The CITY COUNCIL of the City of Port Townsend, Washington, met in regular session this 14th day of May, 1935, at 8:00 o'clock p.m., in the Council Chambers of the City Hall, Coun oilman Wm. Lammers, Mayor pro tem. presiding until the arrival of Mayor Bangerter. ROLL CALL Upon ROLL CALL there were present City Attorney W. J. Daly, City Clerk C. F. Christian, and Counc men Tony DeLeo, Peter Naughton, W. S. Lafferty, Wm. Lammers Sr., H. L. Hirtzler and Sam McGee; Mayor Bangerter and Councilman Sather presiding. MINUTES APPROVED. The minutes of the regular session of May 7th were read and approved as read. REPORTS OF OFFICERS. WaterSupt': 'April' Report. The report of the Water Superintendent for the month of April, 1935, was presented, read, and referred to the Water Committee. REPORTS OF STANDING COMMITTEES. Re: Truck Licensee: Councilman.McOee requested an opinion from City Attorney Daly, relative to State Law recently passed by the State Legislature, prohibiting the city from exacting a license fee from certain trucks, and City Attorney Daly replied that he could not comply at this time because the 1935 session laws were not yet printed, but would recur the information requested at the earliest opportunity. Johnson & Gehrke Building Permit - postponed. In the matter of the request of Johnson & Gehrke to do certain construction work on their service station at the corner of Water and Monroe Streets, it was moved by Councilman Hirtzler and seconded by Councilman Naughton that they be granted permission to do the work as requested in their application. However, Councilman McGee, a member of the Building Committee, took exception to the motion inasmuch' as he had not been consulted in the matter, and the question of complying with the building ordinance was also raised. At the suggestion of the Mayor, and with the consent of his sec and, Councilman Hirtzler withdrew his motion and the matter was carried over to the next session of the Council. Mayor George Bangerter ARRIVED AT THIS TIME and thereafter presided. Marion Application for Sewer Connection. In the matter of the application of R. N. Ma- rion for permission to connect with the city sewer on Cass Street, it was moved by Council- man Lafferty and seconded by Councilman Naughton that he be granted the said permission up- on payment to the city of $23.10; the amount assessed to each lot in that sewer district, Marion's property being outside the district and not heretofore assessed. Motion declared carried. Foster Application. In the matter of the application of W. F. Foster to gravel the sidewalk in front of his property at 1741 Jefferson St., and to make repairs to the buildin at the same address to the extent of $60.00, it was moved by Councilman Lafters^and seconds' by Councilman Lafferty that the said permit be granted. Motion declared carried. COMMUNICATIONS. From R. P. Newland, Highway Engineer, Re: Status of Street Funds. A communication from Mr. R. P. Newland, District Engineer Highway Dept., addressed to the Mayor and requesting additional information relative to status of Street and Highway funds, was presented and read as follows, to -wit: Olympia, Washington, May 6, 1935. Dr. George Bangerter, Mayor, City of Port Townsend, Port Townsend, Washington. Dear Sir: - Receipt is acknowledged of your letter of May 1. At our meeting on Tuesday,April 30th, we requested verbally the following information: 1. The balance on hand from funds accruing under the secondary highway act, Chapt. 41, Laws of 1933. 2. The balance on hand from the $500.00 per mile paid the City of Port Townsend for maintenance of the primary b6ute through the city. 3. Your anticipate3revenue from street levies during the year 1935 which will be avai] able for maintenance or construction during the year of 1935. 4. The balance on hand from funds accruing from street levies prior to 1935. 