It appearing that a small balance remains in the Olympic Gravity Dater System - Construction Fund after all claims against the said fund have been satisfied, the followin resolution to transfer the same visa presented and read, as follows: RESOLUTION. BE IT RESOLVED that the unexpended and unobligated balance of the sum of #45.72 in th ""Olympic Gravity Plater System, Construction Fund" be and the same is hereby transferred to Olympic Gravity Waterworks Fund" and the City 'Treasurer of the City of Port Townsend is hereby authorized to make the appropriate transfer upon the books of his office. It was moved by Councilman Lanuners and seconded by Councilman Naughton that the said resolution be adopted. Upon Roll Call vote, all five Councilmen present voted in favor thereof and motion was declared carried. Resolution to Collect Water Accounts. A resolution relative to collection of delinquent water accounts was now present and read, as follows: Resolution. It having come to the attention of the ^later Committee of the City Council that the delinquent water accounts has grown to an alarming extent, Be It Resolved; that the Plater Superintendent be instructed to vigorously prosecute the matter of the collection of all delinquent water accounts. It was moved by Councilman Lammers and seconded by Councilman Lafferty that the said resolution be adopted. Upon roll call vote, all five councilmen present voted in the affirmative and motion was declared carried. UNFINISHED AND 1 l BUSINESS. Unearned Premium on Fidelity Bond. In the matter of the unearned premium on the bond of the former city treasurer, ILrs. H. E. Dobbs, now deceased, which matter had been referred to the City Attorney, :s. Daly, the city Attorney, advised the Council, be letter, as follows: i Port Townsend, 7,1ashington, October 20, 1936. Honorable Mayor and City Council, City of Port Townsend, Washington. Re: Collection of unearned bond premium on officia bond of former City 'Treasurer. Gentlemen: In conformity with instructions of your body upon the above entitled subject I am in receipt of a communication from Oscar Ylocker, local agent for the L:aryland Casualty Company, surety on the official bond of Harriett E. Dobbs, former City treasurer, a portion of which letter is herewith quoted: "We are now advised by the Rome Office of the L:aryland Casualty Company that on account of the apparent shortage in the accounts of Harriett E. Dobbs, former City Treasure , which may develop into a claim against the surety, we are not permitted to grant any return premium on this bond". >i �j The position taken by the bonding company for the present is, in my opinion, en- { tired correct. Mr. Stockand, the present City Treasurer informs me that he intends to ffJ make claim upon the administrator of the estate of the said Harriett E. Dobbs, deceased, for the difference between the cash which actually came into his hands upon taking over the a office of City Treasurer, and the amount which should have been there, according to the rec ords and files of his office. The time for filing claims in the matter of the estate of Harriett E. Dobbs will not expire until the 28th day of November and, of course, no payment can be legally made from the funds in the hands of the administrator for general clai:.a un- til after that date. I am satisfied, however, that any claim filed by the City of Port (I Townsend will be paid, and when that payment has been made by the administrator vie can re- open and rassert the City's claim against the idanyland Casualty Company for the unearned Fk4 premium on the official bond of :rs. Dobbs. €! Accordingly, this matter should be carried on the records of the Council as un- finished business until about December 1, 1936, when the matter should be reopened Ii Very truly yours, W. J. Calling attention to the fact that funds had now boon appropriated for the repair of the city garage, the City Clerk suggested that early action be taken in the matter se that the repairs could be completed before the edvent of winter weather. Councilnan Lafferty stated that a :s. Anderson had offered, after seeing the buil ding, to put on a flat roof for the total stun of u150100. Councilman Hirtzier stated that he had also contacted a carpenter, who stated that it would cost considerably in excess of ;150.00 to alter and repair the building. A motion by Councilman Hirtzler that the ,job be tendered i,:r. Anderson for $150.00 received no second, and after further discussion, it was moved by Councilman Hirtzler and I'I seconded by Councilman Lai:a:,ers that bids be called for the work after City Engineer Campbell I prepares suitable specifications. Upon a voice vote, the L'nyor declared the motion carried t i 251 :,:inutes of Regular Session of Oct. To Beautify Lot or Street, Councilman Lammers stated that a small triangular plot of land at the intersectic of F and Van Ness Streets was encumbered by woods and rubbish and that a nearby resident would be pleased to clean it up if given permission. It was mooed by Councilman Lammers -and seconded by Councilman Naughton that the requested permission be granted if there be no cost to the city and it was city property. Motion declared carried. ABate Nuisance on I;organ Hill. It was moved by Councilman Hirtzler and seconded by Councilman idcGee that the Fire Department be instructed to abate a nuisance, by burning a partially destroyed buil- ding on Llorgan Ilill, near the residence of Col.
