PROCLAMATION
WHEREAS, Public works professionals focus on infrastructure, facilities, and
services that are of vital importance to sustainable and resilient communities and to the
public health, high quality of life, and well-being of the people of Port Townsend; and
WHEREAS, Quality and reliable infrastructure, facilities, and services such as
water supply, water treatment, transportation, solid waste, fleets and buildings, are not
possible without dedicated efforts of public works professionals at all levels of
government; and
WHEREAS, Our dedicated team has served our community consistently for
decades, directly stewarding and contributing to the uniqueness, vitality, and
extraordinary nature of our people and place; and
WHEREAS, It is in the public interest for the residents, civic leaders, children,
and visitors of Port Townsend to gain knowledge of and maintain an ongoing interest
and understanding of the importance of public works and public works programs in their
respective communities; and
WHEREAS, The year 2024 marks the 64t" annual National Public Works Week
sponsored by the American Public Works Association.
NOW, THEREFORE, I, David J. Faber, Mayor of the City of Port Townsend, do
hereby proclaim the week of May 19 through May 25, 2024, as
Public Works Week
and further extend appreciation to our Public Works professionals, engineers,
managers, and employees, and to municipal public works staff around the region for the
vital services they perform and the exemplary dedication and contributions they make to
protect our health, safety, and quality of life for all.

MINUTES OF THE CITY COUNCIL WORKSHOP MEETING OF APRIL 8, 2024
CALL TO ORDER/ ROLL CALL
The Port Townsend City Council met in a Regular Session on the 8th day of April 2024 in
Council Chambers at 540 Water Street. Mayor David Faber called the meeting to order
at 6:00pm.
Councilmembers present at roll call were David Faber, Amy Howard, Monica MickHager,
Aislinn Palmer, Owen Rowe, Ben Thomas, and Libby Wennstrom.
Staff members present were City Manager John Mauro , Public Works Director Steve
King , Parks and Recreation Strategy Director Carrie Hite , Marketing and
Communications Director Shelly Leavens, Planning and Community Development
Director Emma Bolin , and City Clerk Alyssa Rodrigues.

DISCUSSION ITEMS
Quarterly Workplan Review
City Manager John Mauro, Marketing and Communications Director Shelly Leavens,
Planning and Community Development Director Emma Bolin, Parks and Recreation
Strategy Director Carrie Hite, and Public Works Director Steve King provided the On
the Path: Our integrated workplan, talented team, and responsible budget working to
deliver for our community presentation which included Overview, Strategic Workplan:
7 Priority Areas, 2024 Strategic Workplan (Invest in Our People, Engage Our
Community, Strengthen Our Financial Position, Envision Our Sustainable Future,
Embrace and Resolve Our Community's Challenges, Deliver the Basics), 2024
Strategic Workplan, and Policy Suggestion Board.
In response to Council's clarifying question staff explained the integrated
communication strategy, budget schedule, integrated software tools, pool task force
format, members of pool task force, infrastructure timeline, selling Cherry St, and
what BRIC and FSI stand for.

In response to public comment staff explained developing the workplan and federal
funding.

Transportation Update
Steve King, Assistant City Engineer Jeff Kostechka, and Project Manager Tyler
Johnson presented Tyler Street Paving Project Parking Discussion which included
Title VI Public Participation Form, Background and Sideboards, Tyler Street- Parking
Question, Existing Parking Within 1 Block, Options Evaluated, Option 1.A Maintain
Existing Head -in Parking, Option 2 Change to Head -out Angled Parking, Option 2
Additional Information, Pros and Cons of Each Parking Option, Option 3 Change to
Parallel Parking, Feedback Received to Date, Clay to Jefferson Street Parallel
Parking vs. Downhill Bike Lane, and Staff Recommendation.
In response to Council's clarifying questions staff explained Parks, Recreation,
Trees, and Trails Advisory Board involvement, estimate to fix trip hazards, bulb out
and Farmers Market impact, bikes encouraged to go in lane, entry island, and Clay
to Jefferson St.
Discussion ensued around downhill bike lane.

