The said communications were ordered filed for further reference and the matter of refunding the bonds continued for further report. Treasurer's Report: The Treasurer's report for the month of March, 1934, was presen- ted, read, and referred to the Finance Committee. Water Superintendent Report: The report of the Water Superintendent for the month of March, 1934, was presented, read, and referred to the Water and Drainage Committee. Main Line Water Flow. The report of the City Water Superintendent showing the flow of water through the main line meters for the period ending April 9th, was presented, read, and ordered filed. REPORTS OF STANDING COMMITTEES. Finance Committee, on Treasurer's Reports'. The Finance Committee presented the fol- lowing written report: Port Townsend, Washington, April 17, 1934. To the Honorable Mayor and City Council of the City of Port Townsend. Gentlemen: Your Committee, on Finance, to whom was referred the matter of the Treaeurerta report would respectfully report as follows: That the Treasurer's reports for January and February, 1934, were found to check correctly with the Treasurerts book accounts and are correct. C. P. Aubert Wm. Lammers, Sr. The said report was ordered filed. On State Highway Maintenance. In a verbal report, Councilman Lafferty, chairman of the Street Committee brought up the matter of maintenance of the Olympic Highway within the city limits, stating that members of the committee and the Street Superintendent had made an inspection trip over the said highway and found thechighway in need of considerable maintenance work. Also that Mr. Green of the Water Dept, had advised them that there was some asphalt on hand suitable for such work and that a movable asphalt kettle could be rented for $1.00 per day. He;recommended that the kettle be rented for the necessary work, that the necessary tools be purchased and that men be employed and the Highway be put in a good state of repair. Maintenance ordered. It was then moved by Councilman Lafferty and seconded by Coun- cilman Aubert that the Street Superintendent be authorized to rent the asphalt kettle when needed, to purchase the necessary tools for maintenance work and to employ such men as can be worked to advantage. Motion declared carried. On Hastings Avenue Water Line. Reporting verbally on request of John Woodworth and others for a water supply pipe on Hastings Avenue, Councilman Lammers stated that the situ. ation was in no way changed since the last report on the matter and that it was impractica: at this time to run a special line on the street in question. It was stated in the Ccun oil that the Sheridan Street -Hastings Avenue water main extension may be included in the new Public Works program. COMMUNICATIONS. Circular Letter, from Associated General Contractors of America. A circular letter from the Associated General Contractors of America, advising that it had been designated as registration agency for construction work undertaken on and after March 19th, 1934, was presented and read for the information of the Council and it was ordered that the said com mdnication be::duly filed'for.reference. Circular Letter, from Association of Washington Cities. A circular letter from the Association of '!Washington Cities, inviting the City Councilmen and the officials of the city to attend and participate in the state-wide convention of Washington Cities to be hel in Seattle on Thurdday and Friday, May 3 and 4, was also read for the information of the Council and the communication was ordered filed. REQUISITIONS. Requisitions for sundry supplies for various departments of the city, were presented, read, and disposed of, as follows: For the Street Department, to -wit: 1, 50-foot steel tape. It was moved by Councilman Aubert and seconded by Councilman Lafferty that the said requisition be granted. Motion declared carried. U of April 17/34 continued. (Requisitions) For the Police Dept. to.41t: 2 Tires and tubes for Studebaker car (Geo. Willestoft). 625/21 @ approx. $12.70 each for tires and 1.95 each for tubes. It was moved by Councilman Aubert and seconded by Councilman Lammers that the said requisition be granted. Motion declared carried. ORDINANCES AND RESOLUTIONS. Vacancy of Council Seat - let Ward. Councilman Aubert submitted a resolution declaring a vacancy in the office of Councilman for the First Ward, which was read in full as follows: Port Townsend, Wash., April 17th, 1934. A Resolution on Vacancy of Council Seat of the First Ward. WHEREAS, the Councilman from the let {Yard of the City of Port Townsend has not been in his seat for more than three consecutive sessions of the Council, and WHEREAS, he has been disqualified by the State from holding any office of profit or trust for reasons well known, now, therefore, BE IT.RESOLVED, that it is the sense of the Council that the Council seat of the let Ward is vacant and it is hereby so declared. It was moved by Councilman Aubert and seconded by Councilman Lafferty that the said Resolution be adopted. Upon Roll Call vote, all five Councilmen present voted in the af- firmative and motion was declared carried and resolution adopted. Election on new Councilman'. Eligibility of Geo. Welch. Councilman Aubert requested an opinion from Deputy City Attorney Daly as to the legal standing of George Welch to represent the First Ward as a Councilman and wr. Daly replied that it was his opinion that Mr. Welch would be eligible to hold the said office until the next regular election inasmuch as his residence was in the let ward when the councilman for that ward was regularly elected. Welch nominated and elected. Councilman Aubert then rose and nominated Mr. Geo. Welch for Councilman for the 1st Ward and Councilman Lafferty seconded the nomination. There being no further nominations it was moved by Councilman Lammers and seconded by Councilman Lafferty that nominations be closed. Motion declared carried. It was then moved by Councilman Aubert and seconded by Councilman Lammers that George Welch be declared duly elected as councilman for7:thbcFirst Ward. Motion declared carried, and the Clerk was instructed to officially notify Mr. Welch. NEW BUSINESS. Appointment of City Attorney. Stating that the critical illness of City Attorney Jas. W. B. Scott made it imperative that provision be made for a new City Attorney in the event of Mr. Scott's death, Mayor Bangerter announced the appointment of'Mr. W. J. Daly to that position, dffective if and upon the death of City Attorney Jas. W. B. Scott. Paving question. Mr. E. M. Starret, being accorded the privilege. of the floor, brougb up the question of hard surfacing several down town streets and stated that such surfacing could be assured if the city would assist by apportioning a part of the highway maintenance funds received from the State for such purpose. No action was taken in the matter. In a general discussion relative to paving, maintenance, etc., it was assebted that the State desired an accounting of the expenditure of these highway maintenance funds and the Clerk stated that he would take upethe matter with the State Highway Department. Bond Refunding Matters. The CSty.Clerk brought up the matter of furnishing an expert opinion on the legality of the proposed refunding bonds if the State was not in the market for the bonds. Mrf Daly reported that he had talked with Mr. McGrath and others at Olym- pia and received some encouragement in that they would give the matter full attention if and when presented to them. The City Clerk stated that if 'the city desired bidders other than the State, it would be advisable to go on record as assuring the prospective bidders that the city would furnish an opinion by a recognized authority on bonds relative to their legality, and Mr. Daly stated that he also believed that such action would be advisable. Bond Assurance. It was then moved by Councilman Aubert and seconded by Councilman Lammers that the City Clerk may assure prospective bond buyers that the city would allow a reasonable sum for an expert opinion on the legality of the said bonds. Motion declared carried. Adjournment: Upon motion of Councilman Smith, seconded by Councilman Lammers, council voted to adjourn and it was so ordered. ATTEST: l a