5. The amount of any other funds that you may have available for street maintenance or construction. We also requested that you designate such main traveled streets or arterial streets which are to be maintaned, or upon which construction money is to be spent, from funds ac- cruing under Chapter 111, Laws of 1935. You have requested permission to purchase a grader from the secondary funds accruing this your. Please give us the amount to apply on the purchase of the grader from funds other than th6se accruing under Chapter 111, Laws of 1935 and what your monthly payments would be from the secondary highway fund during the present beinnium. i' i i 35 Minutes of regular session of May 14/35 continued. It ie also requested that you give us an estimate of cost for maintaining your entire street system from April 1, 1935 to April 1, 1936. The above information is necessary before we can act on your request for the purchase of a new grader. An early reply will be appreciated. Very truly yours, R. P. Newland, District Engineer By Geo. After some discussion relative to the information required, it was moved by Councilman Hirtzler and seconded by Councilman Naughton that the Street Committee be authorized and directed to designate the city streets sought to be included as tributary to the State Highway and that the City Clerk and the City Attorney be instructed to prepare and forward proper and suitable facts and figures, as requested, relative to street costa and other in- formation desired. Motion declared carried unanimously. BUILDING PERMIT APPLICATIONS. Applications for Building Permits were presented, read, and disposed of,;,as follows: From Ernest Lundstrom, to -wit: Port Townsend, Wash., May 14, 1935. To the Honorable Mayor and City Council, Port Townsend, Wash. Gentlemen: - Permission is requested to build a small addition to my garage, situate on Lots, 5 and 6, Block 24, Eisenbeis Addition. Coat of materials is estimated at $10.00. Respectfully submitted, Ernest Lundstrom. From Mrs. Clara Hathaway, to -wit:_ Port Townsend, Wash., May 14, 1935. To the Honorable Mayor and City Council, Port Townsend, Wash. Gentlemen: permission is requested to build an addition to my dwelling house situate on Hastings Avenue, near the city limits. Cost of materials is estimated at $125.00. Respectfully submitted, Mrs,. Clara Hathaway. It was moved by Councilman Hirtzler and seconded by Councilman Lafferty that the said applications be granted. Motion declared carried. REQUISITIONS. For Street Department: Requisition for supplies for Street Department was presented and read, to -wit: 1000, Daily Work Report forma. It was moved by Councilman Lafferty and seconded by Councilman Hirtzler that the said requisition be granted. Motion declared carried. UNFINISHED AND NEW BUSINESS. To reduce Theatre Licenses. Councilman Naughton brought up the matter of the present theatre license fees, and moved, the motion being seconded by Councilman McGee, that the City Attorney be instructed to prepare and present an ordinance amending the present ordi- nance by reducing the license fee to,.450.00 for one theatre, or $75.00 for two theatres. At the suggestion of City Attorney Daly, who pointed -out that the proposed fbe':for°two.thea tree might lead to complications, it was agreed that the proposed fee be made $50.00 for each theatre. Motion declared carried. Re: Refund of Defaulted Bonds. Bringing up the matter of the defaulted bonds, the City Clerk stated that he had been advised by the City Attorney that the Courts decision on a section of Initiative No. 92, did not adversely affect the standing of the defaulted bonds, and stated further that he believed the time to be opportune to make an attempt to refund the said bonds. The matter was referred to the Finance Committee. Work Relief Funds: The Clerk further suggested that inasmuch as Congress had passed the work relief bill for such projects as the city had submitted under a recent survey, the cit should now vigorously push forward in a militant manner, our need and right to the allocati of funds for the said projects. The matter was referred to the several standing committee to which the several projects would naturally be referred. Recess: It was moved by Councilman Naughton and seconded by Councilman McGee that the Council now recess for 30 minutes. Motion carried and recess declared. Council re-conveneR, and Roll Call. The Council re -convened at 10:45 o'clock p.m. and upon Roll Call there were present Mayor George Bangerter, City Attorney W. J. Daly, City Clerk C. F. Christian, and Councilmen DeLeo, Naughton, Lafferty, Lammers, Sather, Hirtzler and McGee. To Oil Streets. Councilman DeLeo brought up the matter of oiling certain streets to lay the dust which had become• a nuisance, and he moved, the motion being seconded by Coun01 -
