MINUTES OF THE PREVIOUS SESSION The minutes of the previous sessio n were read in full and it was moved by Councilman Rv� 90 "a 41, Mueller, seconded by Councilman Lindsey that the minutes be approved as read and that the oyor and City Clark be authorized to sign same. Upon roll call vote all seven Councilmen present voted in the affirmitive and motion declared carried. �5f REPORT OF OFFICERS i. W POLICE --17e- Police report for the Month of February 1959 was presented and read and was ordered ;41k filed. It was moved by Councilman Siebenbaum seconded by Councilman Lindsey that the building ermits be granted. Upon roll call vote all seven Councilmen present voted in the off Irml tiv nd motion declared carried. TEAR DOWN PERMIT The following tear down permit was presented and noted upon as follows: Art Haugan, Garage, From, 638 Madison. To abide with Ord. 907. Siebenbaum It was moved by Councilman Lindsey seconded by Councilman NtffTTYKK that the tear down pe t a granted. Upon roll call vote all seven Councilmen present voted in the affirmitive and rr motion declared carried. COMMITTEE REPORTS X Councilman Sullivan reported that he and Street Supt. Arey investigated intersections and found several bad ones where trees and abnubbpry were in parking strips and said they should be taken out. Councilman Sullivan said there was an ordinance in effect where the street department had the power to remove trees and etc that concerned the safety of people.'City attorney Abraham said that if trees and shrubbery were on the right of way then it was legal It was by Councilman Siebenbaum by Councilman that moved seconded Sullivan the street Supt. be authorized toqRtii4es and shrubs where ever it concerned the safety of people. _41,- Upon roll call vote all seven councilmen present voted in the affirmitive and motion declare carried. City Attorney Abraham reported that the street lease was prepared and said it should be submitted to the Dolls. 'Is said that he incorporated the provision that they would pay the cost of inseting and publishing the Ordinance. Councilman Swinhoo said that he would delive k the lease to the Dolls. Councilman Siebenbaum as a member of the finance committee spoke to the Mayor oil CON fl a the park spending. n He sold the park was in the red and was still spending money that was] not there. He said that a voucher had been turned in for $40.00 for leveling ground and moving a log, and that could have been done by the street department at no extra cost but no one knew about it until the voucher had been turned in. He said there was no cooperation from the park department and that something had to be done do stop the unnessary spending.L Councilman{ Siebenbau moved that from now on no further expenditures be made from the park fund without first getting permission from the City Council. Seconded by Councilmen Sullivan. 1. Mayor Leighton asked the City Attorney if the City Council could mane the motion. City Alill oi, Attorney Abraham said the City Council could as for as the motion and information being jr M;Itransmitted to the park board is concerned but the park board was not subject to the control of the City Council. He said that the Council had budget control only and that was the Z"A z appropriation of the money and having appropriated the money under the park board setup as recently constituted the council really has no authority to interfere in the management of the park board in any way. He said that he could not advise the council except other than a record of protest and that the motion would probably have no effect. After considerable more discussion Councilman Sullivan called for the question and upon roll call vote all seven councilmen present voted in the affirmitive and motion declared carried. Councilman Swinhoe 'said that he would like to go on record that all that had to be done to determine was who was responsible for the lack of cooperation and unecessery spending then eliminate the source I f the problem.
