Motion carried. Re: Glassford street vacation petition. l I It visa moved by Councilman Brown, and seconded by Councilman Cornett, that the City Clerk be directed to post the required notices of a hearing upon the petition of Pulliam A. Glassford, and Pelham D. Glassford for the vacation of a portion of a street, as read at a former session; said hearing to be held in the Council Chambers at the regular session of the City Council tb be held on August 5, 1941, and at which any taxpayer might appear and be heard for or against such vacation. 14otion carried. O.RDINANCES AND RESOLUTIONS. li The proposed "willow Street Sewer" Ordinance, which was read in full for the first reading at the last regular session, visa read in full, at this time, for the second reading; whereupon it was moved by Councilman Lammers, and seconded by Councilman Cornett, that the council recess for a short period. Motion carried. (8:15 p.m.) Reconvened. f' The City Council of the City of Port Townsend, Washington, reconvened in regular sessi at 8:40 o'clock p.m., and upon Roll Call the following Officers and Members were noted present: L.ayor, H. E. Anderson;;City Atborney, 'N. J.Daly; City Clerk, C. F. Christian; andl Councilmen Robt. W. Brown, vim. Lanuners Sr., J. i:. Carroll, W. B. Cornett, and J. F. Yaroldo ! It visa moved by Councilman Brown, and seconded by Councilman Carroll, that Section 4 +� p of the proposed ordinance be changed in that the sum of � 6,555.00 be raised to $ 6,600.00. uJ Motion carried. (t,j) It was moved by Councilman Brown, and seconded by Councilman Cornett, that the propose ordinance be read by title only for the third reading; and upon roll call vote, all five councilmen present voted in the affirmative and the motion visa declared carried. ' The proposed ordinance was read by title only for the third reading, and tt was there- upon moved by Councilman Brown, and seconded by Councilman Cornett, that the ordinance do now pass. Upon roll call vote, all five councilmen present voted in the affirmative and i the motion was declared carried. Ordinance, as passed by Council, follows: 1 ORDINANCE No. t AN ORDINANCE providing for the acquisition and construction by the City of Port Townsend of a system of sewerage, specifying and adopting the plan I proposed for said system, declaring the estimated cost thereof as near as may be; creating a special fund for the sole purpose of defraying the cost thereof and issuing bonds payable out of said fund to finance said sewer system. THE CITY COUNCIL OF THE CITY OF PORT TW.NSEND DO ORDAIN AS FOLLOWS: Section 1. That the City Council of the City of Port Townsend deems it 'r• advisable that said City acquire, construct, and operate a sevrer system that will provide a section of the City of Port Townsend, and the inhabitants thereof, with adequate facilities for the disposal of sewerage. Section 2. That the proposed plan and system of sewerage disposal as afore- said provides for a sewer system to be constructed within the corporate limits of said City by underground cement pipe laterals sufficient in diameter to carry all sewerage and refuse from the district served by each lateral; said laterals connect- ing with a main trunk system constructed of cement, which main trunk corunences on Pu llow Street opposite the center line of Block 1 of Plebster's Addition to the City of Port Townsend and runs thence in an easterly direction to a connection with the main city sewer at the intersection of Lawrence and Scott streets, all in accordance with the plans and specifications thereof now on file in the office of the City Clerk of the City of Port Townsend. That said sevrer system shall be a public utility of the City of Port 'Townsend. Section 3. That the City Council of tare City of Port Townsend hereby adopts the proposed plan for a system of sewerage for the City of Pgrt Townsend as specified in Section 2 of this Ordindnce. Section 4. That the estimated cost of daid system of sewerage, as near as may be, is the sum of :pt 6,600.00. Section 5. That to finance the acquisition and construction of said system of sewerage, 'the City Council of the City of P rt Townsend, deems it advisable ! and necessary to create a special fund, to be Rnown as "'billow Street Sewer Fund", i for the sole purpose of defraying the cost of the system of sewerage aforesaid, and to obligate and bind the said City to set aside and pay a fixed proportion of the gross revenues of such public utility, or e;fixed amount without regdrd to any fixed proportion, into said special fund; and to issue and sell coupon bonds of said City, bearing interest not exceeding six per- cent (90p) per annum, payable semi-annually or annually at election of purchaser; such bonds, as so issued, shall be in denominations of not less than a 100.00, nor more than Cw 500.00, ans shall be numbered from one upwards consecutively; shall bear the date of their issue., shall be serial in form finally maturing not later than twenty years from date; and in all other respects shall conform to the provisions of Chapter 193 of the Laws of 7;aahington, 1941, said bonds and the interest thereon to be payable out ' of tine special fund aforesaid only. That said fund is to be maintained by revenues obtained from the said sewer system by virtue of rates and charges, to be established by ordinance for the furnishing of the sewerage to those receiving such service, such rates and charges to be uniform for the same class of service and to be made on a monthly basis, the total revenues to be so estimated and based to be sufficient to take care of cost of maintenance, operation, extensions, interest and sinking fund requirements, and other charges incidental thereto. Section 7. Insofar as the provisions and intent of said Chapter 193 of the Laws of Washington, 1941, apply to this ordinance, the same are made a part hereof as fully as if Incorporated herein, and the City Council of the City of Pdrt Townsend hereby binds said City to each and every obligation thereof. Section 8. That this ordinance be published once in the Port Townsend Leader, to be in force and take effect as provided by law. A delegation of residents of the vicinity of Chimacum corners, sixteen in number, were present in the Council Chambers; and 11:ayor Anderson stated that he believed that they had a matter which they wished to bring to the attention of the members present, and invite them so to do at this time. Mr. G. H. Tranum, acting as spokesman for the group, stated that the matter of obtain- ing water for the vicinity of Chimacum had been presented to the council previously, but that no definite action had been taken, as yet, and that it was the purpose of this dele- gation to endeavor to obtain a definite decision on the matter at the earliest possible date. He reiterated the former statements that the water frorn the we11A in that district contained such an amount of iron as to make it undesirable for use, that the water supplied by the present gravity system of the district was inadequate and altogether unfit for human or, commercial use and that no relief could be seen in this direction, lie enumerated the residents, the business establishments and such that were concerned in the matter, and stated that the count;; shops and the schools of that district were desirous of obtainin_7 a better water supply; and concluded with the statement that inasmuch as the City of Port Townsend had a sufficient supply, and theft a financial gain to the city visa assured, he could see no reason why this objective could not be gained. An informal discussion among those present followed for a short period, slid upon conclusion of said discussion it visa moved by Councilman Carroll, and seconded by Council- man b:aroldo, that the '„ater Co"c:.ittee of the Council meet with a cormitttee selected by the delegation present at a time and place to be set at the conclusion of this meeting, to secure all available information upon the subject, and to present their recosmiendations to the council, as a whole, at the earliest opportunity. No further business appearing, for consideration by the council at this time, it was moved by Councilman y:aroldo,.eud seconded by Courrc.`_lman Brown, that the Council do now adjourn.
