Petition Re: Fireworks
To the Honorable Mayor and City Council
of The City of Port Townsend.

Gentlemen:
`r a; We the undersigned business of the Ctty are asking the privelege of the sale of fire-
works of limited size in the city during the first four days in July 1948.
r We further will contribute a sum of money to promote a Fourth of July Celebration
in the City of Port 'Townsend on the Fourth of July 1948,
We are submitting this proposal for your kind consideration and adoption.

A' t The foregoing petition was signed by representatives of 49 various business houses and
professional men.
A short discussion relative to the foregoing petition was terminated by the motion of
Councilman Sullivan, seconded by Councilman Osborne, that this mutter lay over to the next
regular suasion. :Motion carried.

Gentlemen:
At your request I have examined a deed in the hands of the City Clark to a tract
of land on Lawrence Str^at in the City of Port Townsend 'between the present library bulldin
and.the Baptist Church. This dead is one of gift to an undivided two-thirds interest of
the foe to the City of Port Townsend, On the lace of the tided there appears the following
language:
"Provided However, that if at any time the ❑aid above described gvntee shall cease
to use said land and premises for public library purposes or other public purposes reasonab

Incidental to the public library purposes for which the aforesaid Library Lot (Tax He. 15)
is now being used, or Per other like pjblic purposes in connection with and as part of said
Tax No. 15, or shall sell or convey, or attempt to sell or convey, any of the above des-
cribed land and premises, then, and in any such event, the whole thereof hereby conveyed
shall ika:ediately revert to and become the property of these grantors, their heirs, execute $

administrators or assigns forever free from all effect bursar. To have and to hold the said
premises, with the appurtenances, unto the said part of the second part, and to its success
ors and assigns foAvcr, subject only to the aforesaid reversionary right in the grantors,
and their successors in interest, forrnnuse as above provided.''
The deed, in my.opinion, is one which precludes the City from conveying a full and

complete fee title to the lands described in the instrument. ^ sale mould amount to a
breach of the condition subsequent- that is public library purposes or other public purposes)

reasonably incidental to public library purposes ::* and the purchaser would be subject to
the possibility of reverter re-entry.`.c.f,,.a=.....-._
It is my further opinion that the possibility of reverter created by this conveyance
on condition subsequent is without rule against perpetuities.
Consequently I recommend that the City, if it wishes to dispose of this particular
tract, secure quittances from the heirs of the grntors.

It was moved by Councilman Steele, and seconded by Councilman Osborne, that the City
Clerk be directed to attempt to communicate with the heirs of the James Estate in order to
attempt to secure a clearance upon the provision of reversion in accordance with the findings
of the City Attorney as expressed in the above communication. Lotion carried.

Fire Dept. 1 I
A requisition by the sire Dept. for equipment for the new fire hall in the estimated
sum of $2,000.00, signed by J. J. Lafferty, Fire Chief, was presented and read.

Requisition granted.

It was moved by Councilman Gleason, and seconded by Councilman Osborne, that the fore-
going requist16n be wanted. Upon roll call vote all six Councilmen present voted in the
affirmative and motion was declared carried.
UNFINISHED ALD NEW BUSENESS
Re: Street Light on Garfield street.
Councilman Gleason, reporting For the Committee or. Fire and Light relative to the re-
quest for a street light upon Garfield Street at the approximate point of intersection with
Fillmore Street, if extended, stated that investigation had disclosed the need of a street
light at t''fs point.
It was moved by Councilman Gleason, and seconder? by Councilman Benedetto that the Cityl
Clerk request the Pueett.Sound Pore. and Lir_ht Co. to install a str et light at this location
as early as they may be able so to do. Motion carried.
Street Lighting plans complete j
City Engineer Keith Jones presented, for consideration by the Council, the completed
plans for the oramental street lighting project planned by the City. Mr. Jones presented I
also tentative plans for a sea mall for the protection of '!later Street at the point where
the present sea wall is failing.

Call for Bids ordered
Following inspection end consideration of the Street Lighting plans and specifications
presented by the City Engineer it was moved by Gouncilman "lesson that the City call for
bids to perform the work at outlined in such plans and syzificatlons; sold bids to be opens
at the regular session of the City Council to be held on June 1, 1948; and that the City
Clerk place such call for rids in the Pont Townsend Leader and the Deily Journal of Comserecl.
This motion was seconded by Councilman Benedetto and carried by voice vote of the members
present.