In response to public comment staff explained 45 vs 60-degree parking.
Discussion ensued around head out parking stall amount, favoring head out angled
parking 60 degree, widening the sidewalk, planters with shrubs, Farmers Market
impact, tire stops, curb height, and parallel parking on Clay to Jefferson St.
Steve King, Tyler Johnson, and Jeff Kostechka provided the Public Works
Transportation Projects Update which included Transportation- Big Yead,
Transportation Grants, ELRs and 2024 Striping, Street Division Work Planning, First -
year TBD- 2024, Foreshadowing- TBD 2005 Budgeting, Non -Motorized- Street Master
Plan, Projects Update, Projects and Individual Engagements, and Planning and
Doing.
In response to Council's clarifying questions staff explained ditching, 2022 hours
represented on slide, electric bikes on trails, contracted work, and bike signage on
Kearney.

In response to public comment staff explained 2-inch curb on Tyler St.
Discussion ensued around April 19 T-Lab meeting and new streets machinery.

CALL TO ORDER
The Port Townsend City Council met in a Special Session on the 15th of April 2024 in
Council Chambers at 540 Water Street, Port Townsend, WA. Mayor Faber called the
meeting to order at 5:30pm.
ROLL CALL
Councilmembers present at roll call were David Faber, Amy Howard, Monica

EXECUTIVE SESSION- PURSUANT TO RCW 42.30.110 (1)(G)) PERFORMANCE OF
A PUBLIC EMPLOYEE. (APPROXIMATELY 45 MINUTES)
Council went into Executive Session at 5:32pm for approximately 60 minutes to discuss
Performance of a Public Employee pursuant to RCW 42.30.110(1)(g)), to Consider the
Selection of a Site or the Acquisition of Real Estate by Lease of Purchase when Public
Knowledge Regarding Such Consideration Would Cause Likelihood of Increased Price
pursuant to RCW42.30.110(1)(b)), and Discussion with Legal Counsel about Current or
Potential Litigation pursuant to RCW 42.30.110(1)(i)).
Council came out of Executive Session at 6:36pm. Mayor Faber announced action from
Executive Session will be taken during the Presiding Officer's Report.

City Manager John Mauro provided the City Manager's Report which included
Recompete, new Finance Director Jodi Adams, City Attorney Alexandra Kenyon,
Healthier Together taskforce, KPTZ, Naloxone training, TLAB conference, Connectivity
Fair, Main St Earth Day Spring Clean Up, and Point Hudson Breakwater Opening.

Authorizing the City Manager to Execute a Contract and Any Related Agreements with

Acknowledging Alexandra Kenyon as Port Townsend City Attorney (per PTMC 2.08.020)
Authorizing the City Manager to Execute all Agreements Necessary to Complete the
Condition Assessment of the 1928 sections of the OGWS Pipeline
Resolution 24-014 Declaring an Emergency, Waiving Public Bidding Requirements, and
Ratifying the City Manager?s Approval of all Applicable Documents to Allow for the
Immediate Repair of Erosion Damage to Affected Stormwater Infrastructure
Authorize the City Manager and Mayor David Faber to draft and send invitation letters to
federally recognized Tribes whose ceded lands lie within Port Townsend.
Council member MickHager stated regarding Item E to get a Council update if it goes
over the stated amount.
Motion: Monica MickHager moved to approve the consent agenda. Owen Rowe
seconded.
Discussion ensued around supplemental budgets.
Vote: motion carried unanimously, 7-0 by voice vote.
UNFINISHED BUSINESS
Resolution 24-013 Authorizing Angled Parking on Tyler Street
Public Works Director Steve King presented Resolution 24-013 Authorizing Angled
Parking on Tyler Street which included previous discussions, previous presentation,
grant details, angled parking, three parking options, first reading, workshop, pros/cons,
safety standpoint, bicycles, head out angled parking, outreach feedback, parking count,
parallel parking recommendation, and spring striping.
In response to Council's clarifying questions staff explained staff recommendation and
safety obligation, angled parking in other areas of town, head out parking earlier than
project, center stripe on Tyler St, misunderstanding the flow of traffic, and sidewalk
extension.

