum 20-foot setback when a garage door faces either the front or the side of the property. Up to now, staff has not required a 20-foot front setback for Lynnesfield garages that face a right-of-way. Below grade walls shalt be insulated either on the exterior to a minimum level of R-10, or on the interior to the same level as walls above grade. Exterior insulation installed on below grade walls shall be a water resistant material, manufactured for its intended use, and installed according to the manufacturer's specifications. See Section 602.2. 5. Floors over crawl spaces or exposed to ambient air conditions. 6. Required stab perimeter insulation shall be a water resistant material, manufactured for its intended use, and installed according to manufacturer's specifications. See Section 602.4. 7. Int. denotes standard framing 16 inches on center with headers insulated with a minimum of R-10 insulation. 8. This wall insulation requirement denotes R-19 wall cavity insulation plus R-5 foam sheathing. © 9. Doors, including all fire doors, shall be assigned default U-factors from Table 10-6C. 10. Where a maximum glazing area is listed, the total glazing area (combined vertical pius overhead) as a percent of gross conditioned floor area shall be fess than or equal to that value. Overhead glazing with U-factor of U=0.40 or less is not included in glazing area limitations. 11. Overhead glazing shall have U-factors determined in accordance with NFRC 100 or as specified'in Section 502.1.5. 12. Log and solid timber walls with a minimum average thickness of 3.5" are exempt from this insulation requirement.
