It Was then moved by Councilman Welch and seconded by Councilman Aubert that nomina- tions be closed and that the unanimous ballot of the council be cast for Paul H. Sather as Councilman for the Fifth {Yard. Motion declared carried, and the City Clerk was requests to officially notify Mr. Sather of his election. Cottage in Park. Councilman Aubert brought up the matter of completing the cottage in Chetzemoka Park and it was brought out during the discussion that the Council could not at this time, take any official action. The matter was left in the hands of the Finance Committee for further investigation. BUILDING PERMITS. Applications for Building Permits were presented, read, and disposed of, as follows: From B. A. Erickson, to -wit: Port Townsend, Wash., May 8, 1934 To the Honorable Mayor and City Council, Port Townsend, Wash. Gentlemen: Permission is requested to erect a dwelling house on Lots 5 and 6, Block 94, Elsenbeis Addition, at an estimabed cost of $94.00 for materials. Respectfully submitted, B. A. Erickson by R. Councilman Aubert inquired about the status of the building at the N.E. corner of Water and Quincy Streets, which has been condemned by the City Council and was advised by the City Attorney that suit bad been filed for abatement and that an- swer had been made thereto. COMMUNICATIONS. LaVERA SUIT TRIAL. In the matter of the case of LaVera vs City of Port Townsend, the following communication from City Attorney Daly was presented and read, to -wit: Mayor and City Council, Port Townsend, Wash., May 15th, 1934 Port Townsend, Washington. uentlemen:- He: LaVERA vs. CITY. Mr. Allan L�rumbull, who represents the plaintiff in the above entitled action f damages which is now pending against the city, filed with me since last council meeting a notice asking that the court set this case for trial. The matter was noted for Friday, May 11, but Mr. Trumbull did not appear so the case was not set down. Should he file upon me a new notice, please let me have the wishes of the count on the question as to whether or not a jury should be demanded. If the city demands a ju we shall be compelled to advance to the clerk of the court the sum of $12.00. Yours very truly, '7. J. Daly . (Communications continued) Association of Washington Cities. A circular letter from the Association of Washington Cities, relative to the recent convention in Seattle, together with copy of Constitution and by-laws adopted, were presented by the City Clerk, but not read, and it was ordered that the same be filed for future reference. It was noted that if this city desired to join the as- sociation, the fee would be $20.00 per year. Credit Men Assoctn re: Goo. F. Townsend. A communication relative to claims agai s Geo. F. Townsend, was presented and read, as follows: Seattle, Washington, May 14, 1934 TO THE CREDITORS: Re: Geo. F. Townsend, 801 Water Street, Port Townsend, Wash. Gentlemen: - At the time of the assignment, the assets were claimed by a party under a certai bill of sale which was intended as security Bar a debt which the assignor claimed had been paid. However, the party having possession claimed the debt was not paid and insisted upon his right to the property. Although demand was made by the assignee, delivery was refuse and in order to obtain possession, it would have been necessary to have brought suit. The estate did not have funds with which to engage in litlgation and the property was not of sufficient value to justify the expenditure. Such equipment as has been received, has been sold for $22.50, $34.72 has been collected on accounts receivable, making a total receipts of $57.22. The accounts receiv- able have been disputed or are uncollectible. Funds realized have been applied against expenses and costs and we are compelled to close the estate without a dividend to creditors. Yours very truly, SEATTLE ASSOCIATION OF CREDIT MEN. By - E. C. Webber. Communication was ordered filed. Weppner State Insurance. Copy of letter addressed to Roy S. Weppner, from Department of Labor and Industries, advising that compensation for injury sustained February 27, 1933, had! been-awardedsto January 30, 1934, would cease on that date and that the Department can eiders the claim closed, was presented and read for the information of the Council. Communication was ordered filed. REQUISITIONS. Street Department: A requisition ties' submitted by the Street Department for, 4 new tires for street dept. grader. It was moved by Councilman Lafferty and seconded by Councilman Aubert that the said requisition be gratted. Motion declared carried. Purchase of tires. Inquiry was made as to who would purchase these tires and after some discussion it was suggested that the matter be considered by a committee of the whole Recess: It was then moved by Councilman Lammers and seconded by Councilman Smith tha' the Council recess for 10 or 15 minutes and motion was declared carried. Quotations: City Clerk Christian informed the Council that several dealers has submi• ted wrTEten quotations and the same were turned over to the committee of the whole. Council re -convened At 9:20 o'clock P.M. and upon Roll Call, the following were noted present, to -wit: Mayor —George Bangerter, City Attorney IN. J. Daly, City Clerk C.F.Chriatii and Councilmen George Welch, Sam McGee, W. B. Smith, Wm. Lammers Sr., W. S. Lafferty and C. P. Aubert. Buhler Motor Co. to furnish tires: Taking up the matter of the purchase of tires fo. the grader, Councilman Lafferty reported that the quotation of the Buhler Motor Co., for pneumatic tires with the necessary wheel changes was considered the most satisfactory. It was, therefore, moved by Councilman Lafferty and seconded by Councilman Welch that the order to supply the city with AWW pneumatic tires for the street grader be awarded to the Buhler Motor Company in accordance with the proposal and quotations of the said Compan. Upon Roll Call vote, all six councilmen present voted in the affirmative and motion was declared carried. Tools for Street Department. It appearing that a certain number of workmen were avail able for street work to be assigned by the State Emergency Relief Administration, it was agreed by the Council that the following number of hand tools should be added to the Stree Department requisition, to -wit: 10 shovels, 6 picks, 6 forks, 6 rakes. Emergency Ordinance for Street Department: It appearing that several items in the Street Department Budget had been exKausted, an Emergency Ordinance covering the matter wa, presented and read, as follows: ORDINANCE NO.