Discussion ensued around the process of painting stripes before full project, preference
of head out parking, importance of communication, parallel parking, and staff time
inventory.
Motion: Monica MickHager moved to approve Resolution 24-013 Authorizing Head Out
Angled Parking on Tyler Street. Aislinn Palmer seconded.
Discussion ensued around center line and importance of messaging first.
Vote: motion carried unanimously, 7-0 by voice vote.
NEW BUSINESS
Final Approval: Comprehensive Plan Public Participation Plan
Planning and Community Development Director Emma Bolin and Long -Range Planner
Adrian Smith introduced Final Approval: Comprehensive Plan Public Participation Plan
which included March Workshop, May 9 Vision Workshop, Draft Public Participation
Plan review, how to reach people, updates in Roles and Responsibilities, updates in
non -governmental organizations, Principles of Public Engagement, Public Engagement
Tips, and detail document.
In response to Council's clarifying questions staff explained QR Codes and housing
providers.

Discussion ensued around a community building exercise, appreciation for work and
detail, return to public participation, and reaching new groups.
Motion: Aislinn Palmer moved to approve the Public Participation Plan. Owen Rowe
seconded.
Vote: motion carried unanimously, 7-0 by voice vote.

Resolution 24-015 Updating and Establishing New Fees for Building and Planning and
Community Development Fees
Emma Bolin presented Resolution 24-015 Updating and Establishing New Fees for
Building and Planning and Community Development Fees which included annual
updates, mid -year updates, annexation agreement with East Jefferson Fire Rescue
expiration, amendment to continue services for 6 months, charging fees on districts
behalf, convening a committee, district hourly rate vs city hourly fee, annual consumer
price index increases, occupancy updates, community risk reduction program, fire risk
management in the City, office of Fire Marshall, each role, interim, and language error.
In response to Council's clarifying questions staff explained fees in effect currently,
valuation data, Exhibit A, building valuation data, building permit fee total valuation, per
dollar of additional valuation, and fire inspection fee communication plan.

Motion: Owen Rowe moved to approve Resolution 24-015 Updating and Establishing

Ordinance 3336 Vacating a 30x60-Foot Portion of the Reed Street Right -of -Way Abutting
Lot 2, Block 25, Mountain View 2nd Addition; Authorizing Exchange of 30x50 Foot Portion
of Reed Street for 10x266 Feet of Private Property; Providing for Severability; Providing
for Corrections; and Establishing an Effective Date
Emma Bolin and Steve King provided the Ordinance 3336 Vacating a 30x60 Foot
Portion of the Reed Street Right -of -Way Abutting Lot 2, Block 25, Mountain View 2nd
Addition; Authorizing Exchange of 30x50 Foot Portion of Reed Street for 10x266 Feet of
Private Property; Providing for Severability; Providing for Corrections; and Establishing
an Effective Date presentation which included suitable building site, Chestnut St, public
trails, Lots 3 and 4, 10 ft of Chestnut St, 10 ft trail on top of water reservoir, completed
requirements, and land exchange.
In response to Council's clarifying questions staff explained Council process, changes
since 2020, and strip between Lot 2 and Lot 9 vacated street.

Street for 10x266 Feet of Private Property, Providing for Severability, Providing for
Corrections, and Establishing an Effective Date Aislinn Palmer seconded.
Discussion ensued around appreciation of the property owner giving the extra 3ft.
Vote: motion carried unanimously, 7-0 by voice vote.

