Gentlemen: - Permission is hereby respectfdlly asked to remove the old moss covered roof and framework at the rear of the Olympic Hardware Company, brick warehouse, No. 829 Wash- ington Street. BE IT RESOLVEDby the Mayor and City Council of the City.of.Port Townsend aeffollows: The legislative authority of the City of Port Townsend deems .it- advisable to, lease that certain Partsof its water works and system lying outside of_the. city limits, commonly known as the "Hadlock and Irondale Line" and all additions, betterments and extensions that may hereafter be made to that portion of said water works system, together with all easments, rights -of -way, pipe lines and all other equipmentand appurtenances of every kind and character, real and personal, used or useful in connection with the.operation of that portion of said water works or system, whether now owned by said city.or hereafter acquired. The legislative authority of the City of Port Townsend hereby states and declares that itgdesires to lease said part of said water works and system. The terms and conditions of such lease upon which the legislative authority desires to lease said above-desribed part of said water works and system are as follows: 1. The property to be leased is described as follows: The present right-of-way, right=of-way to be acquired and pipe line to be constructed, to -wit: beginning at a point of the main supply.line of the Olympic Gavity Water System in Tax No. 2 (Tract B) in the NE4 of Section 8, Township 29 North Range 1 West and running thence -in an easterly direction. through sections 8, 9, 10, 11 and 12 in said townshipnand,,rangettosa?,point in Tax No. 7 of Section 1, Township 29 North Range 1 West, together with allequipment and appurtenances of every kind and character, real and personal, used or usefl in connection with the operation of the portion of the said system hereinbefore described, but excluding any pipe lines used in connection with the same to supply customers of the City of Port Townsend residing at Hadlock, Irondale and vicinity. 2. The lease shall have full possesion, control, use and enjoyment of said water works and system throughout the period of said lease, provided, however, that the said lease shall'use from the water works leased a quantity of water not to exceed 150,000 gallons a day and that all the remainder of the water in said line is reserved by the city. 4. The maintenance and the repair of that portion of the water works system so lease shall devolve 'upon the lessee, and the lessee,�)ehall at its own cost and expense maintain and keep said water works and system so leased in good and reasonable state of repair at all times. 5. Of the rent to be paid during said term of years, the sum of $� , shall be paid in advance and shall be considered as rent -'or the whole term of-EHI-s- 1eaee. 6. The lease shall contain provisionato the effect that if the lessee shall fail to observe the conditions of said lease as to maintehaneecanddrepai8; and such default or failure continue for a period of sixty (60) days after written notice, the city shhll have the right to terminate the lease and resume posses 6ionobftthepproperty, provided that in case of ahgl.disputerbetweenLtheapsrties, no forfeiture. shall be declared by the city while the lessee is proceeding in good faith to have the point in dispute determined by any court of competentjjuPdsdidtion. 7. All the provisions, terms and conditions of this lease shall be binding upon and accrue to the benefit of the successors and assigns bB the parties of said lease. AND BE IT FURTHER RESOLVED that the City Clerk is hereby directed to nouns this re- solution to be published in the Port Townsend Leader, a newspaper printed and published in the City Of Port ownsend, once a week for four consecutive weeks, together with a not- ice calling for sealbd bidetto be filed with the City Clerk not later than 12 o'clock, noon, on , the F 9day of , 1934, at the office of the City -Clerk in 1ti a Z`ity Cport Townsend, aecompan e y a.crtified check or deposit as herein- after stated. Each bid shall state the amount to be paid as rent for the term of said lease for said period of years, which bid shall be accompanied by a certified check payable to the order o e City of Port �.ownsend for an amount equal to one (1%)' per Cent, of the aggregate amount of rent bid for said year term, or in lieu there- of a deposit with said City Clerk a like sum in money. Sa_ notice shall require each bidder to state in his bid that if his bid be accepted and he fails to comply therewith within the time specified fo such compliance by Section 9513 and 9514 of Remington's Compiled Statutes of the State of Washington, his certified check or deposit shall be for- feited to said City. Said notice shall further state that the legislative authority of the City of Port Townsend reserves the right to reject any or all bids and to accept any b}d which it deems best. The leasing of said property shall be accomplished in the manner provided by Sections 9512 to'95141 inclusive, of Remington+s Compiled Statutes of the State of W'ashington,and pursuant to hte authority conferred hereby.
