Page 2 of 2 - 1/4/2010 -OVER- BLD 10 —1 W Before hiring a contractor If you are a consumer interested in having work done by a contractor, this brochure can help you by: ¢ Explaining how the Washington state contractor registration program works. * Describing how the contractor registration law protects consumers. ¢ Outlining the requirements for contractors. Washington state law requires all contractors to be registered. General contractors must maintain a $6,000 bond and specialty contractors must maintain a $4,000 bond. (Specialty contractors are those who participate in no more than two trades and do not subcontract work to other contractors.) It is against state law for any contractor to submit bids or perform any contracting work without being registered with the Department of Labor and Industries. It also is illegal for contractors to advertise without including their 12-character contractor registration number in the advertisement. Consumer protection The contractor registration law exists to protect consumers from incompetent and/or fraudulent contractors. Requiring contractors to be bonded gives consumers some financial protection against unsatisfactory or incomplete work. Dissatisfied consumers may take civil action to obtain restitution by taking action against a contractor’s bond in Superior Court. The law also requires contractors to carry insurance for property damage and public liability. It also ensures that contractors have a current Unified Business Identifier (UBI) Account Number and Federal Employer Account Number. Any correspondence you send to a contractor should clearly state that bids: will not be accepted unless the contractor provides a valid registration number. . : While the law does not guarantee perfect... performance, it improves the likelihood that the contractor does competent work. Registration penalties A maximum $3,000 fine and a misde- meanor infraction can be levied against any con- tractor who performs work or submits a bid with- out being registered with Labor and Industries. _ 12 tips to remember 1. Make sure your contractor is properly registered. 2. Be wary of contractors who ask you to pick up the building permit. 3. Plan your project carefully, including detailed plans, if necessary. 4. Try to get at least three written bids on each job. 5. Ask contractors for references. 6. Ask what inconveniences might arise. 7. Obtain a written contract. 8. Make sure you understand the terms before you sign anything. 9. Be cautious about paying for work not yet completed. 10. Put all change orders in writing. 11. Make frequent inspections and consult your local building department. 12. Avoid making final payment until you have received a lien release from suppliers and subcontractors. Risks and liabilities When hiring an unlicensed contractor and acting as your own contractor: 1. You are responsible for the medical and time loss costs of employees injured while working on your project. 2. You may be liable for all unpaid taxes. 3. Your homeowner’s insurance may not cover work done by an unlicensed contractor. 4. The law requires complete disclosure of all work that has been done on your home, if you resell. You may be required to do work over again that has been done without permits, or inspections. Non-disclosure can lead to civil action being taken against you. 5. You may be placing yourself and your family in a life-threatening situation, especially when hir- ing unlicensed people to install plumbing, elec- trical wiring, heating systems or wood stoves. 6. Suppliers can place a lien on your home for non-payment of materials by your contractor. 7. Unpaid workers can place a lien on your picpeay, 8. When problems arise, your only recourse is a lengthy and costly civil action — if there are any assets of value to attach, and if you can find the Contractor. iene Insurance protection Contractors are required to carry at least $20,000 in property damage insurance coverage and $100,000 in bodily injury or death insurance. You are encouraged to verify the contractor’s insurance coverage with his or her agent, as the department's records may not reflect current coverage. Our information line The Labor and Industries contractor registration information line 1-800-647-0982 operates weekdays from 8 a.m. until noon and | to 5 p.m., excluding state holidays. The information line allows you to check whether commercial and resi-dential contractors are registered and properly bonded. Our staff can tell you if the contractor currently is registered, if action against the bond is pending, or if legal acton has been taken against the contractor’s bond in the past. To summarize our talk, the Kenna property has a flat “bench” where the existing house is located. The northern portion of the property is much steeper and significant portions appear to have slopes that equal 40% over a vertical distance of 10 or more feet. If this is true, the proposed retaining wall (BLD11-002) would require review and approval of a Critical Area permit. The two small additions approved for the house were OK’d because they lie on the ne side of the house or away from this slope. The code change will go into effect on July 1, 2010, barring any additional changes prior to that time. The new language is an exception to WSEC Section 502.1.6.3, and is underlined below. 502.1.6.3 Roof/Ceilings: Roof/ceiling assemblies where the ventilation space above the insulation is less than an average of 12 inches shall be provided with a vapor retarder. Faced batt insulation where used as a vapor retarder shall be face stapled. Single rafter joist vaulted ceiling cavities shall be of sufficient depth to allow a minimum one inch vented air space above the insulation. EXCEPTION: _Unvented attic assemblies (spaces between the ceiling joists of the top story and the roof rafters) shall be permitted if all the following conditions are met: 1. The unvented attic space is completely contained within the building thermal envelope. 2. No interior vapor retarders are installed on the ceiling side (attic floor) of the unvented attic assembly. 3. Where wood shingles or shakes are used, a minimum 1/4 inch (6 mm) vented air space separates the shingles or shakes and the roofing underlayment above the structural sheathing. 4. Any air-impermeable insulation shall be a vapor retarder, or shall have a vapor retarder coating or covering in direct contact with the underside of the insulation. 5. Either Items a, b or c shall be met, depending on the air permeability of the insulation directly under the structural roof sheathing. a. Air-impermeable insulation only. Some jurisdictions have allowed builders to use this exception prior to its official adoption date. We recommend that the applicant closely follow the manufacturer’s installation instructions. In addition, builders should be aware that you may be taking on additional liability since this code change has not officially gone into effect. e Know what type of product you are using. Is it rigid sheet foam, open cell (usually 0.5 to 0.81b/ft*) or closed cell (usually 2 Ib/ft*) spray applied product? What is its R-value per inch? Look at its ICC Evaluation Service report (http://www.icc-es.org/); does its listing allow it to be applied to WSEC required levels, or are there limitations due to flame spread? What will its installed vapor permeance be? e In traditional vented attics, the vast amount of moisture intrusion into attic spaces is via air leaks in the ceiling, through light fixtures and other penetrations. As such, air sealing details present in the WSEC are critical in avoiding moisture problems in that space. However, with the unvented attic assembly approach, the unvented attic space is designed and expected to operate close to the temperature and humidity levels of the living space below; as such, no special air sealing at the ceiling is needed. e The requirement that there be no vapor retarder on the interior ceiling of the unvented attic assembly is primarily intended to avoid trapping warm moist air in the attic area in warm humid climates (not an issue in Washington) but also to make it clear that a vapor retarder is not needed at the ceiling level for the unvented attic assembly application anywhere e Exceptions 5a and Sc will be used for spray foam application directly to the underside of the roof sheathing. This application can result in reduced building enclosure air leakage. If ducts are installed in the attic, it will minimize impacts of duct leaks. e Exceptions 5b and 5c allow for combinations of air-impermeable and air permeable insulations in unvented attic assemblies. These are commonly referred to as “hybrid systems”. The potential problem with this type of system is creating a condensing surface where an air impermeable layer transitions to an air permeable one. Indoor vapor could migrate through the air permeable layer and be stopped by the interior surface of the air impermeable layer. If the minimum rigid board or air-impermeable insulation R-value requirements are not met, this surface may be cold enough to be a condensing surface, potentially leading to mold and rot.
