i hereby request that I be granted a lease, for 5 years, of that portion of Kearney Street
lying between 'Washington Street and Water Street. I contemplated using this portion of
street for storage purposes, and it has been put to that use for several years in the post.
I am willing to pay $10.00 par year for the rental on this lease and all costs of ublicat ens c

The City Cleric told the Mayor and City Council that the State Tax Commission had been
auditing the City and they had made a decision the lease between Crown Z and the City of
Port Townsend visa sinter revenue, that Crown Z was paying in the neighborhood of 110,000.
a year and even tough the money was being used to retire bonds it was still considered
revenue and that it should be taxable. The amount taxable since 1959 wac 502,809.50 and th
tax duo the state was 18,101.14 plus interest 2,170.94 making atotal of 20,262.09.

state be rejected by the City Council and that the City Attorney take the necessary action 1
to protect the intorest of tho city of Port Townsend. Motion carried. j
`Mayor Sullivan said that the port eomnision were present and asked them to speak. Lir
Can said that he was at the Co uncil Meeting for only one purpose and that was to ask for
an easement in favor of the Port of Port Townsend permitting them to deposit fill earth age at
and u_on the right of way of state highway number 9 lying between dill Street and Kearney
street in the city of Port Townsend, and to fill to the level of the grade of the state i
highway number 9 all city streets and alleys lying between clay street and 14th street on
the north K:fd of state highway number 9 and on the south side between Hill street and
Kearney street. After the request of the port commission considerable discussion was brou;E_
_forth on wily the port should have to use part of the lagoon for fill. The City Clerk read
four letters all protesting the filling of the lagoon, also a petition that was signed by
341 person was read to the council. Consiserable discussion was brought forth that the port
s ould fill part of the ngoon.
Councilman Carter said that the Council had heard both and all sides of the issue and mac 3
a motion seconded by Councilman Judy that the council have a recess on whether or not to Iw v +
grant the easement.. :motion carried.

Councilman Siebenbaum asked the ?ort Commission if the fill was made would the port
commission take care of all drainage prombleam of the lagoon. Mr. Ward the port commission �r
Engineer oxplained to the council the drainage system that had been planned out by the fill.
Councilman Siebenbanm made a motion seconded by Councilman Carter that an easement be
granted to the port commission to fill in on both sides of the state highway accoring to
their plans and specifications. Upon roll call vote Councilmen Carter, Lindsey, Siabenbaum
Thomas voted Yae, Councilmen Judy, Hoglund voted nae, one absent motion carried.
City Attorney Abraham rind that he had prepared an Ordinance just in case that the � � •
easement be approved by the Council. Councilman Siebenbau. made a motion seconded by CouncJ Iman s
Carter that the Ordinance be read. notion carried.

Yr Arey said that he had talked to 11 Cntroll and he wanted to run a six inch line from
":anresa :fall about a block and a half down Sheridan Ave :,here he had three or four houses.
Cith Attorney Abraham said that if the requested was granted that it should be clearly
understood by all parties that the line will be put in according to specifications set down
by the Sower Supt and the City Env ineor and when the ti;mo comes that someone else wants to
connect on to that lino that thoro will be no misunderstanding about whose line it was.
It was brought out that any time a sewer line was laid on city streets it automatielyy
became city owned.

1 or Sullivan referred the request to the street and sewer committee and the City Engine
for a report at the next regular session.

City Attorney„Abraham explained the ordinance to the Mayor & Council, saying that there
had boon a reprosenative from the tolep:_ono company at his office and they were asking for
an easement through a part of the new seaview addition. At the time that portion of the old
Povaers Fork was vacated to make way for sonviow estate addition which was ord no 1413 the
city reserved the right to grant easements over t.ia tract of land onvolved.

for twenty five dollars on the portion of Kearney- stroct lying between washin,zton street and

Councilman Carter reported on the property along side the fire hall that had boon up for
sale to toe City, he said t.at he had tallied to :s '.tall of Port Angeles, the price was 4,800
and he had told him if he did not hoar from him to forget it and so for he had not let him
know and felt that did not need t!ie property that if coney was Go ng to be spent it could be
spent on the city ?Tall.
