Hirtzler presiding. Roll Call. Upon Roll Call those answering present were Mayor H. L. Hirtzler, City Attorney i7. J. Daly, City Clerk C. F. Christian, and Councilmen W. S. Lafferty, Fred G. Lewis, R. E. Ammeter, Peter Naughton and Robt. 111. Brown. Minutes of Apr. 6th Approved. It was moved by Councilman Brown and seconded by Councilman Naughton that the minutes of the regular session of April 6th be approved as written. Motion declared carried. mayor States Purpose of Meeting. Mayor Hirtzler then stated that the purpose of this meeting was to consider the early purchase of a truck for the street department and also to further consider the propo- sal made to Fort Worden authorities, last August, with reference to a new water contract. Proposal He -affirmed. After a general discussion relating to the said proposal, it was moved by Council man Naughton and seconded by Councilman Ammeter that the proposal, by the old Council, to furnish the Fort with 30,000,000 gallons yearly at a flat rate of $5000900 and all in exces of that amount to be at the regular rate of 21� per thousand gallons, be reaffirmed and ap- proved, the terms of the contract to be subject to the approval of the Water Superintendent and the City Council. Upon Roll Call vote, all five councilmen present voted in the af- firmative and motion was declared carried. Re: Purchase of Truck. It appearing to be for the best interest of the city to purchase a new dump truck at an early date, because of rising prices, it was moved by Councilman Lafferty and seconds by Councilman Brown that the City Clerk be directed to call for bids to furnish the city with andump truck, said bids to be opened at the regular session to be held on April 20th. Upon roll call vote, all five councilmen present voted in the affirmative and motion was declared carried. Specifications. In the matter of specifications to be submitted to prospective bidders, the City Council designated the following items: Capacity (rated) - 1l tons; Body - dump; make - Wood or equal; Capacity - 1VI cu.yde; Power hydraulic hoist. Overload springs; Dual rear tires; With, -,or without dual reduction rear end; Tires, Regular or oversize; Paint job, Highway yellow and lettered; Other equipment, regular. Payments: $500.00 upon delivery of truck, $500.00 on or before July 15th, 1937, remain- der of purchase price on or before Dec. 15th, 1937. A sufficient number of copies to be prepared to supply all prospective bidders. Re: Delinquent Water Accounts. Instructions to City Treasurer. It was moved by C=ncilman Lafferty and seconded by Councilman Naughton that in th futitre whenever the Cuter Superintendent has settled and compromised a delinquent water ac- count with a water consumer and a minimum sum has been fixed as a down payment under that compromise, and when that fact has been communicated to the city treasurer, that she be in- structed to accept no sum .less than the minimum sum fixed by the city water superintendent. Motion declared carried Application for Water Permit, It was moved by Councilman Lafferty and seconded by Councilman Naughton that the mayor and the city clerk be authorized to execute an application in writing, addressed to the State Supervisor of Hydraulics of the State of Washington, for a temporary permit for three years in order that the provisions of application Noe. 2851 and 2852, to divert and store waters of the Big Quilcene river, be extended fox, that period. Upon roll call vote, all five councilmen present voted in the affirmative and motion was declared carried Re:Timber on Water shed. City Attorney Daly stated that they had been assured by Mr. Bruckhart that there woulb be no further severance of timber on the Big Quilcene River water shed as long as he had charge. It was then moved by Councilman Ammeter and seconded by Councilman Lewis that a letter be written to Yr. Bruckhart requesting that no further sales of timber on the Big Quilcene water shed be made. Motion declared carried. Adjournment. Upon motion of Councilman Lafferty, seconded by Councilman Naughton, the Council voted to adjourn. Attest: , �c Mayor .. The CITY COUNCIL of the City of Port Townsend, Washington, met in regular session this 20t day of April, 1937, at 7:30 o+clock p.m., in the Council Chambers of the City Hall, Llayor H. L. Hirtzler presiding. ROLL CALL. Upon Rcll Call there were present Mayor H. L. Hirtzler, City Attorney, W.J.Daly, City Clerk C. F. Christian, and Councilmen Fred G. Lewis, R. E. Ammeter, Tony De Leo, Peter Naughton, Robt. W. Brown and W. S. Lafferty. 14INUTES APPROVED. The Minutes of the special meeting of April 13th, were -read and approved as read. REPORTS OF OFFICERS. Daly on Water Permit. City Attorney Daly reported that Mayor Bangerter and himself had contacted the Supervisor of Hydraulics at Olympia and had secured a new water right permit, granting a further period of two years in which to begin further construction or development of the said rights. Fort Worden Water. City Attorney Daly further reported that he did not know the exact status of the Fort Worden water proposal and, therefore, had not yet taken up the matter with the Fort Worden authorities. Adams Grader Paid. The City Clerk reported receipt of a receipt from the J. D. Adams GraderCompany showing payment in full of the Adams Orador No. 151, purchased on a rental basis in 1935. Treasurer's March Report. The report of the City treasurer for the month of March, 1937, visa presented, rep and reperred to the Finance Committee. No Standing Committee reports presented. COMMUNICATIONS. Daly Re: Traffic Signal, A communication from City Attorney Daly was presented and read, as follows: Port Townsend, Washington, April 20, 1937 Honorable Mayor and City Council, Port Townsend, Washington. Gentlemen: During last week I was informed by your Mayor that Lira. Siebenbaum, one of the owners of the Delmonico Hotel property in the City of Port Townsend, had refused electri- cians under contract to the city, the right and privilege of driving eye bolts into the brick wall of the building for the purpose of hanging traffic signal at the corner of Wate: and Taylor streets. After some conversation with the electircians and your Mayor and and instructions from the latter officer, I wrote Mrs. Siebenbaum and requested, on behalf of the city, request to make the installation as contemplated. I had to assure her that the city would enter into a'written contract of indemnity so as to save her and her associates harmless for any damage that they might sustain to the building by reason of the installa- tion. I now request your advice and instructions in conformity with the foregoing. Very truly yours, W. J. Daly, City Attorney. To execute bond. It was moved by Councilman Naughton and seconded by Councilman Ammeter that the City Attorney prepare such indemnity agreement and thatnthe Mayor and the City Clerk be au- thorized and directed to execute the same on behalf of the city. Upon Roll Call vote, al six councilmen present voted in the affirmative and motion was declared carried. BUILDING PERMITS. Applications for Building Permits were presented, read and disposed of, as follows: From. John Wallitner, to -wit: Port Townsend, Washington, April 15, 1937 To the Honorable Mayor and City Council, Port Townsend, Washington. Gentlemen: Permission is requested to erect a frame dwelling house on my property at the corner of Roosevelt and Quincy Streets. Cost is estimated at 63000.00.
