Owners or managers of all apartment houses shall provide the tenants thereof with adequate
acitlities and cans for the disposal of all gargnbe, rubbish and ashes, and the charge for s ch
is:osal shall be on the basis of the number of cans per week collected, provided however,
lint nothing in this Ordinance contnined shall give any customer of the Garbngo Department in
he City of Pont Townsend the right to demand any rebate or reduction in rate because a can
r ouns shall not be filled or used during any particular week, it being the intent of this
rdinance that each customer of the Garbage Department shall be charged on a monthly basis
ccording to the number of cans customarily collected and shall pay an additional charge to b
'ixed by the Superinteddent of the Garbage Department, for special loads.
Section 3. This Ordinance shall become effective five days from and nfter its passage,

iCouncilman Swinhoe gave a report for the new itaamokiong committee that was appointed the
previous council meeting he said that two thirds of the committee met with the City Attorney
and after quite a discussion decided and recoranended that the need does exist for a planning
,
committee. One need especially was a zoneing ordinance, and therefore afitthetresult-of`-this
investigatioa•meke's motion that a Ordinance be established to point a planning commision
for the City of Port Townsend, Councilman 'dueller seconded the motion. Upon roll call vote
all seven councilmen present voted in the affirnitive and notion carried.
Councilman Sullivan reported on the General Petroolium Corporation request for a renewal 10
deer lease to run their pipes across the City Streets. lie said that they were paying $35.00
at present and that the committee agreed that the price should be raised to $50.00 per year
'After some discussion it was moved by Councilman Sullivan and seconded by Councilman Lindsey
that the new ten year lease be granted at the new price of $50.00 Der year. Upon roll call
vote all seven councilmen present voted in the affirmitive and motion carried.
Councilmen Lafferty reported on t..e request of the Kiwanis Club for a paper box by Safe-
way store, he said that the Kiwanis Club was supposed to write a letter to the Council that
they had settled thirr differences on the paper box.
,Mayor Leighton announced that their will be a firemen training course XXXY1Y[v9_ starting
October 7, 1958 at 7:30 PM and continuing thereafter the first and 3rd tuesdays of each
month the final one o e May 19th 1959.
Councilman Sullivan1yn the new sewer project that the area to be covered included Cherry, G,
H and
J. St.
and also traverse acreage below cherry street in connecting with the present F. Street
'sewer leading to the San Juan Ave. trunk line. Street Superintendent Arey said that the lip
,should be run on the opposite side of J.st as not to interfer with the water line.
Councilman Sullivan said that Superintendt Arey should supervise and inspect the project and
with thoes changes and suggestions Councilman Sullivan made a motion for the project to
start at once, seconded by Councilman Mueller. Upon roll call vote all seven councilmen
present voted in the affirmitive and motion carried.

Mayor Leighton said that this was now the time for the public hearing on the petition on
vacating a portion of 57th at and instructed the City Clerk to read the application again
on which the City Clerk did as follors.

Mayor Leighton instructed the City Clerk to read a communication on which he complied as
follows.

Port Townsend, Washington.
Dear Madam and Gentlemen:
It is most unfortunate that the City Council of Port Townsend must consider n case of
vacating an opern city street. A goup of people have banded together in an effort to gain

valuable property at the expense of another tax payer and neighbor.
It is my sincere and honest belief that no sane person will sigh a petition asking closure
of his only approach and entrance road to his property unless lie has some sininster idea
of forming another approach opern to his property, which would mean gaining property without
payment. What access would a purchaser of Lots 1 and 2 in Block 40 and Lots 7 & 8 in bloc
41 have, if this 57th Street were vacated. Vacating of 57th Street is the start of an
organized attempt to have all side streets from Kuhn Street leading to my property vacated,

right down to 49th street and therefore, force open this socalled Pettygrove Street, which
does not exist, or lead anywhere. Should this 57th street be vacated, then it will be only
a
matter of time until this some group will petition you, the City Council, for opening of
Pettygrove Street. One must only study the city records, where wou will find the some
"back of scene" group petitioned the City Council to vacate all streets leading into my
property from Kuhn Street for the sole purpose of forcing the city to build Pettygrove
street, which would be almost impossible, due to its tepegrophy and cost.
Mr. Hawley is an employee of the City Street Dept, and Mr. Arey is his superior, it is plai
to see which way the wind blows. Again, I wish to urge the City Council to take immediate
steps to re-establish this 57th Street, but should Irou gentlemen of the City Council grant
the vacating of 57th Street, then it is my wish to petition you at this time , and now, to
grant vacating of Pettygrove Street, if not already done so in the past. Due to this
ticklish situation and pressure loom outside groups, I wish to suggest that the City Counci
vote in secret ballot.

Mayor Leighton asked if their were any objections in the vacating of the above mentionel
street. Mr. Follme produced a map and asked the City Council to look it over. Councilman z

made a motion and seconded by Councilmen Swinhoe to hold a five minute recess. Upon roll
call all seven councilmen present voted in the affirmitive and motion carried.
REGULAR ORDER OF BUSINESS RESUMED
Upon roll call all seven councilmen were present. Mayor Leighton asked the council if *e
had reached a decision. Councilman Sullivan said that Mr. Pollme had at least 12 or 13 way
of entering his own property and as there was only a half a street to be vacated and woul

like to ask Mr Follme why he objected to the vacating. Mr. Follme replied that he did not
need that street at the present time butt was only looking forward to the future.
Councilman Mueller said their were no need for a secret ballot and to bring it to h head
made a motion that the street be vacated and the City Attorney draw up the proper ordinance
Seconded by Councilman Swinhoe. Upon roll call vote all seven councilmen voted in the
affirmitive and motion carried. Mr. Follme upon that requested the vacating of Pettygrove
street and was informed that Pettygrove street did not exist although it was shown on the

older maps.
Mr. Harms spoke to the Council on opening street in Foirlers park where he is building a
new residence. Mayor Leighton referred the request to the sewer and street Committee and
Street Superintendent Arey -
Mr. Kunz addressed the Mayor and City Council and said that he did not believe that the

City should close any street that their has been to many vacations in the past.

As there was no further business to come before the Council at this time, it was moved
by Councilman Sullivan and seconded by Councilman Lindsey that the meeting bdjourn. Upon
roll call vote all seven councilmen present voted in the affirmitive and motion carried.
