HomeMy WebLinkAbout00484 Minutes of regular session of May 4 37 continuedi 302 Minutes of regular session of May 4 37 continued THEREFORE, BE IT RESOLVED, by the City Council of the City of Port Townsend, that sai building and structure heretofore described be, and the same is hereby deoredd-to be a pub- lic nuisance and pursuant to the provisions of Ordinance No. 907, the City Clerk of the City of Port Townsend be, and he is hereby authorized to give such notice as required by Section 4 of said ordinance as he deems reasonable in the premises. It was moved by Councilman Naughton and seconded by Councilman Lewis that the said resolution be adopted. Upon roll call vote, all foikr councilmen present voted in the af- firmative and motion was declared carried. The resolution was then signed and attested i by the Mayor and City Cleric respectively. UNFINISHED AND NEW BUSINESS. Leaking Main. Councilman Ammeter reported a leak in the water main in the National City Addition, and the matter was referred to the Water Department. Application to Lease Street. Written application to lease certain parts of streets was presented and read, as follows: Port Townsend, Washington, Iday 4, 1937 j To the Honorable Mayor and City Council, i Port Townsend, Washington. Gentlemen: - Application is hereby made to lease from the City, the following parts of Streets; to -wit: That part of Foster Street from the easterly side of Clallam Street,easterly to the bluff. That part of Clallam Street from the northerly side of Foster Street, northerly to the bluff. Respectfully submitted, Horace E. Gleason. The application was referred to the Street Committee for investigation and report. Agreement of Indemnity. In the matter of installation of traffic signal, using the Delmonico Hotel build- ing as one anchor for the supporting cable, the following Agreement of Indemnity was pre- sented and read, to -wit: AGREE:ZNT OF INDEMNITY. WHEREAS, the City of Port Townsend has installed at the corner of Water and Taylor CI streets in said city, a traffic signal, and, WHEREAS, to complete this installation it became necessary that eye bolts be driven into the wall of the Delmonico Hotel Building for the purpose of securing a cable from whic to hang the traffic signal, qnd, WHEREAS, the City Council is desirous of indemnifying the fee owners of said Delmdnico Hotel Building for any damage that might be sustained to the building by reason of said in- stallation, NOW, THEREFORE, pursuant to a motion of the City Council, duly passed at a regu lar session of said council, the City of Port Townsend does hereby agree to save harmless the owners of said Delmonico Hotel property from any damage that might be sustained to the building by reason of the foregoing described installation. It was moved by Councilman Naughton and seconded by Councilman Lewis that the Mayor and the City Clerk be authorized and directed to sign and execute the said Agreement of Indemnity. Upon roll call vote, all four councilmen present voted in the affirmative and motion visa declared carried. Fort Worden Water Contract. A new contract to furnish Fort Worden with fresh water, drawn in accordance with terms agreed upon by the interested authorities, visa presented and read, and it was then moved by Councilman Brown andseconded by Councilman A:mneter that the ldayor and City Clerk be authorized and directed to sign and execute the same on behalf of the City. Upon roll call vote, all four councilmen present voted in the affirmative and motion was declared carried. i Naval Water Supply. S'Tandard form of bid and contract to supply U.S. Naval vessels with fresh water was presented and read, and it was moved by Councilman Naughton and second ed by Councilman Brown that the Mayor and City Clerk be authorized to sign such bid and con tract at the city's regular rates for water. PORT TURNSEND, WASHINGTON, MAY 25, 1937. The CITY COUNCIL of the city of Port Townsend met in regular session this 25th day of May, 1937, at 8:00 o'clock p.m., in the Council Chambers of the City Hall, Mayor 11. L. Hirt ler presiding. ROLL CALL. Upon Roll Call, thdae answering present were Mayor H. L. Hirtzler, City Attorney W. J. Daly, City Clerk C. F. Christian, and Councilmen Fred G. Lewis, R. E. Ammeter, Peter Naughton, Robt. W. Brown and VI. S. Lafferty. MINUTES APPROVED. The Minutes of the regular session of May 4, 1937, were road and approved as read. REPORTS OF OFFICERS. City Attorney, Re: Condemnation of Property. City Attorney Daly submitted a written report relative to condemnation of propert for street purposes, as follows: Port Townsend, Washington, May 25th, 1937 Honorable Mayor and City Council, City of Port Townsend. Gentlemen: Further authority is requested concerning the acquisition of the property in Sohn Bartlett's Addition for street purposes. The property to which I refer is that adjoining the real estate recently purchased by A. Benedetto from Jefferson County:.and from which Mr. Benedetto has agreed to dead to the city a portion for street purposes. Concerning the back property I wrote the owner and offered her the sum of $15.00 for a deed to the entire lot. I consider this price more than commensurate with the pres- ent or futAre value, of the property. To that communication I have received no answer. From ribbing that I have received at the A. Benedetto Shoe Shop, I assume that my message was delivered in due course, altho nothing official has coma into my hands. I have every reason to believe that one E. LT. Starrett, agent for the property owner, objects to the procedure and I request at this time, formal authority to pressed to to acquire the property thru condemnation proceedings. The cost to the city under condemn- ation will be as follows: Filing complaint $ 4.00 Service of summons 2.00 Judgment 8.00 Attorney fee to defendant 10.00 To this will be added whatever the jury deems the fair price of the land, and in addition Jefferson County will be burdened with the cost and expense of a jury. I am appreciative that Mr. Starrett is informed concerning these facts, and his present attitude in failing to respond to the wishes of the city is not inconsistent with his past attitude in matters of public interest, where his personal purse strings are con- cerned. Very truly yours, W. J. Daly, City Attorney. This matter was taken up under order of Unfinished and New Business. New Truck and Warrant. The City Clerk reported that the truck ordered by the city from Buhler Motor Co., had been delivered to the city and that a warrant upon the City Street Fund, in the amount of '1178,75 in favor of the Buhler Motor Company, had been drawn and delivered to the said Company in payment therefor. It was moved by Councilman Lafferty and seconded by Councilman Brown that the said truck be duly accepted and that the issuance of the said warrant be approved. Upon roll ca vote, all five Councilmen present voted in the affirmative and motion visa declared carried. Warrant for Business Tax. The City Clerk further reported that a warrant in the amount of $197.12, dated May llth, had been issued to the State Tax Commission in payment of the State Business Tax upon Water 'Lorks receipts for the months of lurch and April, 1937. Treasurer's April Report. The report of the City Treasurer for the month of April, 1937, visa presented, rea and referred to the Finance Committee. Water Supt's April Report. The report of the City Water Supt, for the month ending April 30th, was presented, read and referred to the Water Committee. Main Line Meter Readings. The r eport of the Water Supt., showing the flow of water thr the main line meters for the period ending May 25th, was presented, read, and ordered filed. quarantine Station Water Acceptance. The City Clerk reported receipt of acceptance by the U.S. quarantine Station of th Later Contract for the ensuing fiscal year. City Street Fund Resolution. The City Clerk further reported that he had forwarded th certified copies of resolution setting up City Street Fund"to the Highway Department.
