The CITY COUNCIL of. the City of Port Townsend, Washington, met in regular sessim this loth day of December, 1935, at 7:30 o'clock p.m., in the Council Chambers of the City Hall, Councilman `.Ym. Lammers, Mayor pro tam, presiding in the absence of Mayor Bangerter. Roll Call: The Roll was called and those answering present were City Attorney W.J.Daly City Clerk C. F. Christian, and Councilmen H. L. Hirtzler, Sam McGee, Peter Naughton, W. S. Lafferty and Wm Lammers Sr.. Councilmen DeLeo and Sather arrived later in the session. Minutes (Dec. 3rd and 9th) approved. The Minutes of the regular session of Dec. 3rd, 1935, were read and approved as read, and the minutes of the special called session of Dec. 9th, 1935, were read and also approved as road. DeLeo arrives: Councilman 'Pony DeLeo arrived during the reading of the minutes and took his seat in the Council. BILLS AND CLAIMS. Approved Bills. The Clerk requested consent of the Council to present three claims which were due but were not available at the first regular session of the Council this month, and there being no objection, the said claims were presented and read, as follows: Upon the Current Expense Fund, to -wit: Puget Sound Power & Light Co. Street and City Hall lighting for Nov. 152.42 J. D. Adams Company October payment on Grader Contract 83.33 J. D. Adams Company November payment on Grader Contract 83.33 Total .................................. 319.08 It was moved by Councilman Naughton and seconded by Councilman Hirtzler that the said claims be alloyed and that the Mayor and the City Clerk be authorized to draw warrants up- on the proper funds in payment of same. Upon Roll Call vote, all six councilmen present voted in the affirmative and motion was declared carried. REPORTS OF OFFICERS. Main Line Meter headings. The reports of the Water Supt. showing the flow of water through the main line meters, for the period ending December 9th, 1935, were presented, rea and ordered filed. Councilman Paul H. Sather arrived at this time and took his seat in the Council. November Water heport: The report of the Water Superintendent for the month of Novem- ber, 1935, was presented, read, and referred to the Committe on Water and Drainage. REPORTS OF STANDING COMMITTEES. ' More time of Eisenbeis Application. There were no reports from Standing Committees except that Councilman Hirtzler reported that the committee had not been able to ascertain what particular improvements Mr. Eisenbeis desired to make on his building at Water and Adams streets and requested more time, which was granted. Willestoft Reports on Cesspool. At the r equest of Councilman Naughton, Chief of Police Willestoft now reported that he had called on the owner of the septic tank, where complaint had been made of the overflow on Maple Street, and that the owner, Mr. Raynor, had promised to take care of the matter at once. COMMUNICATIONS. Howard -Cooper Corp. The only communication was a circular letter from the Howard-Coope Corporation, of Portland, Oregon, to the effect that parts for the Adams Grader were now in stock at their Spokane Office, but that stocks would soon be carried, both at their Seattle and Portland offices. REQUISITIONS. City Attorney. hepisitfon was presented by City Attorney Daly for 500 sheets 81F x 13 typewriter paper. It was moved by Councilman Naughton and seconded by Councilman DeLeo that the requisi- tion be granted. Motion declared carried. ORDINANCES AND RESOLUTIONS. Liquor Penalty Ordinance. City Attorney Vi. J. Daly now presented a proposed ordinance, accompanied by the following communication, to -wit: Port Townsend, Washington, December 10, 1935. Should the Chief of Police make any arreat within the City og Port Townsend for the violation of this act, it would be necessary that the offender be tr before a county Justice of the Peace, and any fine or forfeiture resulting therefrom would be paid into the general fund of the county. With the passage of this ordinance, the po lice judge has jurisdiction, and the police chief can carry on without resort to the count courts. In preparing the ordinance I have generally followed the language of the original legislative Act throughout, making such changes as apply to a city of the 3rd class. Very truly yours, W. J-. Daly. The proposed ordinance entitled'"'An Ordinance of the City of Port Townsend relating to intoxicating liquors and prohibiting the manufacture, possession, sale, or. other disposition thereof in the City of Port Townsend, except in certain cases; providing for the control and regulation thereof; providing ;ienalties'for violations and establishing a fund of said City known and designated as "Liquor Act Enforcement Fund.", was then read in full by the City Clerk, for the first reading. There being no motion to further consider the proposed ordinance at this session, the matter automatically goes over to the next regular session. Pending Emergency Ordinance. In the matter of the pending emergency ordinance, it vra: moved by Councilman Naughton and seconded by Councilman Sather that consideration of same be deferred to the next regular session. Upon a viva voce vote, the motion was declared carried, Councilman McGee voting "No." UNFINISHED ANDi:NEW BUSINESS. Engineer's Report re: Bid Totals Water Works Construction Project. In the matter of the bids submitted for the water works project, which were opens and read at the special called session of Dec. 9th, 1935, and referred to the City Engines, for tabulation and report, the Engineer submitted a written report, which was presented an read, as follows: Port Townsend, Washington, December 10, 1935 To the Honorable mayor and City Council, Port Townsend, Washington. bentlemen:- The tabulation of bids submitted for Additions and Betterments to, and Replaceme' of, Olympic Gravity Water System, as opened and read before your Honorable Body at 7:30 p December 9th, 1935, shows the total amount of each bid based upon estimated quantities to as follows: James H. It was then moved by Councilman Sather and seconded by Council- man Lafferty that the contract for the making of "Additions and Betterments to, and Replace msnts of, Olympic Gravity Water System" be awarded to James H. Coyne in conformity with his bid as filed, and that the Mayor and the City Clerk be authorized to execute formal contrac , upon the filing of a performance bond, and approveal of the Public Works Administration. Upon Roll Call vote, all seven councilmen voted in the ffirmative and motion was de- clared carried. Other Certified Checks Released. It was moved by Councilman Lafferty and seconded by Councilman Hirtzler that the certified checks of all other bidders be released and that the City Clerk be authorized to return same to the respective bidders immediately. A roll call vote was taken, all seven councilmen voting in the affirmative and motion was declared carried. Clerk to Inform PWA.
