Benton Street Vacation Hearing Notice of hearing having been posted as required by law upon the application of Mr. Benton Street, the City Clerk at this time Vt. V. Benedetto for the vacation of a portion of read the notice of hearing as posted, together with affidavit of such posting. Mayor Anderson inquired if there were any present who might wish to comment upon the proposed vacation and offered privilege of the floor for such purpose. Vacation granted. No objections appearing to the vacation as proposed by Mr. Benedetto in his application it was moved by Councilman Steele, and seconded by Councilman Osborne, that the vacation be granted, and that the petitioner be notified to present an ordinance confirming such vaca- tion for consideration by the council. Upon roll call vote, all six councilmen present voted in the affirmative, and motion was declared carried. Fourth Street Vacation Hearing The City Council having directed a hearing at this time upon the application of Messrs. Ervin n. Mosier, E. D. Cook and James G. Larsen for the vacation of a portion of Fourth Street, the City Clerk at this time read verbatim a copy of notice of hearing as posted in accordance with law,'together with affidavit of such posting, as follows: NOTICE OF TITLE AND PLACE OF HEARING IN THE MATTER OF THE VACATION OF PARTS OF' CERTAIN STREETS. Ervin R. Mosier, E. D. Cook and James G. Larsen having filed with the City Council of the City of Port Townsend, Jefferson Colfnty, Washington, a petition requesting the vacation of a part of a certain street within said City, to -wit: That portion of 4th Street situate between the easterly line of Sherman Street and the westerly line of Hendricks Street. NOTICE IS HEREBY GIVEN That pursuant of a motion duly made, seconded and passed by the City Council of the City of Port Townsend on the 17th day of December, 1946, the said petition will be heard at the hour of 7:30 o'clock P.M.., or as soon thereafter as practicable, on Tuesday the 18th day of February, 1947, in the Council Chambers of the City Hall of the City of Port Townsend, Jefferson County, Washington, when and where any person or persons may appear and make exceptions or objections to the proposed vacation. CHRISTIAN, being first duly sworn on oath, deposes and says that he is the regularly elected, qualified and acting City Clerk of the City of Port Townsend, State of Washington; that he posted notices, the annexed of which is a full, true and correct copy, in the following places in the said City of Port Townsend, Washington, as follows One at the front door of the City Hall in the City of Port Townsend, One at the front door of the Jefferson County Court House, One on the bulletin board at the corner of Taylor and 'Nater Streets in said City, and Two on the part of street sought to be vacated; That such posting was made on the 9th day of January, 1947. C. F. Christian Subscribed and sworn to before me this 18th day of February, 1947. J. Daly Notary Public in and for the State of Washington, residing at Port 'Townsend. As required by law, opportunity was given at this time for anyone so desiring to speak for or against the proposed variation. Vacation granted. In the absence of any objector to the proposed vacation of street, it was moved by Councilman Gleason, and seconded by Councilman zenedetto, that the vacation of a portion of Fourth Street,as designated,be granted, and that the petitioner be directed to present an ordinance confirming said vacation,f•or consideration by the council. Upon roll call vote, all six councilmen present voted in the affirmative, and motion visa declared carried. M Re: Revenues few Taxicabs Councilman Mueller inquired of the City Attorney as to the possibility of levying a rental fee upon taxicab operators for the curb area required by them and set aside for them to carry on their operation. City Attorney Daly advised the council that the proper method by which the city might derive revenue from the operation of f6r hirecars visa by the settin of a proper license fee, the amount of which fee is determined by action of the City Council. ...qi xt it 1:L� C OF I Re: Revision of Building Ordinance, etc. Councilman Gleason introduced the matter of the inability of the City Council to proper ly evaluate the advisability of issuing building permits under the ordinances now in effect relative to building construction and the determination of the first and second fire zones. After some general discussion of the matter by the councilmen present, Councilman Gleason moved that the Mayor appoint a committee to consist of the present Building Commit- tee of the council, the present Fire Committee of the council, the Fire Chief and the City Attorney to make a study of this matter and to report back to the council thereon within sixty days. This motion was seconded by Councilman Mueller, and upon call for voice vote, motion was declared carried. A question as to information required to be given in making application for a building permit was introduced, but it was generally felt that this question would be considered as a part of the subject matter of the previous motion. Building Permit Granted A. H. Brooks f It was moved by Councilman Gleason, and seconded by Councilman Benedetto, that the request of Mr. A. H. Brooks for a building permit,which was read at the last regular session and referred to committee, be granted. Motion carried. Re: Thompson Permit City Attorney Daly stated that an ordinance now in effect in this city, of which none present appeared to have been previously aware, required that applications for building permits with respect to any building or hall wherein public gatherings might be hold require submission with the application of a detailed plan of the work to be done. Mr. Daly inquire as to whether the council might wish to reconsider the application of Mr. Thompson, for which permission was granted at the last regular session, upon this basis of fact. Following short consideration of the query presented by the City Attorney, it was moved by Councilman Gleason, and seconded by Councilman Mueller, that the City Clerk request ;,r. Thompson to submit a plan of the improvements contemplated in his application to comply with the ordinance as explained by the City Attorney. Motion carried. ADJOURNMENT No further business appearing upon which the council might take action at this time, it was moved by Councilman Steele, and seconded by Councilman Yueller, that the council do now adjourn.
