The undersigned, since that time, has been in conference with attorneys for the
lessee corporation, and it has been impossible for our minds to concur on an adequate
and proper proposal that will meet the particular situation, and the exigencies there
However, 1 am confident that within the next day or trio, that a,written document
will be available in such form that it can be acted upon at the next regular meeting
of the City Council, :,:nrch 28th, if a euorwn of the City Council sees fit to meet on
that date.

The foregoing letter was referred to the Committee on 'eater and Drainage and it was
commonly agreed among those present that n meeting of the Council be held upon Tuesday,
Larch 28, and the Clerk was asked to notify each member to that effect.

Gentlemen: Re: Applications Ilos. 2651 and 2852 and
Permits Nos. R. 62 and R. 118
'„e wish to call your attention to Application #2851 for the appropriation of
100 second -feet from Big Cuilcene River and Application No. 2852 for storage of
3000 acre-feet of water in Lords Lake.
There has been no interest shown in these applications since u:ay 2, 1940 and
we are now wondering if the City has any plans for the future use of crater involved.
If not, these applications will be cancelled. Please let us hear from you concern-
ing these filings. Do not confuse the above application with Permit No. 1021, for
which a crater right certificate has been issued for 30 second -feet from the Big
C•uilcene River now in use by the City.
Reservoir Permit i,o. 118 for the City Lake project and Reservoir Permit No. 62
for storage of 750 acre-feet in Lords Lake are both subject to cancellation for
failure to file the required progress reports provided for under the provisions of
the permits.

A short discussion followed the reading of the foregoing communication which developed
that none of those present had definite knowledge as to the requirements outlined in said
letter. it was moved by Councilman Brown and seconded by Councilman Carroll that the water
sunerintendent be authorized to forward to the Department of Conservation and Development
the required progress reports when the form of such be determined. �otlon carried.
Further discussion of the matter with particular reference to the urgency for immed-
iate action resulted in a motion by Councilman Carroll that the :.:ayor and '.later Superinten-
dent together with such other city cfficials as they considered advisable, personally con-
tact :.:r. Bartholet with regard to the subject matter of the letter and other water permit
matters in order that definite knowledge upon the status of said water rights be determined

Street Department
A requisition b, the Street Department to provide for the overhaul of the motor of the
Adar.:s Grader rras presented and read and it was thereupon moved by Councilman Brown and
seconded by Councilman Carroll that the requisition be.rranted. Upon roll call vote, all
five members present voted in the affirmative and motion visa declared carried.
Police Department
A requisition by the Police Department for the naintinc of the two police cars at a
cost of approximately 9'100.00 was presented and read. A discussion as to the advisability
and necessity of this won;: resulted and it was moved by Councilman Brown that the newer
of the two cars be painted at a cost not to exceed �75.00 but visa lost for lack of a second

Re: Treasurer's Office Repairs
Councilman Buse placed before the Council the matter of the need for some repairs in
the office of the City Treasurer with particular reference to the fact that some nlaster
needed replacing and that certain portions showed crater stain which would require painting.
Councilman Bu:e moved that the necessary repairs to recondition the Treasurerts Office
be authorized which motion, rras seconded by Councilman Carroll and, upon roll call vote, all
five Councilmen present voted in the affirmative and motion rras declared carried.

Mr. H. J. Carroll who was present, having expressed a desire to present a matter before

Street Oiling Program Outlined
i.ir. '.:. A. Burge, ex-officio City Engineer, presented to the Council at this time an
outline of the streets to benefit by this year's road oiling program as tentively drawn up
subject, of course, to the availability of necessary supplies and stated that, if any chances
in the tentative program were considered advisable by L•he Council, these should be made at
an early date in order that the final definite program might be determined as early as
possible to allow for the time necessary for securing necessary '7.P.B, approval and such.

b:r. Burge also outlined at this time the proposed improvements of a sidewalk upon the
southerly side of 'aashington Street from approximately the easterly side of Harrison Street
to approximately the easterly side of Polk Street and seawalls at the southerly ends of
Taylor and (.,uincy Streets.
Street Department Emergency Ordinance Ordered

It was moved by Councilman Brown that the City Attorney dram an emergency ordinance to
provide for the, expenditure of ..1,500.00 from the City Street Fund to carry out the street
oiling program as now outlined. This motion was seconded by Councilman Sullivan and, upon
roll call vote, all five members present voted in the affirmative anal motion was declared
carried.

�® It was moved by Councilman Brown that the City Clarkbe instructed to advertise for
bids upon the street projects for sidewall: on 't:ashington Street and seawalls at the southerl
ends of Taylor and Quincy Streets, said bids to be opened at the regular session of April 16
This motion was seconded by Councilman Carroll and, upon roll call vote, all five Councilmen
present voted in the affirmative anti motion was declared carried.
Lr. Burge also reported on the attendance of himself and li:nyor Anderson at a meeting of
Civilian Defense heads held in Seattle and briefly outlined the points discussed at this
session.

Street Fund :Emergency Ordinance
The order of business by common consent reverted to ordinances and resolutions and the
emergency ordinance to provide funds for the city street oiling program :which was ordered
earlier in the session visa presented and read in full for the first reading. at this time as

AN OhDINANCE providing for the immediate appropriation of money for expenditure from
the City Street Fund of the City of Port Townsend during the ,year 1944,
and declaring an emergency.

',HEREAS, at the
time of the adoption of the official budget for the City Street Fund of the City of Port Townsend for the year 1944, the total cost of seal coating
certain streets within said city could not have been foreseen, and the sum of only
w4,500.00 has been budgeted therefor, and,
7:Hc4EAS, it now appears from figures submitted by the City Engineer that a sum
of ;f6,000.00 ::;ust be expended to accomplish the results sought to be obtained., and
