AN ORDINANCE OF TIlE CITY OF PORT TOWNSEND AMENDING
THE PORT TOWNSEND MUNICIPAL CODE, CHAPTER 13.04,
UTILITY LATECOMER AGREEMENTS, SECTION 13.04.070, WRITTEN
AGREEMENT - PAYMENT OF CITY COSTS IN EXCESS OF
APPLICATION FEE TO ALLOW THE CITY MANAGER TO SIGN
LATECOMER AGREEMENTS
NOW, THEREFORE, the City Council of the City of Port Townsend ordains
as follows:
SECTION 1. Chapter 13.04, Utility Latecomer Agreements, Section
13.04.070, Written agreement - Payment of city costs in excess of application fee, of
the Port Townsend Municipal Code is hereby amended to read as follows (strike to
delete / underline is added):
13.04.070 Written agreement - Payment of city costs in excess of application
fee.
A. Upon approval of the application, formulation of a reimbursement area and charge,
notice to the property owners and expiration of the appeal periods or a determination by
the city council, the utility latecomer agreement, together with supporting documents,

B. In the event costs incurred by the city for engineering or other professional
consultant services required in processing the application exceed the amount of the
application fee, the public works director shall so advise the City Manager and City
Manager.~..j~* ........ ~....~..~l.~ ~..~..~"~ ~....~..~.~ approval may be conditioned upon receipt of payment
by the applicant of an additional amount sufficient to compensate the city for its actual
costs in excess oft he application fee. (Ord. 2579 § 1, 1997; Ord. 2515 § 1, 1996).
SECTION 2. Severability. If any provision of this ordinance or its application
to any person or circumstance is held invalid, the remainder of the ordinance, or the
application of the provision to other persons or circumstances is not affected.
This ordinance shall take effect and be in force five days after the date of its
publication in the manner provided by law.

Adopted by the City Council of the City of Port Townsend, Washington, at a
regular meeting thereof, held this third day of September, 2002.
