Minutes of Regular Session, March 5, 1940, continued,
The Veterans of Foreign Wars have been trying to make the bicycle riders conscious of
Safety and Traffic rules through means of the Bicycle Safety Clubs organized by and for
school children in Port Townsend, and therefor Key City Post #1495 Veterans of Foreign Wars
voted at a regular meeting to extend to the Mayor, City Council, City Attorney, and City
Police, sincere thanks for their splendid efforts and co-operation in their action to
safeguard the lives of the bicycle riders in Port 'Townsend.

and Members of the City Council
Gentlemen:
The members of the local branch of the Washington Old Age Pension Union respectfully re-
quest the use of a room in the City Hall for their meetings, twice monthly.' This is a
non profit organization, with but a five cent per month dues for stationery, etc., formed
for the purpose of helping the eligible secure the state pension, so you see the question
of rental for a meeting place is a serious one. We feel the work we have done in the past
has been helpful to the older people in the county, and is worthy of support. We will
appreciate what cooperation and consideration is given this request.

Washington News Letter
Receipt wns acknowledged by the City Clerk of a Washington News Letter of the American
Municipal Association, and Councilmen assured that same would be on file for any who might
wish to read it.
REQUISITIONS
A requisition from the City Treasurer's office was presented and read as follows:

It was moved by Councilman Robt. Brown, seconded -by Councilman Sullivan, that the
foregoing requisition be granted. Motion carried.
ORDINANCES AND RESOLUTIONS
A proposed emergency ordinance to provide funds for improvements and additions to, thee,
Olympic Gravity Water System, entitled, '"AN ORDINANCE of the - City of Port Townsend providin
for the making of certain extensions to, and replacements of, the existing municipal water
works system of said city, and providing for the payment thereof by the issuance of
emergency warrants upon the Olympic Gravity Water Fund of said City," which was read in
full for the first reading at the last regular session of the Council, and incorporated in
the minutes thereof, was read in full at this time for the second reading.
It was moved by Councilman Lammers, seconded by Councilman Richards, that the third
reading be by title only. Upon roll call vote, all six Councilmen presented voted in
the affirmative, and the motion was declared carried.
Third Reading and Passage
The ordinance was then read by title only for the third reading, whereupon it was
moved by Councilman Robt. Brown, seconded by Councilman Lammers, that the said ordinance
do now pass. Upon roll call vote, all six Councilmen present voted in the affirmative,
and the motion was declared carried.
Truck License Refund Ordinance
In conformation with a resolution adopted by the City Council at regular meeting on
the 5th day of September, 1939, an ordinance relative to licensing of commercial vehicles,
was presented and read at this time in full for the first reading as follows:
ORDINANCE
AN ORDINANCE repealing the licensing of commercial trucks within the City of Port Townsend,
and authorizing refund of payments by licensees to the City during the year
1939.
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DO ORDAIN AS FOLLOWS:
Section 1. That that portion of Ordinance No. 1036, entitled, "AN ORDINANCE relating
to and providing for the licensing of certain motor and other vehicles; defining offenses;
providing regulations for the same; providing penalties; providing for the suspension and
revocation of ordinances and repealing Ordinance No. 879," passed by the City Council
December 5, 1933, approved by the Mayor December 8, 1933, affecting the licensing of
commercial trucks within said city, be and the same is hereby repealed.
Section 2. That the City Clerk of the City of Port Townsend, is hereby authorized to
draw warrants upon the Current Expense Fund not exceeding the amount heretofore budgeted
for the purpose of refunding license fees to those persons who paid commercial truck
vehicle license to the City of Port Townsend during the year 1939.

force and take effect as provided by law.

It visa moved,by Councilman Robt. Brown, seconded by Councilman Lammers, that the first
reading be considered the second reading, and that the third reading be by title only. Upon
roll call vote, all six Councilmen present voted in the affirmative, and the motion visa
declared carried.
Third Reading and Passage
The proposed ordinance was then read by title only for the third reading, whereupon
it visa moved by Councilman Robt. Brown, seconded by Councilman Sullivan, that the ordinance
do now pass. Upon roll call vote all six Councilmen present voted in the affirmative,
and the motion was declared carried.
UNFINISHED AND NEW BUSINESS
Re: Vacation of Alley
Councilman Robt. Brown reporting for the Street Committee, upon the request of Mr. W.A.
Myers, for vacation of an alley, as read at the last regular meeting and referred to the
Street Committee, stated that inasmuch as the said alley was uuunded entirely by property
owned by Mr. Myers, and did not 1n any way connect platted streets, the Committeewished to
report in favor of such action. It was thereupon moved by Councilman Lammers, and seconded
by Councilman Phillip Brown, that notice of the proposed vacation be posted in accordance
with the law, and that a horsing thereon be set for the evening of April 16th, 1940, the
same being the regular meeting night of the City Council. Motion carried.
Recess
It was moved by Councilman Robt. Brown, seconded by Councilman Lewis, that the Council
recess at this time (8:10 P.M.) for a short period. Motion carried.
Reconvened
The council reconvened in session at 9:10 o1clock, P:M., with the following officers
and members present: Mayor H. L. Hirtzler, City Attorney, W. J. Daly, City Clerk, C. F.
Christian, and Councilmen C. E. Richards, Robt. W. Brown, Wm. Lammers, Sr., Donnie Sullivan,
Fred G. Lewis, and Phillip E. Drown. .
Re: Building Ordinance
It was moved by Councilman Lewis that the present Building Ordinance be changed if
found feasible, in order to enable the erection of certain types of buildings not allowed
by the present Building Ordiance within the first and second fire zones. There being no
second to this motion forthcoming, the matter was referred to a special committee consisting
of the Building Committee, Fire Committee, and Fire Chief, for full investigation as to the
possibility of such action.
Re: Leyda Street Lease
Councilman Robt. Brown reporting for the Street Committee, upon the application of Mr.
Ralph Leyda for lease of that portion of the Monroe Street lying between Water Street and
Port Townsend Bay, stated that inasmuch as Mr. Leyda had made arrangements to lease the
property fronting on each side of said portion of Monroe Street, the Committee was in favor
of granting such a lease, and moved -that a lease on said portion of Monroe Street be granted
Mr. Leyda. This motion was seconded by Councilman Sullivan, and carried by voice vote of
the Council.
Re: Winchester Street Lease
Councilman Robt. Brown reporting upon the referred request of Mr. M. D. Winchester, for
a lease of certain streets, stated that because of oral protests received, he wished to ask
that the Committee be given further time to investigate, which was granted.
Re: Willow Street Sewer
The matter of the Willow Street sewer, as requested by various residents of that die
trict, Councilman Robt. Brown, stated that full data was not as yet available, but that the
Committee would have a full report at the next regular meeting.
Re: O'Meara Communication
In an informal discussion of the request of Mr. Charles O'Meara, for elimination of the
parking limit signs on that portion of Adams Street South of Water Street, it was the con-
sensus of opinion of those present that with proper cooperation between Mr. OtMeara, and the
Police Department, no action would be necessary by the Council.
The Building Committee had no report to make relative to the replacing or rebuilding of
the front entrance to the City Hall Building.
