ORDINANCE NO.
AN ORDINANCE of the City of Port Townsend providing for an offense of negligent
operation of n motor vehicle, and amending Ordinance No. 1091 of
said city entitled "AN OlDINANCE relating to vehicles and the use
and operation thereof on the public streets, alleys and ways of the
City of Port Townsend; limiting and restricting certain uses of the
public streets, alloys and ways of the City of Port Townsend; pre-
scribing rules of the road for vehicles operating upon the same;
providing for conduct in the event of vehicle accidents; providing
procedure for enforcement of the provisions of this ordinance;
providing for certain records and reports; providing the porters and
duties of peace officers within the City of Port Townsend relative
to the enforcement of this ordinance; providing for the distribution
of fines collected for violation of any of the provisions of this
ordinance; defining offenses and fixing penalities, and repealing all
ordinances or parts of ordinances in conflict herewith" - Passed by
the City Counr.il, (.larch 15, 1938, approved by the Mayor, March 16, 1936,
by adding thereto a new section to be known as Section 35L, under
Chapter XI of said ordinance.
TIIE CITY COUNCIL OF THE CITY OF PQHT TOWNSEND DO ORDAIN AS FOLLY..S:
Section 1. That Ordinance No. 1091 of the City of Port Townsend, entitled "AN ORDINANC
relating to vehicles and the use and operation thereof on the public streets, alleys and way
of the city of Port Townsend; limiting and restricting certain uses of the public streets,
alleys and trays of the city of Port. Townsend; prescribing rules of the road for vehicles
operating upon the same; providing for conduct in the event of vehicle accidents; providing
procedure for enforcement of the provisions of this ordinance; providing for certain records
and reports; providing the powers and duties of peace officers within the city of Port Town-
send relative to the enforcement of this ordinance; providing for the distribution of fines
collected for offenses and penalties, and repealing all ordinances or parts of ordinances in
conflict herewith"- Passed by City Council March 15; 1938, approved by the Mayor larch 16,
1938, be and the same is hereby amended following Section 35 of Chapter XI and before Section
36 thereof, by adding thereto a new section to be known as Section 302, reading as follows:
Section ME It shall be unlawful for any person to operate a motor vehicle in a negli-
gent manner over and along the public streets, alloys and/or ways of the City of Part Tor:n-
send. For the purpose of this section to "operate in a negligent manner" shall be construed
to mean the o� vdtion of a vehicle upon the public streets, alleys and/or ways of this city
in such a m:.r.ner as to endanger OR BE LIKELY TO ENDANGER any persons or property.
The offense of operating a vehicle in a negligent manner shall be considered to be
lesser offense than, but included in, the offense of operating a vehicle in a rolkless maa
nner
and any person charged with operating a vehicle in a reckless manner may be convicted of the
lesser offense of operating a vehicle in a negligent manner. Any person violating the pro-
isions of this section will be guilty of a misdemeanor, PROVIDED, the Director of Licenses
of the State of Washington should not revoke any 113ense under this ordinance.
Section 2. That this ordinance be published once in the Port Townsend Leader to be in
orce and take eft'ect five (5) days from and after the date of such putilication.

After a short discussion, as to .the purposes of such an Ordinance, it was moved by
i ouncilman Steele and Seconded by Councilman Mueller that the first rending be considered
s the second reading and that the third reading be by title only. Upon roll call vote all
ix councilmen present voted in the affirmative and motion was declared carried.

RESOLUTION NO.
BE IT RESOLVED by the City Council of the City of Port Townsend, that the State Auditor
of the State of Washington be, and he is hereby authorized to pay direct to the Department
of Highways of the State of Washington, the sum of 174.89, representing the cost of painting
3.1 miles of traffic stripe within the City of Port Townsend, which mileage and which route
is part of n primary State Highway, and charge said sum to such amount as may be due the
ity of Port 'Townsend under existing law.

UNFINISHED AND NE-1.7 BUSINESS
Re: Sewers for Fifth Ward
Councilman Sullivan inquired as to the possibility of providing for a system of sewerage
Ln the Fifth Ward. In a short discussion which followed the City Attorney, Daly, informed
:he members of the Council that because of the large area and a small percentage of property
Ieveloped, such a plan at this time would not be fI nancially practicable.
Re: Sidewalk Repairs
Councilman Benedetto reported that the property owners concerned with repairs to the
sidewalks on the south side of Water Street between Taylor and Tyler Streets, had signified
:heir willingness to start this improvement but had not es yet been able to secure the ser-
•ices of a contractor to perform this work. City Attorney, Daly, inquired as to whether or
sot the estimate of cost were in sufficient detail to provide for the letting oh a contract
Basis thereon. A short discussion of various factors in the matter ensued.
It was moved by Councilman Gleason that the City Clerk be directed to address a letter
o Mr. F. W. Eisenbeis reouesting said party to provide for putting into proper repair the
dewalk upon rater Street adjoining his property, situate at the northwesterly corner of
ater and Adams Street and to construct a concrete sidewalk as provided by Ordinance, upon
he Adams Street side of said property. This motion was seconded by Councilman Steele and
arried by voice vote of the members present.
Bids to be called on Smith r.linger and Welch Sidewalk
It was moved by Councilman Sullivan that the City issue a call for bids for constructions
f the sidewalk adjoining the property of Smith Brothers, Sirs. Klinger and Geol belch, upon
he southerly side of Plater Street between Taylor and Tyler Streets, said bids to be opened
t the regular session of the Council to be held upon Noveber 6th, 1945. This motion was
econded by Councilman Benedetto.
Cite Engineer Lay, called attention of the members of the Council to the fact that the
entative plans for installation of an ornamental street lighting system in the down town
rea would require installation of underground cable and it would be well to provide, if
ossible, for the installation of such cable during the period of construction of this side-
alk and thus eliminate the necessity of subsequent breaking up and repairing of said side-
•alk for such installation.
The question was put for a vote upon the motion of Councilman. Sullivan, seconded by
Wuncilman Benedetto and upon voice vote, motion was declared carried.
ADJOURNMENT
There being no further business before the Council for their consideration at this time,
