foregoing permit be granted. Motion carried.
COMMUNICATIONS
From Department of Highways
A letter from the Department of Highways showing this Cityls November allotment of
gasoline tax funds in the amount of $703.04, was read and ordered filed.

It has been reported that you have been considering a new set-up for a city-wide
W P A paving project.
The Port Townsend Uhamber of Commerce at a recent meeting expressed itself as
heartily approving such a step and commend your action in seriously considering this
project.
Trusting that such a plan can be put into active operation and assuring you of

Dear Mr. Mayor:
The Commanding Officer wishes to express his appreciation of your efforts to
secure better lighting at the intersection of highways at the entrance to the Port Townsend
Training Station. It has long been felt that this intersection was an extremely dangerous
one when unlighted due to the grades on each side of the road leading to the training
station, and the light now installed remedies this situation. He also wishes to express
appreciation for the work done in repairing the road to the main entrance of the training
i station.
If at any time the training station can be of any material assistance to the city,
it is hoped you will not hesitate to call on us.

A copy of a letter directed to Mr. Fred Lammers, City Garbage Contractor, by the
City Attorney, Mr. W. J. Daly, was presented and read as follows:
January 13, 1940.

Dear Yr. Lammers:
Mr. Alexander of the State Department of Public Service, has called my attention to a rec-
ent decision of the Supreme Court of the'State of Washington - the case of "State of Wash-
ington vs Diamond Tank Transport Company," reported in Volume 102, Washington Decisions, at
page 10.
The case determines that garbage haulers are contract carriers as defined by the law, and
it will be necessary therefore, that you enroll under Department of Public Service regula-
tions and pay such fees as are required.
Mr. Alexander said he will be back in Port 'Townsend again very shortly, but in the mean-
time you should contact the local sheriff's office, who will make arrangements for a
meeting.

It was moved by Councilman Robt. Brown, seconded by Councilman Lammers, that the
foregoing requisition be granted. Motion carried.
UNFINISHED AND NEW BUSINESS
Gasoline Bids"
This being the date and time set for the opening of sealed bide to furnish the City
of Port Townsend with gasoline for the various Departments for the ensuing year, bide were
opened and read as follows:

Contract Awarded
It was moved by Councilman Robt. Brown and seconded by Councilman Marolde, that inasmuc
as the Shell Oil Company and the Associated Oil Company had tendered identical bids at the
lowest price, the contract for gasoline for the current year be divided equally between the
two said companies.
Upon Roll Call vote, all five Councilmen present voted in the affirmative and the motio
was declared carried.
It was moved by Councilman Maroldo and seconded by Councilman Robt. Brown, that the
two successful bidders deliver alternately, for periods of two months each. Motion carried.
Recess
At this time (8:40 o1clock, P.M), it was moved by Councilman nobt: Brown, seconded by
Councilman Sullivan, that the Council recess for a short period. Motion carried.
council Re -adjourned
The Council re -adjourned in session at 8:50 o+clock, P.M., with the following Officers
and Members prescat: Mayor H. L. Hirtzler, City Attorney W. J. Daly City Clerk, C.F.
Christian, and the Councilmen Dennis Sullivan, J. F. Maroldo, C. E. Richards, Robt. W. Brown
and Wm. Lammers, Sr.
Verbal Resolution Offered
Councilman hobt. Brown asked that City Attorney Daly present a resolution verbally at
this time relative to certain streets and parts of streets would be bettered by application
of the light bituminus surfacing, the same to be drawn up in written form by the City
Attorney to conform to necessary legal standards.
City Attorney Daly responded as requested, naming said streets s d parts of streets as
a part of said oral resolution; whereupon it was moved by Councilman tobt. Brown, and
seconded by Councilman Lammers, that the said resolution be adopted.
Upon Roll Call vote, all five Councilmen present voted in the affirmative, and the
motion was declared carried.
A full, true and correct copy of said resolution in its written form is hereto appended
ADJOURNMENT
No further business appearing at this time for consideration by the Council, it was
moved by Councilman hobt. Bros, seconded by Councilman idaroldo, that the Co it do now
adjourn. Motion carried.
