Minutes of regular session of May 21/35 continued
(supplemental letter to Newland)

Dear Sir: -
Supplemental to my letter of even date, replying to your letter of May 6th, here-
in is set forth a short "history of receipts and expenditures for the street department for
the past four:or-•five^years:
An expenditure of approximately $4200.00 in excess of receipts was brought about a
follows:
The city was advised by the Hi§hway Department, prior to making up the 1931 budget,
that the city could include the sum of $1484.50, for highway maintenance, as an estimated
receipt. The same amount was included in the budget for 1932 in the belief that the city
would be awarded these funds eventually but the Attorney General ruled adversely to the cif
which created a deficit, in the said amounts. During the summer of 1934, it was found neoest
sary to appropriate $1250.00, in addition to the regular budget for highway maintenance, cre-
ating a further deficit of $1250.00; in other words, current expense warrants in approximately
the above amounts were issued and put on interest because of lack of funds to cover same.
At the beginning of 1934, about $8000.00 current expense warrants were outstanding, the war-
rants issued for street dept. expenditures being included (as above) and when the funds, ac-
crued under the highway act, Chap. 41, Laws of 1933, were received, they were, with other
funds accruing to the current expense fund, used to redeem outstanding warrants.
The City Attorney (in 1932) advised the writer that in the absence of specific au-
thority, the city council could not legally set up a Street Fund inasmuch as the Laws of 1935
abolished the old street and other funds. Highway maintenance and other highway moneys re-
ceived from the State were, therefore, put in the current expense fund, and while unable to
get an itemized statement from the Street Supt. (prior to March 1, 1934) of expenditures
separate from other maintenance, it is presumed that the funds were expended for maintenance
of the State Highway and connecting laterals.

Sanction to Oil Streets.
With reference to the oiling of certain "down -town" streets,
the City Clerk reported that he had written to the State Highway Department for their sanc-
tion of the said work fpr the protection of the city's funds should the work be classed as .
Special Maintenance, the following being a copy of said letter, to -wit:

At the session of the City Council (May 14th), a motion was made, seconded and
duly passed that the Street Department proceed to oil certain business streets as a dust
palliative, inly, and not as a surfacing job, but it occurs to me that such work may be cla -
sed as special maintenance and, therefore, your approval is sought for oiling the following
streets:
Washington St. from Monroe St, to Tyler St.
Monroe St., Madison St., Quincy St., and Adams St., one block only on each street be-
tween Washington and Water Streets.
Two blocks on Lawrence St., and two blocks on Tyler St., extending one block on each
street from the intersection of the said streets.
Thest streets are all directly tributary to Primary State Road No. 9, which passes
through the city. ,
Your sanction is requested at your earliest convenience because each high wind rai-
ses a veritable dust storm.

P.S. It is proposed that the regular street crew will do the work with the exception of th i
actual application of the oil.
CITY TREASURER.
Re: New Fiscal Agency.
The City Treasurer reported receipt of notice from the Chemical �.-
Bank & Trust Company, the new State Fiscal Agent in New York City, that funds for Bond Int-
erest and Bond Redemption must reach them 30 days prior to maturity date or a charge will b 4
made for their services as paying agent.
Treasurer's April Report.
The Report of the City Treasurer for the month of April, 193 ,
was presented, read, and referred to the Finance Committee.
Water Superintendent,
Main Line Meter Records.
The report of the Water Superintendent showing the flow of wa-
ter through the main line meters for the period ending May 13th, was presented, read, and
ordered filed.
REPORTS OF STANDING COMMITTEES.
Refund Bonds: Officers Instructed.
In the matter of taking steps to refund defaulted
bonds of the maturity date of July 1, 1931, it was moved by Councilman Lafferty and seconde
by Councilman McGee, that the City Attorney and the City Clerk be instructed to prepare the
necessary resolutions and 1Y'esent same to the Council at the next regular session. Upon
Roll Call vote, all five Councilmen present voted in the affirmative and motion was declare
carried.
Authorization to cash C.E. Warrants from other surplus funds.
It was moved by Councilman Lafferty and seconded by Councilman Hirtzler that the
City Treasurer be authorized to pay Current Expense Warrants from other Funds having a sur-
plus when there is no cash balance in the current expense fund;, in order to save the 6 per
cent interest on said current expense warrants. Motion declared carried. j

Dear,Sir:-
Pursuant to the provisions of Section 5 of Chapter 41, Session Laws of 1933, as
amended by Chapter 168, Session Laws of 1933, we transmit herewith our check in the amount
$506.93 as due the City from Secondary Highway receipts for the months of January, February
and March of the Current Year.
For the year 1935 the County Assessor reports the gross valuation of the City as f
$1,013,858.00, which includes the "Ships and Vessels" assessments. II
The laws under which this apportionment is made having become ineffective as of
April 1, 1935, the enclosed check covers only the proportionate sgare of 2/10 of 1% of the �
City"s assessed valuation for the months as noted above.