Motion: Aislinn Palmer moved to approve the City Manager Evaluation for 2023. Owen

Farmers Market Opening Day, and Point Hudson Breakwater Event.

SUMMARY STATEMENT:
Like all 271 cities in Washington, Port Townsend is a member of the Association of
Washington Cities (AWC) and we regularly and actively participate as a member.
AWC's Annual Conference offers a city -focused agenda, with general sessions,
workshops, networking opportunities, an exhibit hall, and social events designed to
maximize the attendee experience. The conference offers educational, thought -
provoking, and inspiring sessions about a wide variety of city issues. Attendees are
typically City councilmembers, mayors, managers and administrators, and department
heads. At the meeting there may be votes of cities to establish goals or direction for the
organization or for legislative priorities. Delegating voting responsibilities to a
councilmember attendee is beneficial to the City so that our collective voice (particularly
that of our governing body) can be heard.
Deputy Mayor Amy Howard serves on the AWC board and will be traveling to and
attending the conference. Delegating voting responsibilities to her provides those
benefits to the city.

SUMMARY STATEMENT:
Every two years, grant opportunities for Safe Routes to Schools and Bicycle Pedestrian
program funding becomes available. The grant programs are highly competitive with
many millions of dollars applied for with limited funding available. However, the City has
been successful in securing grants under these programs in the past. The last bike-ped
grant was for $1.4 million for Discovery Road.
Grants applications are due by the end of the month. Given current work loads with
engineering staff, the only possible way to submit an application is to re -submit
previously approved applications.
In 2022, the City Council went through a prioritization process at the May 2, 2022
business meeting. The meeting packet and information is available on the City's

The Council at the time prioritized applying for shared use path on Discovery Road
between 19t" and San Juan as well as SR20 sidewalk at Bishop Canyon. Council

SR20 — Logan to Hancock Streets: This project proposal would install sidewalk to fill
a gap. The project would not include a bridge, but rather traffic calming measures by
narrowing up the lanes as well creating a buffered bike lane. Staff also recommends a
rapid flash beacon for crossing the street at Hancock.
Proposed sidewalk and access ramps on south side of SR20 between Logan to Hancock Street.
Staff recommends doubling down on both of these projects again given much of the
grant work has already been done and to honor Council priorities of the past.
Additionally, the Discovery Road shared use path may be well suited to couple with a
TIB grant given the pavement is deteriorating quickly. This project would also support
PT Preservation Alliance development.
This strategy is recommended based on staff availability to get the work done, Council
priorities, and community benefit for highly utilized key transportation routes.
If successful, the financial impact to the City will be in terms of match funding and cost
staff engineering time and overhead.
The Discovery Road — 19t" to San Juan estimated financial impact is estimated at
$250,000. There is no match required; however, this project would require extensive
staff oversight and funding is needed to cover grant ineligible overhead.
The SR20 — Logan to Hancock estimated financial impact is estimated at $150,000.
There is no match required; however, this project would require staff administrative
costs in coordinating with WSDOT and to cover grant ineligible overhead.
If either or both of these projects are funded, Transportation Benefit District funding or
Real Estate Excise tax is recommended as a source of city funds.
Staff is asking for City Council support for these two project applications.

SUMMARY STATEMENT:
Councilmember Aislinn Palmer, City Council Position #2, submitted her resignation to
Mayor David Faber on May 6, 2024, effective May 31, 2024, as she will be living outside
of Port Townsend. State law prohibits Councilmembers from holding office if they reside
outside of the city they represent (RCW 29A.04.151).
Article 3 of the Port Townsend City Council Rules of Procedure pairs with the state law
(RCW 42.12.070), outlining how Council vacancies are to be filled "with the most
qualified person available until an election is held." This includes the City Council:
• Widely distributing and publishing notice of the vacancy, the procedure, and any
application form for the vacancy.
• Drawing up an application form which contains relevant information to answer set
questions posed by the Council.
• Interviewing candidates publicly at City Council meetings.
• Making a decision on appointment to fill the remainder of the term within 90 days.
In the case of Position #2, the vacancy to be filled would start from appointment,
expected by the end of August 2024, through November 2025 when that seat is again
up for election (RCW 29A.24), once it is filled immediately (not in January 2026) upon
certification of the general election. The position must be appointed by Council within
90 days of the vacancy (in this case, August 29, 2024) or the appointment responsibility
shifts to the County Commission. Should the County fail to do so within 180 days, the
County (or City) may petition the Governor to appoint a qualified person to fill the
vacancy.
With the process and constraints clearly set out in Council rules and State code, the
task ahead before this governing body is four -fold:
1. To determine the timeline of the process (i.e., in alignment with City Council
business meetings and before 90 days elapse; three such options below).
2. To agree an application form including a set of questions for candidates,
interview approach, and evaluation criteria (draft: Attachment A), as well as a full
application (draft: Attachment B).
3. To widely distribute and publish the timeline and application form.
4. To interview candidates and make a decision on appointment.
Staff presents three options for the timeline for council consideration, including an
approach for soliciting and agreeing application/interview questions and publishing the
timeline and application.
Based on an evaluation of a range of factors (e.g., Council shaping application,
application period, public visibility, expediency, duration of seat vacancy), staff

About the Port Townsend City Council
As the City's governing body, Port Townsend's seven elected part-time City Councilmembers establish
City policies and laws, adopt an annual budget, approve appropriations, and contract for services. The
Council hires and evaluates the City Manager, who is responsible for preparing a budget for the Council's
consideration; recruiting, hiring, and supervising City staff; operating the services of City government;
serving as the Council's chief adviser; collaborating with local, regional, state, and federal agencies; and
carrying out the Council's policies, among other duties.
City Councilmembers serve staggered four-year terms; roughly half the Council is up for election
every two years. All Councilmembers are "at -large", meaning that they are elected by and serve the City as
a whole as opposed to a specific district in the City.
The City Council chooses a Mayor and Deputy Mayor from among its members at the first
meeting of the new year following an election. The Mayor presides at Council meetings and
represents the City at ceremonial functions and inter -governmental meetings. The Deputy Mayor
presides in the Mayor's absence. They and the City Manager set the agenda for City Council meetings.
Most City Council meetings are held on V, 2"d, and 3rd Mondays at 6:00 p.m. Occasionally special
meetings are scheduled as needed. There are no Council meetings on Mondays that are legal holidays.

Councilmembers may also serve on or liaise with Council committees, regional and local committees, and

Serving on the Port Townsend City Council is a part-time position. The position includes a nominal monthly
salary, compared regionally and determined locally by a Salary Commission, which is as follows:

As determined in late 2022, a Council majority is able to form a workgroup for health coverage and apply

In 2023, the WA legislature passed SB 5290, which made changes to the Local Project
Review Act and associated permit timeline requirements to approve certain types of
permits. Associated with these new requirements are grant opportunities to assist
jurisdictions to find efficiency in permitting procedures, ultimately to hasten the housing
supply pipeline. The first of two competitive grants is now available, the "Consolidated

Staff is keen to hear feedback on some of these ideas to include in our grant
application.
The city must demonstrate during the grant period that we are able to issue residential
building permits in 90 calendar days or less. If not, the State will put the City on
probation. The City could become ineligible for grants if unable to resolve exceeding
backlog. The City's timeline to issue residential building permits and the associated
street development and minor improvement permits takes 30-45 days typically. With
the March 2024 State Building Code changes, there was a permit application surge. The
surge has increased our permit issuance to 60-80 days —still under the 90-day threshold.
By July 1, when the grant's compliance period begins, we hope that the backlog will
mostly be resolved.
The City team already is working diligently on residential building permits. The pre -
platted and replatted nature of the City makes engineering review for infill building
permits exceptionally challenging. This grant would help us work through code,
standards, and fees to overcome these challenges. While it's impossible to future -proof
the City to forever achieve a 90-day or less residential building permit review, it's more
urgent to demonstrate our commitment to efficiency and housing supply pipeline.
Grant eligibility hinges on Council adoption of the statements in the resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON, TO BEGIN TO ISSUE FINAL DECISIONS ON RESIDENTIAL
BUILDING PERMIT APPLICATIONS WITHIN 90 CALENDAR DAYS AND
DETERMINE A FEE STRUCTURE ALLOWING THE CITY TO PROVIDE
CONSOLIDATED PERMIT REVIEW WITHIN 90 CALENDAR DAYS EFFECTIVE
JULY 1, 2024.
WHEREAS, major changes were made to the Local Project Review Act with the passage
of Senate Bill (SB) 5290 in 2023 intended to consolidate, streamline, and further improve local
permit review processes for applicants, customers, planners, builders, and designers; and
WHEREAS, the Department of Commerce, as mandated under SB 5290, established the
"Consolidated review grant program" to enable jurisdictions to consolidate residential building
permit review in order to address shortages in housing across the state; and
WHEREAS, City grant eligibility requires it to adopt a resolution which meets the
requirements of RCW 36.70B.240; and
WHEREAS, the time it takes the City to review and issue decisions on residential building
permits is historically less than 90 calendar days; and
WHEREAS, the grant availability provides an opportunity for the City to access grant
funds to cut through the permit backlog due to an application permit submittal surge due to a rush
to vest before the March 15, 2024 State Building Code update; and
WHEREAS, the grant is an opportunity to identify ways to streamline development codes
that remove barriers to housing affordability; and
WHEREAS, residential building permit delays result from lack of clarity in street,
sidewalk, and infrastructure design and engineering design standards;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend, Washington, that the City Council makes the following commitments to building
permit review consolidation:
a. No later than July 1, 2024, the City will begin to issue final decisions on
residential permit applications within 90 calendar days, using consolidated review for
building permit applications.
b. No later than July 1, 2024, the City will determine a specific fee structure
that will allow the City to continue providing consolidated permit review within 90
calendar days.
c. On September 15, 2024, December 15, 2024, March 15, 2025, and June 15,
2025, the City will provide a quarterly progress report and status update to the
Department of Commerce. The report must include the average and maximum time for
issuing final decisions on residential building permits using consolidated review during
the City's participation in the grant program. The status update will include a
Resolution 24-018
description of work completed under chosen eligible activity or activities.
d. If the City is unable to successfully meet the terms and conditions of the
grant, the City understands that it must enter a 90-day probationary period. If the City is
unable to meet the terms and conditions of this grant by the end of the probationary
period, the City will no longer be eligible to receive grants.

SUMMARY STATEMENT:
City staff recommends adding seasonal FTEs to the 2024 personnel schedule as
follows. These seasonal positions are for a 6- month terms each and will be funded by
capital projects for work already budgeted for 2024.
Add 0.5 FTE seasonal to support streets division work for banked capacity
projects. The addition of a seasonal employee would help the streets crew
immensely in performing 2023 banked capacity projects. It is possible that staff
will ask for an extension into next year but will follow up as needed and as
budgeted for 2025.
Add 2.0 FTEs (4 seasonal employees for 6 months each) to assist the water
distribution crew in performing lead and copper plumbing assessments and to
install water meters. The lead and copper inventory would be combined with
water meter replacements budgeted for in 2024.
Given that banked capacity streets projects and the water meter replacement program
extend into 2025, it is possible to extend these seasonal positions into 2025. This
would make the positions possibly more attractive for a longer term. However,
extension requires budget approval for 2025 and approval by the Union to make an
exception to the General Bargaining Agreement..
Finally, staff recommends this strategy to help engage new workforce in public works
professions. Seasonal employment is a great exposure to public works and gives the
City a chance to work with prospective future long-term employees.
