(9)u 392 the City Council of March 7th, 1933, c It was moved by Councilman Lafferty and seconded by Councilman Lammers that the said claims be allowed, and that the Mayor and the City Clerk be authorized to draw warrants upon the proper funds in payment of same. Upon roll call all seven Councilmen voted in the affirmative and motion was declared carried. Unapproved Bills: The bills of the Puget Sound Power & Light Company,in the amount of $156.80 for street lighting and 025.25 for the City Hall, were considered too high and it was moved by Coun- cilman Smith and seconded by Councilman Lafferty that the bills be referred to the Fire & Light Oonunittee and the City Clerk to take the matter up with the said company to secure an adjustment in accordance with the contract. Motion declared carried. LaVera Damage Claim: The claim for damages, presented by Allan Trumbull, attorney for claimants, Manuel LaVera and Lucile Lavers, was presented and read in full, as follows: "Manuel LaVera and Lucille Lavers, ) husband and wife, Claimants, ) No. -vs - ) C L A I The City of Port Townsend, a munici-) pal corporation of the Third Class, ) Defendant. } Comes now the above named Claimants, Manuel LaVera and Lucille LaVera, who at all times herein mentioned were husband and wife, and present this; their claim, against the Defendant, the City of Port Townsend, a municipal corporation of the third class, and set forth, as follows: I. That on or about the 18th day of February, 1933, Lucille LaVera, wife of said Manuel LaVera, was driving a 1929 Dodge, Standard Six, Sedan, southerly on Harrison Street near Lawrence Street, in the City of Port Townsend, Jefferson County, VV'ashington. That the De- fendant, the City of Port Townsend, aforesaid, on the 18th day of February, 1933, and for a long time prior thereto, negligently and carelessly, permitted, allowed and maintained a large rock or stone to be, or remain, upon said street and highway, which fact;:was well- known to said City of Port Townsend and to its agents, or should have been known. That said Claimant, Lucille LaVera, while driving as aforesaid in a careful and prudent manner, col- lided with said rock, or stone, upon said street wrecking said car and inflicting severe bodily injuries, as follows: That the body of said car, steering gear, wheels, bumpers, fenders, the radiator, axle, chasis, windows, windshield were broken and destroyed, damag- ing the value of said car in the sum of Two Hundred and no/100 ($200.00) Dollars. That Claimant, Lucille LaVera, suffered severe sprains and bruises to her back and spine; and severe sprains, bruises and contusions to her limbs, arms and chest; and suffered severe cuts and bruises in and about her face and head; to the damage of Claimants in the sum of Two Thousand Five Hundred ($2500.00) Dollars. That it visa necessary:'for Claimant, Lucille LaVera, to have medical atten- tion and the services of physician and surgeon, and she is still under the care of her doctor. That the value of said medical attention is now undeterminable. That by reason of the damages and injuries, as aforesaid, to said Claimants, said Claimants have been damaged in the sum of Two 'Thousand Seven Hundred a2^r00.00) Dollars; and in the further sum of , for the services of a physician and surgeon. II. That said Manuel LaVera and Lucille LaVera, husband and wife, now are and they con- tinuously have been for more than six (6) months last past residents of the City of Port Townsend; and their place of residence during all said times has been at 355 'IE' Street in said city.
