the city council elected for a four-year term at the City General Election held on the 6th
day of December, 1932, except as qualified by Chapter 184, Session Laws of 1915 relating
to vacancies.
Section 4. That Ordinances numbered 339, 365, 469, 598 and 730, and all other ordinano a
or parts of ordinances in conflict herewith be and the same are hereby repealdd.
Section 5. That this ordinance be published once in the Port Townsend Leader and to
take effect and be in force five days from and after such publication.

UNFINISHED AND NEW BUSINESS.
Carl Jorgensen Application.
Written application from Carl Jorgensen to purchase dirt
to be taken from a city street was presented and read, as follows:
Port Townsend, Wash., August 7th, 1934.
To the Honorable Mayor and City Council,
Port Townsend, Wash.
Gentlemen:
Permission is requested to take about 7000 yards of dirt from the north aide
of Water Street between Walker and Van Buren Streets, the price for same to be decided up-
on between the City Council and myself.
Respectfully submitted,
Carl Jorgensen.
It was moved by Councilman Welch and seconded by Councilman Lafferty that the matter be
referred to the Street Committee for investigation and to report on the matter at the next
regular meeting of the Council.
Discussion followed, and City Attorney Daly being asked for an opinion, stated that if
removing the dirt destroyer the lateral support for the abutting property, the city would
be liable for damages.
Upon a call for the question, the motion was put and declared carried.
Cotton's Port Commission Water Bill.
Water Superintendent Green now brought up the matter of the unpaid water account
relative to construction of the Port Commission boat haven and reported that Mr. Harry A.
Cotton disclaimed liability for the account, and that any claim the city had in the matter
should be taken up with the Port Commission.
He further reported that Mr. Cotton had been billed for the water taken from the
water system for ships anchored in the bay.
Loose crushed rock on Water Street.
Councilman Lafferty, chairman of the Street Com-
mittee, reported that the Highway Department had requested that all of the loose crushed
rock on Water Street whoea recently surfaced by the Department, should be swept up and
taken off the street and he further reported that the Street bepartment was arranging to
comply with the request.
Letter from Wm. Brinsmead, Sr.
' A communication from Wm. Brinsmead, Sr., relative to
water service, was presented and read as follows, to -wit:

To the Honorable Mayor and City Council,
Port Townsend, Washington.
Gentlemen: -
I wish to call your attention to the following facts, that I have been antago-
nized and persecuted for several years by an employee of your water department, and througl
utter spitefulness, he has installed a meter to my property this month, which is unfair
andr;will defeat its purpose, with a loss to the city. I have done no sprinkling this year
for several reasons, other than that allowed by my house allowance, $3,05, and I invite
your inspection of my property to bear out this statement.
I am unable to rent this property on account of the meter installation and ask the
Council to have it removed at once, lest a loss to both myself and the city, as I am mo-
ving to Seattle by September 1.

THE CITY COUNCIL of the Ciy oG Port Townsend, Washington, met in regular session this

21st day of August, 1934, at 8:00 o'clock P.M. in the Council Chambers of the City Hall,
Mayor George Bangerter presiding.
ROLL CALL:\
Upon Roll Call, there were present Mayor George Bangerter, City Attorney W. J. Daly,
City Clerk C. F. Christian, and Councilmen Sam McGee, W. H. Lafferty, Wm. Lammers, Sr., and

Paul H. Sather; Councilmen Welch and Smith arriving later in the session.
MINUTES READ AND APPROVED.
The Minutes of the regular session of August
7th were read and approved as read. Councilman W. B. Smith arrived during reading of the
minutes, and Councilma:i Gen. Welch arrived immediately following the said reading of the
minutes.
ORDINANCES .:AND.RESOLUTIONS.
Special Election Ordinance.
By unanimous consent, the order of business of "Ordinances
and Resolutions"was now taken up, and an ordinance calling anspecialcelection to vote on
certain additional tax levies and entitled "An Ordinance of the City of Port Townsend pro-
viding for and fixing the date of a special election for the qualified voters of the city
to ratify or reject propositions granting to the City Council authority to levy taxes on th

taxable property of said city in excess of the rate of fifteen mills now provided by Law,"

3rd Reading and Passage.

The City Clerk then read the said ordinance by title only for
the third reading, whereupon it was moved by Councilman Lafferty and seconded by Councilman
Smith that the said ordinance be put on final passage and that it do now pass.
Upon Roll Call Vote, all six Councilmen present voted in the affirmative and motion was
declared carried.
Copy of Ordinance.
The following is a full, true, and correct copy of the said Ordi-
nance as passed by'the City Council on the 21st day of August, 1934, approved by the Mayor
on the same date, and published in the Port Townsend Leader August 23rd, 1934, to -wit:
ORDINANCE NO. 1042.
AN ORDINANCE of the City of Port Townsend providing for and fixing the dare for a spe-
cial election for the qualified voters of the city to ratify or reject propositions grant-
ing to the City Council authority to levy taxes on the taxable property of said city in ex-
cess of the rate of fifteen mills now provided by law.
WHEREAS, it appears to the City Council of the City of Port Townsend from an examinati
of the Preliminary Budget now on file with said council that there will be insufficient
money returned to the city treasury of the City of Port Townsend during the year 1935,throu
taxation and otherwise, to provide for and carry out the functions of the city government
for that year; and
WHEREAS, under the provisions of Initiative No. 64 (Chapter 4, Laws of Washington,1933)
cities and towns are granted power to levy taxes in excess of fifteen mills, when authori-
zed so to do by the electors of such city or town; and

WHEREAS, it appears to the City Council that an election for that pdrpoae is necessary,

and that the following propositions should be submitted to the qualified electors of the
city for ratification or rejection, now therefore,
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DO ORDAIN AS FOLLOWS:
Section 1. That a special election be held in the City of Port Townsend and the various
voting precincts thereof on Tuesday the 25th day of September, 1934, which day and date be,
and hereby is, fixed.as the date upon which said election shall be held and shall be voted
upon by the qualified electors of said city the following propositions and questions, in
the manner following:
Proposition I -
Shall the City Council of the City of Port Townsend .be authorized to
collect by taxation during the year 1935 the sum of approximately $1,950.00, for the purpos

of meeting a yearly installment upon the purchase price of the city fire engine, by a ape-

cial and additional levy of 1.950 mills on all taxable property of said city, over and abov

the 15-mill levy now authorized by law?

Proposition II -
Shall the City Council of the City of Port Townsend be authorized to
collect by taxation during the year 1935 the sum of approximately $1,750.00, for the pur-
pose of operating and maintaining the free public library of said city, by a special and
additional levy of 1.750 mills on all taxable property of said city, over and above the 15-
mill levy now authorized by law?
