Miller, who was present, signified the willingness -of the petitioners to bear such cost. It was thereupon moved by Councilman Town, and seconded by Councilman Cornett, that the said portion of Oak Street .e vacated, and that "Ine pity attorney prepare an ordinance for presentation at the next regular session for this purpose. Grady, informed him t that undrr present state statute, levy for Parks and recreational purposes in cities of the Third Class, were limited to one mill except by vote of the people of the City at a special levy election. This was for the information of the Committee in determining the possibility of the city sponsoring such a project.
