BUILDIIIG PERMITS Requests for permission to build were presented and read as follows: From 17m. Higley, to -wit: Port Townsend, Washington Honorable Mayor and City Council June 4, 1940 Port Townsend, Washington Gentlemen: Permission is requested to tear down and rebuild the garage at my residence located 439 Fillmore Street. COlai lUNICATIONS Washington News Letter The City Clerk acknowledged receipt of a Washington News Letter, a service of the Association of Washington Cities, and stated that same would be on f ile in the City Clerk's office for anyone interested. From Isomer T. Bone A circular letter addressed to the City Council from Congressman Homer T. Bone, relative to "Initiative No. 13911, visa read and ordered filed. ORDINANCES AND RESOLUTIONS Cotton Franchise Ordinance A proposed ordinance to grant a franchise to the Olympic Pile Driving Company, was presented and read in full before the Council at this time for the first reading, as follows: ORDINANCE N0. ,1-5 Ali ORDINANCE authorizing the Olympic Pile Driving Company, a corporation, its successors and assigns, to construct and maintain wharves, building docks, marine ways and gridiron on Madison Street commencing on the South side of Water Street, between Blocks 5 and 6 of the Original Townsite of Port Townsend, State of Washington; and thence extending in a Southerly direction, including all that portion of Madison Street between Blocks 5 and 6 and extending to the inner harbor line or deep water; and that portion of Front Street, South of Lot 7, Block 5. All aforesaid lots and blocks of the Original Townsite of the City of Port 'Townsend, Washington, according to the duly recorded plat thereof on file in the office of the County Auditor, Jefferson County, State of Washingt THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DO ORDAIN AS FOLLOWS: Section 1. That there is hereby granted to the Olympic Pile Driving Company, a corporation, and its successors and assigns, for a period of ten years, the right, privilege and authority to construct, operate and maintain wharves, building docks, marine ways and gridirons on Madison Street commencing on the South side of Water Street between blocks 5 and 6 of the Original Townsite of Port Townsend, State of Washington; and thence extending in a southerly direction, including all that portion of Madison Street between blocks 5 and 6 and extending to the inner harbor line or deep water; and that portion of Front Street, South of Lot 7, Block 5, All aforesaid lots and blocks of the original Townsite of the City of Port Townsend, Washington, according to the duly recorded plat thereof on file in the office of the County Auditor, Jefferson County, State of Washington. Section 2. That by an acceptance of this Ordinance the said grantee thereby agrees upon the request of the City Council of Port Townsend, Washington, to conform said wharves, docks or other structures to the grade of said streets now established or to be hereafter established, and to allow free wharfage over any wharf constructed under this franchise to the said City of Port Townsend. That all the rights granted under this franchise shall be subject to any existing' rights under any other franchise or franchises previously granted affecting said streets and the city especially reserves the right at any time hereafter to grant a franchise over, across and along said streets to any person', company or corporation, for the construction and operation of a railroad thereon and that all rifts granted in this franchise shall be subject to this reservation. The grantee further agrees to leave the street open and accessible to the abutting property at all times when requested to so do by the City of Port Townsend. Section 3. This Ordinance shall be accepted by the grantee within thirty days after its passage and if not so accepted shall be void. Section 4. This ordinance shall be published once in the Port Townsend Leader and take effect and give force from and after five days from publication. Section 5. That for the rights herein granted the said Olympic Pile Driving Company and its assigns, shall pay to the City of Port Townsend, Washington, the sum of Fifteen Dollars ($15.00) per annum during the term of the said franchise, payable annually in advance; that in case the said grantee or its assigns shall fail to comply with any or all conditions of this Ordinance, then and therefore this Ordinance shall become null and void and all rights and franchises herein granted shall become null and void.
