Section 2. It was then moved by Councilman Aubert and seconded by Councilman Lafferty that the first reading be considered the second reading and that the third reading be by title only. Upon Roll Call, all six councilmen present voted in the affirmative and motion was declared carried. The said ordinance was then read by title only for the third reading, whereupon it wa: moved by Councilman Aubert and seconded by Councilman Lafferty that the ordinance be put upon final passage and that it do now pass. The following is a full, true, and correct copy of said Ordinance No. 1038, as passed by the City Council Dec. 19th, 1933,approved by the Mayor Dec. 20th, 1933, and published in the Port Townsend Leader Dec. 21st, 1933, to -wit: ORDINANCE NO. 1038. An Ordinance of the City of Port Townsend providing for the immediate appropriation and expenditure of money from the Current Expense Fund of the City of Port Townsend, and providing for an emerbgency. Whereas, the certain departmental budgets for the Current "xpense Fund of the City of Port Townsend for 1933 are now exhausted, and Whereas, and unusual call upon the expenditure of such funds could not have been fares seen at the time of the adoption of the budget for the Current Expense Fund for the year 1933, and Whereas, it now appears necessary and for the best interests of the people of the Cit; of Port Townsend that the following expenditures of money should be made, therefore, THE CITY COUNCIL OF THE CITY OF PORT TOwNSEND,;.WASHINGTON'; DOTORDAIN AS FOLLG.,S: Section 1. That this Ordinance be published once in the Port Townsend Leader and to be in force and take effect from and ofter five days from such publication. Passed by the City Council Dec. 19th, 1933. Deputy City Attorney Daly, for the information of the City Cain oil, brought up the matter of the Btate Business Tax on the revenues of the water System, stating that in an action brought by the Cities of Seattle and Tacoma, the State Tax Com- mission had been enjoined from collection of such taxes from municipally owned utilities where it appeared that the entire gross revenues of such utility had been pledged to the payment of bonds and interest on same. lie further stated that he had appeared before t' Tax Commission and asked for exemption .on behalf'of'the'water system of the city and was advised by the said Corission the the correct procedure would be, either to pay the tax and ask for a refund or to join in the suit to enjoin collection of the said tax. Y u, continued. 521 It was moved by Councilman Aubert and seconded by Councilman Townsend that the City Attorney be authorized to join in such suit on behalf of the City. Upon Hall Call, all six councilmen present voted in the affirmative and motion was declared carried. CHLORINE CONTRACT. 1 �• ' The Tacoma Electrochemical Co., submitted a renewal contract for furnishing the City },cam y with liquid chlorine for 1934 for water purification, the price quoted being 9V por pound } f.o.b. Tacoma. The contract submitted is a duplication of the 1933 except that the city r' pays all freights from Tacoma, instead of the Company as under the terms of the 1933 con- tract. It was moved by Councilman Townsend and seconded by Councilman Lafferty that the Mayor and the City Clerk be authorized to execute the said contract. Upon Roll Call, all i six councilmen present voted in the affirmative and motion was declared carried. � s i PROPOSED GASOLINE STORAGE ORDINANCE. i; Bringing up the 'matter of storage of gasoline in gatages and other buildings, it was moved by Councilman McGee and seconded by Councilman Aubert, that the City Attorney be in- s ••' structed to draw up and submit -an ordinance regulating the storage of gasoline in the City. za• Upon Roll Call, all six Councilmen present voted in the affirmative and motion was declared carried. CONDEMNED BUILDINGS. Councilman Aubert brought up the matter of certain buildings which were declared a fir ' hazard and nuisance by the City Council some time ago and asked what the next official pro- cedure would be. Deputy City Attorney Daly advised that the proper procedure would be to 1, institute a civil suit to abate the nuisance. To bring suit. I,1 It was then moved by Councilman Aubert and seconded by Councilman McGee that the City Attorney be instructed to bring civil suit to abate the nuisance exist- ing on the south half of Lot 7, Block 43 of the original Town Plat. Upon roll call, all six councilmen present voted in the affirmative and motion was declared carried. ADJOURNMENT. Upon motion of Councilman Townsend, seconded by Councilman Aubert, Council adjourned.
