It was moved by Councilman Siebenbaum and seconded by Councilman Steve that as the
bids for gasoline non- premium and diesel oil were the lowest an::d'best for the City of
The Union Oil Co, that that bid be accepted. Upon roll call vote all seven Councilmen
present voted in the affirmative, motion carried.

I Gentlemen:
'4 Permission is hereby requested for permission for expanding funds for grouting
the leaks in the East Dam at Lords Lake. The expenditures will be for equipment rental
labor and materials to repair the leaks in the dam so water storage can be brought to its
full capacity. The expenditures will be approximately as follows:
;f Mobilization and demobilization (lump sum ) 10190.00
Labor- 432.65 per day - Approx. 10 days- 4,326.50
Cement- in place- 200 sacks at 3.00 600.00

It was moved by Councilman Siebenbaum and seconded by Councilman Lindsey that the City
Engineer request be granted. Upon roll call vote all seven Councilman present voted in
ithe affirmative, motion carried.
{ The City clerk was authorized by the Council to read five letters to the City Council
and certain individuals as per attached copys. City .Attorney Abraham after considering
the City relation to the problem informed all present that in law, surface water is a
i` common enemy. Each landowner is permitted to combat the surface water, in its encroach-
ment upon his land to the extent'neoessary to protect his property: Generally a City
is granted no authority to trespass bn'landa not owned by the City. In a dispute between
landowners a City can have no interest. It can be neither a partisan or a mediator, for
neither the constitution nor the statutes grants to it such powers.
The remedy, if any is available , does not reside in the exeoutine or legislative
powers. The Council and Mayor are therefore without authority to act on the matter.
After Councilman Ellis suggested to the Council that as long as the city was not
damaged in any way that the problem did not belong to the City and that it should be
e' referred to the individuals concerned.
i; NEW AND UNFINISHED BUSINESS
Councilman Sulliven'informed the Council of a tearing down of a warning sign where
{; San Juan Ave. and 49th St. intersect. After some discussion'as to whether or not hhe sign
I had been torn down and should be replaced. City Street Supt. Arey said he would take dare
of the situation.

Mrs. Lee Davis of the Park Board suggested an ordinance for Zoning on billboards
j and signs, because of.the fact vandalism was defacing or tearing down signs, and
signs and billboards word indiscriminately placed about the City.
ADYOURNMENT
As there was no further business to come before the Council at this time it was moved
by Councilman Mueller and seconded by Councilman Steve that the Meeting adjourn. Motion
carried.

The City Council of the .City of Port''-Uownsendrp Washington,'met in regular sessiop;
this 4th day of February, 1958, at 7:30 P. M. in the Council Chambers of the City Hall,
Hayor George Bangerter presiding.
ROLL CALL
Officers and members present were as follows: Mayor George Bangerter, City Attorney
Abraham, City Clerk Ryan and Councilmen Sullivan, Steve, Mueller, .Ivory, Ellis, Siebenbsum
and Lindsey.
MINUTES OF PREVIOUS SESSION
The minutes of the previous session were read in Ml and it was moved by Councilman
Ellis and seconded by Councilman Sullivan that the minutes be approved as read and that
the Mayor and City Clerk be authorized to sign same. Upon roll call vote all seven Council-
man present voted in the affirmative and motion carried.
APPROVED BITLS AND CLAIMS
Current Expense Fund $3,735:12
Olympic Gravity Water Fund 562.09
Library Fund 464.47
Park Fund 220.55
City Street Fund 929.65
It was moved by Councilman Avery and seconded by Councilman Lindsey that the bills be
approved as read and that the Mayor and City Clerk be authorized to draw warrants upon the
proper funds for payment of same. Upon roll call vote all seven Councilman present voted
in the affirmative anf motion carried.
REPORT OF OFFICERS
City Clerk
The City Clerk reported the regular salaries for the month of January 195E as
follows:

City Treasurer
The City Treasurers report for the month of January 1958 was read and was referred
to the Finance Committee.
BUILDING PERMITS
The following building permits were presented end read:
Michael D. DeLeo, addition to residence 16x24 ft. frame construction, 19th and
Haines Streets. 550.00
Harold W. Peterson , addition to residence 24xlBf!t 9111 frame construction, lath and
Wilson Streets. $1,200.00
LeMoine E. Sievert, Remove Chimney and replace with new 17x24 Brick Construction
716 Lawrence Street. $50.00
It was moved by_Councilman Siebenbsum and seconded by Councilman Steve that the
building permits be granted. Upon roll call vote all seven Councilmen present voted in the
affirmative and motion carried.
REQUEST TO INSTALL HOUSE TRAILER
