Christian, and Councilman Tony DeL. eo, Peter Naughton, '^. S. Lafferty, Vim. Lammers Sr., Paul H. H. Sather, H. L. Hirtzler and Sam McGee, Mayor Bangerter arriving later in the session. MIIlUTES OF FEBRUARY 5th and 8th APPROVED. Minutes of the regular session of February 5th, and the special session of February 8th, were read and approved as read. Mayor Bangerter arrived at this time and thereafter presided. REPORTS OF OFFICERS. CITY ATTORNEY. Proposed Street Fund ordinance. Reporting on the proposed ordinance to create a Shree Department Fund, City Attorney Daly quoted from an opinion by the Attorney General relating to funs froto the affect t of the ap peareddto bem mthat thetsaidsoline Tax funds shouldnbe, a the expended entirelyforhstreetnpurposes.stair. Dal stated, however, that inasmuch as the city had no knowledge or assurance at this time that the legislature would appropriate any part of the gas tax monies for the use of the cities and towns of the State, he believed it would be a mistake to set up a separate street fund at this time. . Water Ordinance Infractions. City Attorney Daly also brought up the matter of delin- quent water patrons, stating that %later Superintendent Green had reported to him that some of these delinquent patrons had turned on the water after the Department had shut of the water for non-payment of bills, in some instances having turned on the water at least three times in succession. +•r. Daly reported to the Council that after a search of the Water "i•dinances, it appeared that no penalty had been provided for this particular action by the consumer and that the city -was witoAt'definite, power to penalize such consumers. To Draw Penalty Amendment.. It was moved by Councilman Lammers and seconded by Council- man Lafferty that the City Attorney be instructed to draw up an ordinance providing for a penalty or penalties for turning on the water from the city system without due authorization i,iotion declared carried. CITY CLERK. Hoffman Reply. City Clerk Christian reported that in accordance with instructions, he had written to Mr. E. 11. Hoffman, as follows: Port Townsend, Washington, February 13, 1935. E. R. Dear Sir: - Relative to the above numbered project and in reply to your letter of kebruary 5t1 the City Council has instructed me to inform you that because of conditions which have deve oped since air application for a grant was merle, the city is now unable to carry out their part of the proposed project, that is; to furnish rg15,000 as a part of such construction costs. The unusual weather conditions prevailing during the past 'minter has created e hazard along the transmission orrsupply line of the water system that demands the retention of a considerable surplus for emergencies. It is with extreme regret that the Council was forced to come to the foregoing conclusion, but adequate protection to our supply system seems to demand it. Yours very truly, C. F. Liotion declared carried. From Standard 011 Company, Re: House Bill No. 55. A circular letter from the Standard Oil Company, urging the City, as a lessor of property to the said Company, to oppose the passage of House Bill No. 55, (intended to plat ... the State in the Gasoline Business) and to address a letter to the State senator from this District to vote "No" on this bill, was presented and read in full. , Clerk to send letter. It was moved by Councilman Lafferty and seconded by Councilman Naughton that the City Clerk be instructed to send a letter to Senator Bengston, advising him that the Council is opposed to House Bill No. 55. Motion declared carried. Port Angeles Passed Gas Division Resolution. The City Clerk reported receipt of advice from the City Clerk of Port Angeles that r. the City Commission of Port Angeles had also adopted a resolution favoring an allocation of gasoline tax monies to the cities and towns of the State and had forwarded copies of same to ` the legislators from this District. .I From H.
