It was moved by Councilman Naughton and seconded by Councilman Lafferty that the said 7esolution be adopted provided that it did not financially obligate the city in any manner. Jpon Roll Call vote, all six councilmen present voted in the affirmative and motion was de- slared carried. UNFINISHED AND NEW BUSINESS. John O'Dell Claim Rejected. In the matter of the damage claim of Joon O'Dell, which was referred to the City Attorney and the Chief of Police for investigation and report, Chief of Police Willestoft submitted the following written report. Port Townsend, Wash., January 28, 1937 Honorable Mayor and City Council, Port Townsend, Wash. Gentlemen: - I herewith submit a diagram and report of the accident occurring between the City Truck driven by Mickey McCullem and the private car of O'Dell drived by Mrs. O'Dell. The accident occurred on November 19, 1936, on the Fort road and 0 Street.From report given by McCullem and Harrington, the city truck coming from the gravel pit had entered the intersection and was half way across the fort road, when O'Dell's car approach from the right. McCullem's intention was to cross the Fort road onto 0 Street, but seeing the O'Del car approaching and trying to pass in front of city truck, swung to the left in order to a- void a collision. Mrs. O'Dell passed in front of city truck and doing so scraped and t-11 the left door of her car on the fender of city truck. McCullem and Harrington stated that Mrs. O'Dell was driving with considerable speed. McCullem reported the accident to me immddiately. Mrs. O'Dell reported to the Sher- iff's office. Respectfully, Goo. Willestoft, Chief of Police. Diagram or drawing, showing street plan and location of accident was attached to letter It was then moved by Councilman Brown and seconded by Councilman Lafferty that the said claim (of John O'Dell) be rejected. Upon Roll Call vote, all six councilmen present voted in the. ffirmative and motion was declared carried. Election of Mayor Pro Tem. Carried over,from the previous session of the Council, because of a tie vote, the Mayor declared it to be in order to ballot upon the election of a Mayor -Pro 'Tem, and named City Attorney Daly as teller. A tally of the first ballot showed that Councilman Sather had received three votes and Councilman Naughton had also received three votes. The Mayor declared it no election and called for a second ballot. Naughton Elected. Upon a tally of the second ballot, it was shown that Councilman Naughton had received five votes and Councilman Sather had received one vote. Mayor Hirtz- ler thereupon declared that Councilman Peter Houghton had been duly elected as Mayor pro tom GASOLINE BIDS. Pursuant to published call for bids, the following oil companies submitted propose: or bids to furnish the city with gasoline for the ensuing year, which bids were opened and read, the proposed rates being as follows: Ethyl Non -premium 3rd Structure Associated Oil Company �1�6CC Richfield Oil Company 18¢ 16¢ 15 ¢ Union Oil Company 16¢ 1 ¢ Shell Oil Company 18¢ 16¢ 1 ¢ Standard oil company 18¢ 16¢ 1 ¢ The terms and conditions of the said proposals appearing to be uniform, they are not recorded in these minutes, but they are hereby referred to and made a part of these minutes with the same force and effect as though herewith set out in full. It was thereupon moved by Councilman Naughton and seconded by Councilman De Leo that the said proposals be accepted and that the delivery of gasoline to the city be divided between the five companies submitting, proposals, for the coming year, upon a pro rate basis. Upon Roll Call vote, all six councilmen present voted in the affirmative and motion was colored carriod. Recess. Upon motion of Councilman Naughton and seconded by Councilman De Leo, counoil recessed for a few minutes, and re -convened at 9:25 P.M. REPORTS OF OFFICERB. s Mayor Appdints City Officers. I # Under this head, the Mayor announced the following ap- pointments: Chief of Police: Goo. Willestoft; Patrolman: Dave Bartl. Clerk, Water Office: Mrs. J. H. Johnson; Fire Chief: J. J. Lafferty. Street Superintendent: A. D. Swanson. Members Park Board: Joe Kirkpatrick, Mrs. Emma With and Roy Dale. It was moved by Councilman Sather and seconded by Councilman Brown that the Park "'✓<i Board appointments be confirmed. Upon rollcall vote, all five councilmen present voted in the affirmative and isotion was declared carried. Attorney asks about Campbell Warrant. f?` City Attorney Daly reported to the Council that the City treasurer had refused to honor the warrant issued in the name of T. W. Campbell, for services due him at the time of his death, when tho=saiddwarrant was presented by the widow, Mrs. Campbell. Mr. Daly sug- ' gested that the Oouncil recommend that the warrant be paid if presented, duly endorsed by ;`F the surviving spouse of the late Mr. Campbell. Motion to so recommend. a It was moved by Councilman Ammeter and seconded by Councilman' Brown that the Council recommend to the City :Treasurer that the said warrant be paid upon presentation if duly endorsed by Mrs. Campbell, the surviving spouse. Councilman Lewis, Chairman of the Fire and Light Committee, stated that he had not ' called his committee together int eh matter of the installation of the traffic signal at the intersection of Taylor and Water Streets, but would do so in the near future. Councilman De Leo stated that Mr. Kendall, the contractor, had advised him. that he could not do the work at the contract price if installation of poles was required. The matter was left in the hands of the committee for further investigation. y Sidewalks. Councilman Sather, chairman of the Street Committee, reported that a tents tive plan had been drawn up by the Street Committee, relative to the installation of sidews. under the new W. P. A. Set up. BUILDING PERMITS. Applications for Building Permits were presented, read and disposed of as follows: From R. E. Ammeter, to -wit: '� Port Townsend, Washington, Feby 16, 1937. Gentlemen: Permission is hereby requested to reshingle the roof, and to shingle the aides c the house at 631 Calhoun St., at an estimated cost of $75.00 for material.
