This communication was referred to the Committee on Police and Licenses to be consider- ed with the matter to which it pertains. From State Dept. of Highways The monthly form letter of the Dept. of Highways of the State of Wash. showing this city's November allotment of gasoline tax funds to be $869.32, was presented and read and ordered filed. UNFINISHED AND NE.- BUSINESS Assistant Sanitarian Appointed Mayor Anderson at this time announced the appointment as provided by motion at the last regular session of an Assistant Sanitarian whose duties were as outlined in the dis- cussion of the so-called rat control program, and named as appointee, Mr. M. T. Horne. 1943 Gasoline Bids Opened This being the date, time, and place set by the Council for the presentation of bids to provide the various departments of the city with gasoline for the year 1943, bids sub- mitted were opened by the City Clerk and the prices noted as follows: SHELL OIL COMPANY, INC. Premium grade gasoline, 1611yie per gallon First grade nonpremium gasoline, 14'R per gallon UNION OIL COIdPANY OF CALIFORNIA TIDEWATER ASSOCIATED OIL COMPANY Associated Flying "A" gasoline, 15� per gallon Associated ethyl gasoline, 17) per gallon STANDARD OIL COMPANY OF CALIFORNIA Flight gasoline, 14� per gallon Standard gasoline, 15V per gallon Standard Supreme, 17� per gallon Prices quoted were rechecked by the City Clerk for verification to the members of the Council, and after short consideration it was moved by Councilman Mueller and seconded by Councilman Sullivan that inasmuch as the bid of Shell Oil Company, Inc., quoted the lowest prices upon like quality basis that said bid be accepted and that the Mayor be authorized to sign the contract form presented. Upon roll -call vote, all four Councilmen voted in the affirmative and the motion was declared carried. Re: Letter from Representative Francis Pearson Mayor Anderson announced that he was in receipt of a letter from Rep. Francis Pearson, chairman of the Civilian Defense Committee of the State Legislature, stating that it was his desire that he be informed of the wishes of the various cities in this matter and to be of help to the cities wherever possible. Re: Civilian Defense Expenditures It was moved by Councilman Carroll and seconded by Councilman Sullivan that in view of the fact that the Attorney General of the State of Washington had rendered an opinion to the effect that county governments could not lawfully expend moneys in the maintenance of a Civilian Defense Program, the City Council go on record at this time as obligating the city to provide funds and pay claims to the extent provided in the budget for the year 1943, to maintain the present system of local Civilian Defense organization, pending such time as the opinion of the Attorney General might be further clarified or legislation concern- ing this matter might be completed. Upon roll -call vote, all four Councilmen present voted in the affirmative and motion was declared carried. Re: Trees Along "Maple Avenue" Mr. Rollie Stahl, City Superintendent of Streets, at this time called the attention of those present to the hazardous condition of the maple trees nor; growing along that portion of Tyler Street commonly :mown as "Maple Avenue." He stated that as a result of recent storms, certain of these trees had blown over and many limbs torn loose from others, which upon failing had become hazardous to vehicular and pedestrian traffic. He gave it as his opinion that these trees had all reached a point at this time when it was no longer safe that they be left standing and asked the Council what action they wished taken upon the mat- ter. Councilman Lammers advised that in the absence of the City Attorney it would be well for the matter to be carried over to the next regular meeting when they could be advised by the City Attorney as to the proper steps to be taken to bring about removal of these trees, should it be deemed advisable, and that the Council might further investigate as to the cond Lion existing in the intervening period. Washington Street Grade Repair Survey Authorized It was moved by Councilman Lammers and seconded by Councilman Sullivan that Mr. 17. A. Bugge, ex-officio city engineer, be authorized to proceed with a survey to determine costs and methods of correcting the present condition of what is known as Washington Street Grade ,due to deterioration of the timber retaining wall and consequent settling of the fill form- ing the present street area. Motion carried. n {o. 333'� MINUTES OF THE REGULAR SESSION OF THE CITY COUNCIL JANUARY 19, 1943, continued. j Taxi Rates J J Mayor Anderson stated that he had received a number of complaints to the effect that various rates were being charged by local taxi operators in instances where the trip cover- ed was identical or comparable. Councilman Carroll stated that matter had also been brought to his attention and after I' s short discussion, Councilman Carroll suggested that taxi operators be required to file a list of rates by zones with the City Clerk. It was thereupon moved by Councilman Sullivan] and seconded by Councilman Carroll that operators of taxi cabs in the City of Port Townsend be instructed by the City Clerk to file a list of rates by zones, such as they might de- termine with the City Clerk, so as to be available to the Council, and that a list of said I! rates be posted in each of the cabs in operation. Port Townsend, Washington January 26, 1943 The City Council of the City of Port Townsend, Washington, met in regular session this 26th day of January, 1943 at 7:30 otclock P. M. in the Council Chambers of the City Hall, Mayor H. E. Anderson presiding. ROLL CALL Officers and members answering present upon roll call were as follows: Mayor H. E. Anderson; City Attorney, W. J. Daly; City Clerk, C. F. Christian; and Councilmen G. F. Mueller, Edward Buse, Wm. Lammers, Sr., J. M. Carroll; Councilman Dennis Sullivan arrived later in the session. MINUTES OF PREVIOUS SESSION The minutes of the previous session were read and there being no corrections or alte- rations, same were approved as read. Sullivan Arrives Councilman Dennis Sullivan arrived during the reading of the minutes of the previous session and assumed his proper chair in the Council Chambers. COMMUNICATIONS From Shell Oil Company, Inc. A letter from Shell Oil Company, Inc., stated that prices shown upon the contract of- fered for consideration at the last regular session were in error through the carelessness of an employee and requesting that said contract be replaced by contract form accompanying letter, which contract quoting prices of 171E per gallon for Premium Grade gasoline and 15� per gallon for First Grade non -premium gasoline was read before the Council. Councilman Carroll stated that in view of the facts presented he felt that the contract of Shell Oil Company which was accepted at the last regular session should be declared void and the contract now presented be honored and further that inasmuch as these prices offer- ed were identical with prices offered by the other three companies bidding, the gasoline requirements for the year 1943 should be divided between the four companies bidding, upon the basis of an equal number of months for each company, and moved the same. The motion was seconded by Councilman Buse and upon roll -call vote all five Councilmen present voted In the affirmative and motion was declared carried. BILLS AND CLAIMS The claim of the Jefferson County Auditor in the sum of p225.00, this being the city's share of the expenses of the September and November elections, was presented at this time by the City Clerk for consideration of the members. The Clerk stated that this was the only bill remaining against the 1942 budget and inasmuch an the books for the year 1942 should be closed and there is no provision for election expenses in the 1943 budget, he considered it advisable that this claim be allowed at this session. The foregoing claim was approved and signed by members of the Finance Committee and it was thereupon moved by Councilmen Lammers and seconded by Councilman Carroll that the rules of the Council be suspended to allow consideration and that the Mayor and City C1erY_ be authorized to issue a warrant upon the proper fund in payment of said claim.
