The following is a full, true and correct copy of the said order as passed by the City Council, approved by the Mayor and attested by the City Clerk, to -wit: In the Matterof the re -location ) of the City Garbage Dump ) O.R D E R. WHEREAS, under the provisions of Ordinance No. 772, of the City of Port Townsend entitl "An ordinance providing for the disposal of rubbish, garbage, and other refuse matter, and providing a penalty for the violation thereof," passed by the City Council March 15, 1910, and approved by the Mayor March 16, *1910, the City Council of the City of Port Townsend is empowered, from time to time, to designate by order the place for the disposal or deposit of rubbish, garbage and other refuse matter, now, therefore, EFFECTIVE July 20th, 1938, those certain promises described as "the beach at the north end of Oakland Street in the City of Port Townsend, Washington, being a place on the beach near Smith's Ranch," be and the same is hereby abolished as the city garbage dump, and the following described premises, to -wit: "The bluff or beach at the end of the county road in Lot 1, Section 1, Township 27 North, Range 2 West, 17.M., Jefferson County, Washington," be and the same is hereby fixed, designated and established as the place for the deposit of rub.l bish, garbage and other refuse matter collected within the City of Port Townsend, and from and after said 20th day of July, 1938, it shall bb unlawful for any person to deposit rubbisl garbage or other refuse matter in any place whatsoever within the City of Port Townsend. IT IS FURTHER ORDERLD that the penalties provided for the violation of said Ordinance No. 772, shall apply to this order with like force and effect. Passed by the City Council August 4, 1938. H. L. Hirtzler, Mayor Attest: C. F. Christian, City Clerk. Shell Oil Company Frahchise Ordinance. A franchise ordinance was submitted by the Shell Oil Company, which ordinance was entitled "An ordinance granting to the Shell Oil Company, a California corporation, and its assigns, the right to construct, maintain, operate and remove pipe linos across a street in the City of Port Townsend, Washington, and granting to said Shell Oil Company, a California corporation, and its assigns, the right to operate, maintain and remove a wharf in said City of Port Townsend," and the said ordinance was read in full by the City Clerk for the first reading. In accordance with State statutes, the said Ordinance was then laid over to the next regular session of the council. Special Tax Levy Election Ordinance. An ordinance providing for a special tax levy election, which ordinance is entitle "An Ordinance of the City of Port Townsend providing for and fixing the time of a special el tion for the qualified voters of the City of Port Townsend to ratify or reject propositions granting to the City Council of said city authority to levy taxes on the taxable property of said city in excess of the fifteen mills now authorized by law," was submitted and read in full for the first reading. There being no motion to further consider the ordinance at thi session, the same goes over to the next regular session of the council. Adjournment. ThhPo being no further business before the council, it visa moved by Councillman Naughton and seconded by Councilman Lafferty that the Council now adjourn. Motion declared carried. Mayor — — s M k �k Cr f 427 MINUTES OF REGULAR SESSION OF CITY PORT TOWNSEND, WASHINGTON, AUGUST 16, 1938. Tha CITY COUNCIL of the City of Port Townsend, Washington, met in regular session this 16th day of August, 1938, at 8:00 o'clock p.m., in the Council Chambers of the City Hall, Mayor H. L. Hirtzler presiding. Upon Roll Call, there were present Mayor If. L. Hirtzler, City Attorney V1. J. Daly, City Clark C. F. Christian, and Councilmen 71. S. Lafferty, Paul H. Sather, Fred G. Lewis, R. E. Ammeter and Robert IV. Brown; Councilman Peter Naughton arrived during reading of the minutes of the previous session and thereafter took part in the proceedings of the Council. MINUTES APPROVED. The minutes of the regular session of August 2nd, 1938, (adjourned to August 4th) were read and approved as read,. REPORTS OF OFFICERS. Plater Supt. The 4 eport of the Plater Superintendent for the month of July, 1938, was read and referred to the.11ater Committee. Main Line meters. The report of the Plater Superintendent showing the flow of water through the main line meters for the period ending August 15th, wan presented, read, and ordered filed. REPORTS OF STANDING COLMITTEES. Fire and Light on Hose Requisition. It was moved by Councilman Lewis and seconded by Councilman Lafferty that the city clerk be instructed to contact firms dealing in fire hose and obtain quotations oii the hose requisitioned by the Fire Department. Motion declared carried. Hydrant Removal and 'later Tank Petition. Councilman Naughton, chairman of the Water Committee, to whom was referred the ap- plication for permit to move a hydrant and the petition that the city purchase a certain wa- ter tank, reported progress. Damage Claim. No report was rendered on the damage claim of 1.1. W. Porter. BUILDING PERMIT. From Dr. F. I. Johnston. Application from Dr. F. I. Johnston, for a building permit, was presented and read, as follows: Port Townsend, Washington, August 16, 1938 Petition to the City Council, Sirs: - Please grant me a permit to make some alterations to the lower floor of my residenC3, as follows: change position of plumbing, installation of cabinets, and general repairs, wit lowering of cedlings and etc. Amount to be expended about $150.00. Thanking you for your kind consideration, Very truly yours, Dr. Frank I. Johnston It was moved by Councilman Brown and seconded by Councilman Lafferty that the said per- mit be granted. Motion declared carried. COMMUNICATIONS. From Fred V. Berger. A communication from Fred V. Berger, relative to seepage of water near his prop- erty, was presented and mad, as follows: Port Townsend, Washington, August 8, 1938. The Honorable Wayor and City Council, Port Townsend, Washington. Gentlemen: - Your attention is invited to the fact there is a seepage of water on the face . of my property overhanging Washington Street. I personally called on the Mayor last week and called his attention to the matter, advising him that this condition was in no way due to any action on negligence on my part. After the slide which occurred on June llth, and for which my sprinkling was erroneously blamed, I had a new sower pipe and a new water line put in and the entire plumbing system thoroughly inspected. There are no leaks of any kin on my property and no water has been allowed to run. The f act remains that water is still coming out on the face of the bluff, from whore I do not know. There is the possibility that there will be further slippage which, under tae circumstances, I am unable to prevent and for which I assume no responsibility. it 'is requested that the source of this water be determined by competent authority and such steps as may be necessary to atop the menace be taken. I have had a number of compe- tent witnesses inspect the situation as far as my property is concerned and the fault is not here. Practically two thirds of my lawn is dried up for lack of water as I have not deemed it wise to wet it down. Your co-operation with a view to alleviating this situation is desired.
