The City Council of the City of Port Townsend, Washington, met in regular session this 21st day of June, 1938, at 8:00 o'clock p.m., in the Council Chambers of the City Hall, Mayor H. L. Hirtzler presiding. ROLL CALL. Upon Roll Call there were, present Mayor H. L. Hirtzler, City Attorney W.J.Daly, City Clark C. F. Christian, and Councilmen Peter Naughton, Y!. S. Lafferty, Fred G. Lewis and R. E. Ammeter. MINUTES APPROVED. It was moved by Councilman Naughton and seconded by Councilman Ammeter that the minutes of the regular session of June 7, 1938, be approved as written. Motion declared carried. REPORTS OF OFFICERS. Water Superintendent. The report of the Water Superintendent, covering operations for the month og May, 1938, was presented, read, and referred to the Water Committee. City Treasurer. The report of the City Treasurer for the month of May, 193B, visa presented, read, and referred to the Finance Committee. Main Line Meters. The report of the Water Superintendent, shoring the flow of water through the main line meters for the period ending June 21, 1938, was presented, read and ordered filed Non -Cooperation from Treasurer. Water Superintendent Lockhart reported that delinquency in water accounts was increasing and tbb the Department could not obtain cooperation of the Treasurer in the mat- ter of collections, which made it extremely difficult to enforce the terms and provisions of the city water ordinance. A general discussion followed but no specific action was taken at this time. BUILDING PERMIT. David M. Horne Application from David L]. Horne, for Building Permit, was presented and read, as follows: Port Townsend, Washington, June, 15, 1938. To the Honorable Mayor and City Council, Port Townsend, Washington. Gentlemen:- Permission is requested to build s small addition to the, dwelling hopes Hoar the Rendezvous Lunch, situate on Block 17, Original Townsite, City of Port Townsend, at an estimated cost of 3100.00. Respectfully submitted, David M. Horne. It was moved by Councilman Naughton and seconded by Councilman Ammeter that the said permit be granted. Motion declared carried. C Ou1MUN ICATIONS . From Fred V. Berger, Re: Water and Sewer Service. Communication from Fred V. Berger, was presented and read, as follows: Port Townsend, Washington, June 21, 1938. Honorable Mayor and City Council of Port Townsend. Gentlemen: As you have been advised the water supply and sewer connections to my residence at 314 Polk Street by no fault of mina since the llth day of this month. I am naturally vitally concerned and extremely eager:that replacements of these facilities be made at once and am requesting your Honorable body to restore my water supply and sewer connections wit] in the next week. Fred V. Barger. City Denies Liability. Upon request for an opinion, City Attorney Daly stated, In of feet, that unless the sliding was duet -and caused by water from a leak in the main or mains of the city water system, the city had no liability in the matter. He suggested that the claimant be informed that the city denies liability for any damage caused by the slide as it appears that it was caused by atturation of the earth due to excessive sprink- ling of lawns and gardens and through no fault of the city. Clerk to notify Berger. It was moved by Councilman Naughton and seconded by Council- man Lafferty that the City Clerk be instructed to so notify Mr. Berger. Councilman Naughton brought up the matter of a flour of water in the street near the Schlager properties, apparently being the drainage from septic tanks in that vicinity and since the City Health Officer had previously given his approval b6 the operation.^.of,the i septic tanks, no action was considered by the Coupcil at this time. Highway Maintenance Allowance. The City Clerk reported receipt, from the Department of Highways, of the follow- ing notice, to -wit: Olympia, Washington, June 13, 193B. To All City Clerks and City Treasurers: Gentlemen: In accordance with Chapter 20B, Laws of 1937, the City of Port Townsend has been credited with the amount of $810.00 for the maintenance of Primary State Highway No. 9 through said city, based on 3.24 miles at the rate of $250.00 per mile, for the period from April 1, 1938 to March 31, 1939. Receipt of a News Bulletin from the American Municipal Association, a service of Association of Washington Cities, was also reported. i Institute of Government. Bulletin announcing that Third Annual Institute of Government, sponsored by The Bureau of Governmental Research, in Co-operation with the Extension Service of the Universi ty of Washington would be held at the University of Washington on July 11-12-13-14-15, 1938 was submitted by the Clerk, who suggested that the Chief of Police be given leave of absenc to enable him to attend the school for police officers. Chief of Police given Three Days Leave. It was then moved by Councilman Naughton and seconded by Councilman Lafferty that the Chief of Police be granted three days leave of absence, it being understood that he would bear the expense of such attendance. Motion declared carried. New Garbage Dump Location. Upon verbal notification by County Commissioner S. Lockhart, that a dumping grown for garbage and rubbish had been established on the bluff at the beach near Middle or Rocky Point and that a good road had been built to the said 3ocation, it was moved by Councilman Ammeter and seconded by Councilman Naughton that the City Clerk be directed to notify the official garbage collector of the city that refuse and garbage should be, hauled to this new dump and to discontinue discharge of such matter at the old dumping grounds. Motion de- clared carried. $10.00 appropriated for renovation of old Dump. It was moved bg:+Couhcilman::Lafferty"and-seconded by Councilman Naughton that the x city authorize the expenditure of $10.00 looking toward the destruction of rats infesting the old garbage dump location, and cleaning up purposes. Motion declared carried. UNFINISHED AND NEW BUSINESS. w �.. Shell Oil Company Application for Street Lease or Franchise. '] Communication from the Shell Oil Company, relative to street lease or franchise, was presented and read, as follows: Seattle, Washington, June 16, 1938. City of Port Townsend, Port Townsend, Washington. Gentlemen: We are the owners :]n fee of real property described as: "Southwesterly half of tide land district No. 94 of the tidelands of the first class in front of the City of Port Townsend in Jefferson County, Washington, being otherwise known and de- scribed as lots 5, 6, 7 and 8, block 19, L. B. Hastings First Addition to Port Townsend (or southwesterly half of said block 19)." acquired by us in 1929. On this property we now have our distributing plant and storage facilities. 1� Fronting on this property are tide lands which we have leased from the State of Washington amd on which are located dock and pipeline facilities. This leased property is described as follows: "All that harbor area leased under application lying in front of the northeasterly half of Scott Street and the southwesterly half of Tide Land District; No. 94. City of Port Townsend, ( said harbor area being bounded by the inner and outer harbor lines and the center line of Scott Street extended and a theoretical line running in a northwesterly direction and squall r dividing Tide Land District No. 94, both extended across the harbor area to the outer harbor } line excepting, however, such p g, portion as is included in Front Street:" Located between the real property owned by us and that leased by us is Front Street, over G
