Minutes of Regular Session, Tuesday, June 18, 1940, continued

A letter from the District Engineer of the Department of Highways, showing this
City's April allotment of Gas Tax Funds to be $761.50, visa read and ordered filed.
From Homer T. Bone
A circular letter from Senator Homer T. Bone, relative to the proposed"Initiative
No. 139; in a similar vein to the one presented and read at the last regular session, and
incorporated in the minutes thereof, was noted received and will be placed on file in the
City Clerk's office.
From Assoc. of Wash. Cities
City Clerk, C. F. Christian, acknowledged the receipt of Information Bulletin No. 2
(Series "B"), the same being a report of action taken at the state-wide meeting of the
Assoc. at Everett, Washington, on May 23rd and 24th, and stated that anyone interested
might review the same at the City Clerk's office.

Dear Mr. Hirtzler:
It is requested that the City of Port Townsend grant an easement or right of way
in perpetuity to the United States of America over certain streets in the City of Port
Townsend for the purpose of laying an ui.nlerground cable. This easement or right of way is
necessary to the Government in the furthering of Military Projects in these harbor Defense .
The Government agrees that upon the completion of the laying of the cable, that all dam-
age sustained to the streets named in the easement or right of way will be repaired and
the streets placed in a condition similar to that which they were in previous to the
granting of the easement.
This easement or right of way to begin at the West boundary of the Military
Reservation of Fort Worden and running West on 47th Street to San Juan Avenue, thence Nort
on San Juan Avenue to 49th Street, thence West on 49th Street to Hendricks Street, thence
North on Hendricks Street to the West Secondary Station Reservation. Thence beginning at
the intersection of Thomas and East Diamond Streets, thence West on East Diamond Street
to Emerald Street, thence North on Emerald Street to Cook Avenue thence Northwest across
Cook Avenue to Calument Street, thence ',test on Calument Street to Perry Avenue, thence
Southwest across Perry Avenue to Davis Street, thence South on Davis Street to West
Diamond Street, thence West on West Diamond Street to Elmira Str:+et, thence North on
Elmira Street to the Tibals Hill Military Reservation.
It is requested that the granting of this easement or right of way be made as
expeditiously as possible.

Cunningham Request Granted
It was moved by Councilman Lfaroldo, and seconded by Councilman Richards, that the
request of Colonel Cunningham for permission to lay Government cables upon streets as
stated in the foregoing letter, be granted, with the stipulation that the city request
that the cable be laid along, the edge of such streets as may at present have bituminous
surfacing. Motion carried.
REQUISITIONS
A requisition by the City Treasurer for pencils and receipt books in triplicate, was
presented and read and upon motion of Councilman Lammers, seconded by Councilman Maroldo,
the members present voted to grant this requisition.
ORDINANCIS AND RESOLUTIONS
Cotton Franchise Ordinance
The proposed ordinance granting a franchise to the Olympic Pilo Driving Company, as
presented and read for the first reading at the last regular session, and incorporated in
full in
the minutes thereof, was presented and read in full at this time for the second
reading, whereupon it was moved by Councilman Lammers and seconded by Councilman Richards,
that the third reading be by title only. Upon roll call all.four Councilmen present voted
in the affirmative, and the motion was declared carried.
Third Reading and Passage
The proposed ordinance was Lhen read by title only for the third reading, and it was
moved by Councilman Robt. Brown, and seconded by Councilman Lammers, that the said ord-
inance do now pass. Upon roll call vote all four Councilmen present voted in the affirm-
ative and the motion was declared carried.

UNFINISHED AND NYX BUSINESS
The District State Fire Warden being present in the Council rooms and having expresso
a desire to address the Council, was called upon at this time to bring the matter in which
he was interested before the members present. He thereupon proceeded to advise the Counci
of the hazardous condition with relation to fire now existing at the City garbage dump,
and stated that unless the present situation was remedied, it would be necessary to ask
that the City provide additional help to eliminate fires in this vicinity.
The Mayor having already taken steps to correct the existing hazard within a few days,
the warden visa so advised and assured that the City would, at all times, attempt to pre-
vent fire hazards at this point.
Recess
It was moved by Councilman Robt. 1�. Brown, and seconded by Councilman Lammers, and
passed by voice vote of the members present, that the Council recess for a short period.
(8:00 P.M.).
Reconvened
The City Council of the City of Port Townsend reconvened in regular session at 8:45
o'clock, P.M., with the following Officers and Members present: Mayor H. L. Hirtzler;
City Attorney, 111. J. Daly; City Clerk, C. F. Christian, and Councilmen C. E. Richards,
Robt. W. Brown, 17m. Lammers, Sr., and J. F. Maroldo.
Re: Health Program
It was moved by Councilman Robt. Brown, seconded by Councilman Maroldo, that the City
Clerk be instructed to inform the Jefferson County Commissioners that in accordance with
the request presented by C. 19. Miller of the Jefferson County Welfare Department, this city
would make avaliable the sum of $100.00, as its share for the ensuing half year toward a
combined City and County Health Program, as proposed by the Federal and State Social
Security Departments. This being contingent upon final approval and acceptance of the
plan by the Jefferson County Commissioners. Motion carried.
Re: Census Increase
Mr. R. F. McCurdy, being present as a representative of the Port Townsend Chamber of
Commerce, stated that the Chamber, acting to make possible the inclusion of the population
of Fort Worden, as a part of the census count of this City, had been reasonably assured
that if the City Council of the City of Port Townsend, Washington, would go on record as
stating that the Fort Worden area was orginally part of the platted area of this City, it
would be accepted as evidence that the population of the said Fort 17orden, should ba
included in the census of the City.
It was moved by Councilman Maroldo, seconded by Councilman Robt. Brown, that the Mayor
and City Clerk be authorized to prepare and certify to the Director of Census, under the
seal of the said City, such documentary evidence and otherwise, as they deem pertinent to
secure a reversal of the ruling of the Director of Census, wherein the population of Fort
Worden, Military Reservation was not included in the official count of the City of Port
Townsend for the 1940 census. Upon Roll Call vote, all four Councilmen voted in the
affirmative, and the motion was declared carried.
Re: Willow Street Sevier
City Attorney Daly took this opportunity to inform Mr. Lawrence Minish, who was presen
that plans and cost estimates of the proposed Willow Street sewer, in which matter Mr.
Minish was interested, were now available and that interested parties could arrange a meet-
ing with Mr. H. J. Young, who had prepared this information in order that they might secure
full detailed information on the proposed work.
Re: Fire Zone Change
Mayor Hirtzler stated that the matter of the change in the boundaries of the Second
Fire Zone of this City, would be referred from this time to the Building Committee, rather
than the Fire Committee, to whom it visa previously referred, and requested that they make a
report at the next regular meeting.
ORDINANCES AND RESOLUTIONS
Mayor Hirtzler at this time stated that the order of business would revert back to
the order of Ordinances and Resolutions, whereupon a proposed ordinance relative to
establishing a grade for a certain portion of•McKinley Street, was presented and read in
full for the first reading as follows:

THE CITY COUNCIL OF THE CITY OF PORT TO'XNSEND DO ORDAIN AS FOLLOWS:
Section 1. That the grade of the center line of McKinley Street in the City of Port
Townsend shall be four per cent for a distance of sixty (60) feet from the west line of
Jackson Street at the intersection of Jackson and McKinley Streets; thence in a convenient
grade from the established point to the east line of Monroe Street at the intersection of
McKinley and Monroe Streets.
