No. 1464 was read for the third time by title only and it was moved by Councilman Siebonbaum seconded by Councilman Hoglund that Ord. No. 1464 do now pass. Notion carried. ORDINANCE NO. 1465 AN ORDINANCE AMENDIIiG ORDINANCE 1204, AS AniENDED BY ORDIIIA14CE 110. 1437, and THEREBY REDUCING A LICENSE FM-. THE CITY COUNCIL OF THE CITY OF PORT TOVINSEND, in regular session assembled, do ordain as follows: Section 1. Section 1 of Ordinance 1204, passed on December 17, 1946 and approved on Dec. 18, 946, and there after amended by Section 1 of Ordinance No. 1437 which was passed and approved on February 19,1963, is here and hereby amended to road as follows: "Sectionl. Each and ev::ry person, firm or corporation having at any place or places of business within the City of Port Townsend, a device, devices, machine or machines which are mechanical music machines or are for playing games of amusement, commonly known as pin and ball machines or devices, or machines in which coins may be dropped for the purpose of operating the same (unless specifically exempted by this Ordinance) and which may be legally operated within the State of Vashington, shall pay an annual license fee of rive Hundred Dollars ($500.00) for an owner's or operators license Section 2. --7his Ordinance shall take effect immediately upon its passage, approval and publication in the form and manner required by law. Motion carried. THIRD READING AIM PASSAGE OF ORD. No. 1465 Ord. Ho. 1465 was again read for the third time by title only and it was moved by Councilm Hoglund seconded bt� Councilman Thomas that Ord. No. 1465 do now pass. Motion carried. NE'11 L OLD BUSINESS Councilman Lindsey referred to the letter and request of the Library to use the Haller Fountain for coins, after some discussion 'Mayor Sullivan referred the request to the water committee for a report at the next regular session. Mayor Sullivan reminded the council that a meeting of the health Dept-. would be held in Senuim on the 6th of Jan. and if the weather permitted he would like to have all attend that could. :ire Chief Jones reported that the new fire truck was being put together and it looked like the city was going to have a fire truck whether they wanted one or not. Attorney Abrah said that he had approved another form of lease with the bank. :Mayor Sullivan reappointed Mrs Dorthy Hand & Mr Heil Potoff for five year terms on the Library board. Engineer Bockersaid that he had received a phone call from Cary & Cramer who were doing the planning survey for the sewer Dept. They requested to have permission from the council to take areal photographs of the city for £heir planning. Eng. Backer asked if the planning survey were going to do the same and according to the report they already had, he thought the t-ing to do was to got in touch with the arial co. who took, the last survey and 'buy the photes from them for it would be a lot cheaper. :Mayor Sullivan asked Eng. Backer if he wouli get in touch with the planning commission. City Attorney Abraham informed the Mayor & Council that the City had finally been sued by Bignold Co. who visa a sub contractor for :Morris Const. Co. on the main water transmission line project, the amount visa for 645,629.24 plus $8,000.00 attorneys fees. lie said he was not going to bore the council with to many details for as they know it mud been brought before the council quite a few times in the last and each time the council had rejected the claim. He also mentioned that Morris Const. Cc and the General Insurance of America Cc were also co-defendants. Attorney Abraham said that the construction firm was attempting to stif the burden onto the city for the difficulties it encountered in the construction work but th city had faithfully met the terms of the contract, and that both he and the city engineer wer6=btimistic that the action would be resolved in favor of the city. Strs e'. Supt. Aray asked p:rmission from the council to dispose of a 1922 white flatbed truck that had been purchased by the city for 10.00 from the county years ago. It vrns moved by Councilman Carter seconded by Councilmen Siebonbaum that permission be granted. Motion carried. Mayor Sullivan asked :..r Thomas Dunstan an architect from Seattle to speak before the count on behalf of the H.A. Parker Development Co. Inc. V:r Dunstan said that he had plans for a million dollar shopping center, the development site would run from Dolk to Harrison streets and extend some 220 foot into the bay south of water at. Construction plans culled for dredging and filling -of the site, a breakwater -would be constructed along the present Front St. line with the dredged area beyond to be later utilized as a marina. The shopping center would feature a new safoway store and neighboring store space would be developed in annordance with demand and the parking area eventually enlarged to accommodate 150 cars. Tile entire project -would include a total of some 35,000 square feet of construction plus the waterfront restaurant and marina. lie said lie would like to have confirmation from the counc_1 to vacate the waterfront portions of Polk and Fillmoro streets as well as a portion of Front Street. he said that ontions already had boon obtoi ned on the necessary real estate i
