MINUTES OF REGULAR SESSION OF APRIL 2, 1957.

The City Council of the City of Port Townsend, Washington, met in regular session
this And day of April, 1957 7:30
at P.M. in the Council Chambers of the City Hall,Mayor
Pro-tem Dennis Sullivan presiding.

Officers and members present were as follows: Mayor Pro-tem Dennis Sullivan,City
Attorney Abraham, City Clerk Ryan and Councilmen, Steve, Ellis, Mueller, Avery,Siebenbsum
and Sullivan.
LSINUTES OF PREVIOUS SESSION
The minutes of the previous session were read in full and it was moved by Councilman
Mueller and seconded by Councilman Siebenbaum that the minutes be approved as read and that
the Mayor and City Clerk be authorized to sign same. Upon roll call vote all six Council-
men present voted in the affirmative and motion carried.
APPROVED BILLS AND CLAI.MS
Approved bills and claims as audited by the Finance Committee for'the month of March
1957, were presented and read. ( See vouchers for month of March-1957).
From the Port Townsend Water {Yorks and System Construction Fund, in accordance with
Ordinance No. 1321.

It was moved by Councilman Avery and Seconded by Councilmen Ellis that the bills be
approved as read and that the Mayor And City Clerk be authorized tp draw warrants upon
the proper funds for payment of -same. 'Upon roll call vote all six Councilmen present voted
in the affirmative and motion carried.
APPLICATION FOR TAXICAB DRIVERS LICENSE
An application for a taxicab drivers license Lloyd K. Saxton was y presented and read.
The City Clerk told the Council that the application had been approved by the Chief of
Police and that the $3.00 Fee had been paid. It was moved by Councilman Mueller and seconded

by Councilman Steve that the permit be granted. Upo:i roll call vote all six Councilmen
present voted in the affirmative and motion carried.

Contract
According to the State of Washington Tax Commission the entire amount
of the above contract is subject to the Washington State Sales Tax of
3 1/3 %. They cite rule 170 (Constructing and repairing of New or
Existing Buildings or other Structures Upon Real Property) of the Rules
Relating to the Revenue Act of the State of Washington which states
that lump sum contracts are taxable for the whole contract price imloss
the clearing of land or moving of earth are separately stated in the
bid prices. These two items are deemed to be separately stated in
unit -price contracts.
Tnerfor, by law vie are required to collect from you the entire amount
of the sales tax of $3785.88 on the contract price of $113,756.50.
Should you so desire you may protest to the State Tax Commission at
Olympia. If their ruling is in your favor they will reimburse us,
and we in turn will reimburse you for any difference in the above
amount of $3785.88.

Gentlemen:
The City owns the El/2, Sec, 28 and NE1/4, Sec 33 T 28 NR 2 W, the land lying
around Lords Lake. A small part of this was salvaged for cedar by Cascade Cedar Co.
two years ago, and proved satisfactory, netting the City around $280.00 at 10,%
stumpage. We would like to salvage the cedar on thereat of this property.
Mr. Seton of Cascade Cedar Co., went over the property with us and said that it
could be arranged to hold the stumpage for the timber at the mill, and that he would
send it to the City, if it would be convenient for the City to have it that way.

It was moved by Councilman Steve and seconded by Councilman Mueller that the request be
denied and that City property be posted. Upon roll call vote all six councilmen present
voted in the affirmative and motion carried.
:Hr9RDINANCES AND RESOLUTIONS
ORDINANCE NO. 1331
Ordinance No. 1331 which was read for the first time at the regular Council Meeting
was read for the second and- time. It was moved by Councilman Mueller and seconded by
Councilman Siebenbaum that the first reading be considered the second reading and that
the third reading be by title only.
THIRD READING AND PASSAGE
Ordinance No. 1331 was read for the third time by title only and it was moved by
Councilman Sieberbaum and seconded by Councilman Avery that the Ordinance do now pass.
Upon rolleall vote all six Councilmen present voted in the affirmative and motion carried.
DEDICATION AND RESOLUTION
DEDICATION
KNUN ALL MEN BY THESE PRESENTS: That the undersigned are the duly elected and acting
representatives of that group of persons residing or owning property in the City of Port
Townsend, Washington who have styled themselved the "19th Street Sewer Districts"
That at a meeting of the said 19th Street Sewer District held in the City Hall,
Port Townsend, Washington, on March 27, 1957, by unanimous vote of the said Sevier District,
the undersigned were authorized and directed to execute and deliver to the City of Port
Townsend the following dedication:
