Eisenbeis, his successors and assigns, shall be entitled to charge for the use of said wharf and improvements such rates of wharfage, dockage, storage and tolls as the proper authorities of the City of Port Townsend may from time to time le- gally establish; provided, however, that all property and material belonging to th63said city , or for its use, shall be admitted over said wharf free of charge. Section 4. The City retains the right to lay and maintain water pipe lines for fire purpose, or sale of water, any where on said wharf outside of the buildings thereon, as one of the conditions upon which this franchise is granted. Section 5. The City of Port Townsend also reserves and maintains the right to estab- lish and maintain a float alongside of said wharf on the easterly and insh6re side of (L) or (T) with suitable steps or gangway leading to said float, which shall be for the free use of the public for the purpose of landing and shipping property or freight not exceeding five hundred (500) pounds in quantity at any one time, and such property and freight, so landed or shipped, may be transported or shipped over said wharf, to or from said float, Without payment of wharfage, dockage or tolls of any kind. Section 6. Said F. W. Eisenbeis, his successors and assigns, shall begin the construe tion of said wharf within sixty (60) after this ordinance takes effect, and shall complete the same within four (4) months from date. Section 7. This ordinance shall take effect and be in force five days after its publi cation, and shall continue to be in force for a period of ten (10) years, and no longer. Section 8. That for the rights granted, the said F. W. Eisenbeis and his successors and assigns shall pay to the City of Port Townsend the sum of $50.00 per annum for each and every year during the term of said franchise for the rights and privileges herein granted, payable annually in advance; that in case said grantee, his successors and assigns shall fa; to comply with any or all of the conditions of this ordinance, then and thereupon this ordi• nance shall become null and void, and all rights and franchises herein granted shall become forfeited. UNFINISHED AND NEW BUSINESS. Fort Worden Water Contract Renewed. Written form of N6tification from the War Department of intention to extend the contract to supply Fort Worden with vrater for one year from July lst, 1936, was presented and read to the Council and it vras moved by Councilman Naughton and seconded by Councilman Lafferty that the Mayor and the City Clerk be authorized to sign and execute the said re- newal of contract. Upon Roll Call vote, all five councilmen present voted in the affirm- ativeoand motion was declared carried. Keymes Beach Water Pipe Petition. A petition, signed by Fred J. Simcoe, at al., relative to extension of a water pipe line, vras presented and read, as follows: The Honorable Council, Port Townsend, Wash., June 15, 1936 City of Port Townsend. Gentlemen: The undersigned, property owners in the district adjacent to Keymest Beach (or Adelma Beach as now known), respectfully request that your Honorable Body make necessary allotment of vrater funds to install water line from a take -off where the present city main crosses the "FOUR -CORNERS to CHIMACUM" county road east of the said FOUR CORNERS to a point in the vicinity of said Keymes, Beach in order to afford water service to property owners in that general area. It is our opinion that availability of city water will be a very pronounced facto, in the settling of that area by persons building not only summer homes buff also permanent residences as well, and a large potential list of water consumers may readily be envisaged by a brief study. Ammeter The said petition was referred to the Plater Committee and the City Engineer for inves- tigation and report. Mosely Tap. Councilman Lafferty reported that Mr. Mosely, of the Rhododendron Hall on the Chimacum Road, had spoken to him about a water tap, requesting that it be moved to the new 6" pipe near the highway. Lycette, an attorney representing the Woodmen of the World, addressed to M ir, sly rela- tive to the status of the 1911 G.O. Bonds; in which he discussed possible settlement of the defaulted bonds. This letter being addressed to the City Attorney, it is not herewith recorded and it was referred back to the City Attorney.
