Minutes of the Regular Session of April 4th, 1933, Continued.

was read in full by the City Clerk for the first reading. It was moved by Councilman Smitl
and seconded by Councilman Townsend that the first reading be considered the second read-
ing and that the third reading be by title only. Upon roll call all six Councilmen presen
voted In the affirmative and motion was declared carried.
Third Reading and Adoption:
The City Clerk then read the said Ordinance by title only for the third reading, wher
upon it was moved by Councilman Smith and seconded by Councilman Lafferty that said Ordi-
nance do now pass. Upon roll call all six Councilmen present voted in the affirmative and
motion was declared carried.
Copy of Ordinance:
The following is a full, true and correct copy of said Ordinance No.1027, passed by
the City Council April 4th, 1933, approved by the Mayor April 5th, 1933, and published in
the Leader April 6th, 1933, to -wit:
ORDINANCE NO. 1027
AN ORDINANCE providing for qualifications of applicants for the sale of certain be-
verages for the purpose of revenue, regulation and control and amending.
Ordinance No.1026 entitled "An Ordinance licensing the sale of certain
beverages for the purpose of revenue, regulation and control; providing
for the supervision and revocation of licenses; defining offences agains
said ordinance and providing penalties for the violation thereof.
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. That the fourth subdivision of Section 4 of Ordinance No.1026, passed by
the City Council March 30th, 1933; Approved by the Mayor March 30th, 1933, be and the same
is hereby amended to read as follows: A statement that the applicant is a citizen of the
United States of America and not less than twenty-one years of age; (if a corporation or
partnership, any of its officers or members as the case may be); that such applicant has n
been convicted of a felony or misdemeanor involving moral turpitude or of any State or Fed
eral laws or regulations or city ordinances rolating to the sale or possession of intoxi-
cating liquors or narcotics or of gambling, within a period of two years immediately pre-
ceding the date of application.
Section 2. That this ordinance be published once in the Port Townsend Leader and to
be in force and effect from and after five (5) days from date of publication.
Passed by the City Council April 4th, 1933.
Approved by the Mayor April 5th, 1933.

Re: Beverage Wholesalers:
Councilman Townsend asking an opinion from the City Attorney as to whether or not
wholesale:•houses shipping beer to the City could be compelled to take out a wholesaler's
license, and Mr. Daly replied that in his opinion the City would have no jurisdiction over
a non-resident not in business in the city. He stated, however, that he would look the
matter up further.
Non -Payment of Water Bills:
Councilman Smith brought up the matter of non-payment of large water bills contracted
in the past, stating that such a condition out down very seriously the revenues of the
Water Department. Councilman Smith then moved, seconded by Councilman Lafferty, that the
Council go on record that it was a concensus of opinion of the City Council that it was
opposed to service of water to such contracters and other such establishments until all
back charges are paid. Motion declared carried.
ADJOURNMENT.
Upon motion of Councilman Townsend, seconded by Councilman Lafferty, Council adjourned

The City Coun ell of the City of Port Tarnaend, Washington, met in regular session this
llth day of April, 1933 at 7:30 o'nlock P.M., in the Council Chambers of the City Hall,

ROLL CALL.
Upon Roll Call there were present Dep. City Attorney Wm. J. Daly, City Clerk C.F.Chris
tiam and Councilmen Geo. F. Townsend, Sam McGee, W. S. Lafferty, Y7m. Lammers,Sr, and Jacob
„ Miller, Councilman Smith arriving later in the session.

The minutes of the regular session of Mar'128th were read and approved as read.
Councilman Smith arrived during reading of the minutes.
The minutes of the regular session of April 4th were read and approved as read.
BILLS AND CLAIMS.
Fire Engine Payment:
The Clerk brought up the matter of annual payment ofi the Fire
Engine, advising that the next payment amounting to $2171.20 was due April 15th. It was
then moved by Councilman Smith and seconded by Councilman Lafferty that the Mayor and the
City Clerk be authorized and directed to draw warrants upon the proper fund to cover the
said instalment due April 15th. Upon roll call all six Councilmen present voted in the
affirmative and motion was declared carried.
LICENSES.
Applications for Beverage Licenses as defined by Ordinance No. 1026 as amended by
Ordinance No. 1027, were presented, read, and disposed of as follows:
From Lake and Johnson, proprietors of the MMabcantile Cash Grocery, to -wit:

For Retail License, to be consumed "off the premises."
Location, 825 Water Street.

It was moved by Councilman Lafferty and seconded by Councilman Smith that the said ap-
plication be granted. Upon roll call, all six Councilmen present voted in the affirmative
and motion was declared carried.
From Benjamin Franklin Thrift Stores, Frank Bettis. Mgr., to -wit:
Grocery:
For Retail License, to be consumed "off the premises."
Location, 906 Water Street (Mount Baker Block)

It was questioned if the licensa could be granted because of the time z'element:-clause
in the Ordinance, and it was then moved by Councilman Lafferty and seconded by Councilman
Miller that the application be not granted, Discussion followed, during which Mr. Bettis
and Mr. Henderson of the said applicants were granted permission to address the Council.
Mr. Daly, upon request for an opinion, stated that the provisions of the ordinance would
undoubtedly bar the granting of the application. There was a call for the question and
upon roll call Councilmen Lammers and Miller voted in the affirmative and Councilmen Town-
send, McGee, Smith and Lafferty in the negative. Motion declared lost.

Application laid over.
It was then moved by Councilman Townsend and seconded by Coun-
cilman Smith that the said application be put over to the next regular session. Motion
declared carried.
